A regular meeting of the Merit System Board was held on
Tuesday, November 21, 2000, in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz, Merit System Board
Members, Margaret E.L. Howard and Leo Vartan; Andrea Grundfest,
Deputy Attorney General; and Henry Maurer, Director, Division of
Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Janice Mitchell
Mintz, opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on November 8, 1999 and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise
specified.

SUBJECT: Change in the Classification Plan

DEPARTMENT OF LABOR

The Department of Labor is requesting a one-range salary increase
for the title of Disability Insurance Supervisor.

Changes over the past several years have impacted the know-how
factors of the Disability Insurance Supervisor. The Temporary
Disability Insurance Service was upgraded to division status.
The Division assumed a number of responsibilities previously
performed by another unit, including fraud abuse, medical
relations, and field investigations. Operations and staff have
shifted from that which was primarily clerical to primarily
professional. Legislative changes and case law precedents have
increased the complexity factors affecting temporary disability
insurance determinations. The Department intends to increase the
amount of supervisory experience required for appointment to this
title by one year.

We believe this one-range increase is warranted.

A-5 ALBERT ENGESSER

Albert Engesser, Police Sergeant, Township of Parsippany
Troy Hills, Police Department, suspension for 6 months and
demotion effective July 14, 1999, on charges of conduct
unbecoming a public employee, neglect of duty, withholding
information, reporting violation of laws, ordinance, rules
or orders, compromising criminal cases, truthfulness and
misconduct observed by police personnel.

Recommendation of the Administrative Law Judge - Uphold the
6-month suspension and the demotion, and award the
respondent counsel fees in the amount of $3,364.60.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

Stephen Greene, Electrician, Camden County Municipal
Utilities Authority, removal effective February 2, 2000, on
charges of failure and inability to perform duty.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to a resignation
in good standing.

Harold Weigle, Inspector, Fire Safety with the Department of
Community Affairs, removal on charges, requests back pay.

Recommendation of the Administrative Law Judge - Appellant
be paid back pay from January 4, 1999 through the date of
his reinstatement.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-12 WILLIAM T. ECKSTEIN, JR.

William T. Eckstein, Jr., Marine Mechanic, Division of State
Police, Department of Law and Public Safety, release at the
end of the working test period effective April 24, 1998.

Recommendation of the Administrative Law Judge - Grant a new
working test period.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-13 KAREN BREVOGEL

Karen Brevogel, Senior Practical Nurse, County of
Burlington, Buttonwood Hospital, removal effective April 22,
1998, on charges of incompetency, inefficiency or failure to
perform duties; conduct unbecoming a public employee and
neglect of duty.

Recommendation of the Administrative Law Judge - Modify the
removal to a 90-day suspension.

ACTION: The Merit System Board directed that this matter
be held over.

A-14 ROBERT DAVIS - SETTLEMENT

Robert Davis, Senior Correction Officer, East Jersey State
Prison, Department of Corrections, removal effective May 24,
1999, on charges of conduct unbecoming an employee. Settled
to a resignation in good standing.

ACTION: The Merit System Board acknowledged the
settlement.

David MacNeil appeals his rejection as a County Correction
Officer by the County of Monmouth and its request to remove
his name from the eligible list for County Correction

ACTION: The Merit System Board directed that this appeal
be denied.

Kevin Moyer appeals his rejection as a Fire Fighter by the
City of Camden and its request to remove his name from the
eligible list for Fire Fighter on the basis of psychological

Ricardo Leaty, represented by Anthony J. Fusco, Esq.,
appeals the removal of his name from the eligible lists for
Police Officer (S9999W and S9999V), City of Plainfield, on
the basis of an unsatisfactory criminal record.

ACTION: The Merit System Board directed that this appeal
be denied.

Theresa Myers, represented by Daniel J. Zirrith, Esq.,
appeals the decision of Human Resource Information Services
which upheld her bypass on a certification of the list for
Receptionist/Telephone Operator (S6151W), Judiciary, Union
County Vicinage.

ACTION: The Merit System Board directed that this appeal
be denied.

B-20 NATHAN T. PLESKONKO

Nathan T. Pleskonko appeals the decision of Selection
Services which upheld the Department of Corrections' request
for the removal of the appellant's name from the Correction
Officer Recruit (S9999W) eligible list due to an
unsatisfactory criminal and driving record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-21 BARBARA FLANAGAN

Barbara Flanagan, a former Head Nurse, 12 Months, with
Woodbridge Developmental Center, Department of Human
Services, represented by Benjamin Spivak, Senior Staff
Representative, CWA Local 1040, requests reconsideration of
the final administrative decision, rendered June 8, 1999,
which upheld the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board granted the request for
reconsideration but denied the request for sick
leave injury (SLI) benefits.

B-22 JOHN L. ROBINSON, III

John L. Robinson, III, a Job Developer with the City of
Jersey City, petitions the Merit System Board for
reconsideration of the final administrative decision,
rendered April 8, 1999, which found that Robinson should be
suspended for six months.

ACTION: The Merit System Board denied the request for
reconsideration.

B-23 BRIAN WHITTLE

Brian Whittle, a Fire Fighter with the City of East Orange,
represented by Eldridge Hawkins, Esq., seeks enforcement of
that part of the Merit System Board decision rendered on
June 8, 1999, granting him back pay for the period following
his six-month suspension to the date he returned to work.

ACTION: The Merit System Board established that the time
period for which appellant is to receive back pay
is from September 11, 1998, following his six-
month suspension, to September 27, 1999, the date
of his immediate suspension. The Merit System
Board also granted a hearing on the issue of the
amount of back pay and counsel fees to which the
appellant is entitled.

B-24 HENRY BUSSEY

Henry Bussey, a Senior Correction Officer with Northern
State Prison, Department of Corrections, represented by
Robert A. Fagella, Esq., requests that the Merit System
Board review the amount of back pay which he is due as a
result of his being exonerated of criminal charges for which
he had been indefinitely suspended on January 21, 1998.

ACTION: The Merit System Board granted a hearing.

B-25 COORDINATOR, FEDERAL AND STATE AID (C0458O), ESSEX COUNTY

The Superior Court, Appellate Division, has remanded for
reconsideration the decision of the Merit System Board,
rendered on July 11, 2000, denying the appointing
authority's request for an appointment waiver for
Coordinator, Federal and State Aid (C0458O), Essex County
and assessing $1,000 for the administrative costs of
ensuring compliance with the certification and appointment
procedures.

ACTION: The Merit System Board granted the request for
reconsideration and appointment waiver. The Merit
System Board rescinded compliance costs but
assessed the costs of the selection process.

B-26 THERESA ANDERSEN

Theresa Andersen appeals the determination of the Division
of Selection Services, which denied her eligibility for
admittance to the open competitive examination for Paralegal
Technician 2 (S0318W).

ACTION: The Merit System Board directed that this appeal
be denied.

B-27 BARBARA S. COHEN

Barbara S. Cohen appeals the determination of the Division
of Selection Services, which found that she did not meet the
experience requirements for the promotional examination for
Management Improvement Specialist 2 (PS8783K), Division of
Youth and Family Services.

ACTION: The Merit System Board directed that this appeal
be granted.

B-28 CATHERINE GRAHAM

Catherine Graham appeals the determination of the Division
of Selection Services, which found that she did not meet the
experience requirements for the promotional examination for
Secretarial Assistant 3 (Non-Stenographic) (PS8189K),
Greystone Park Psychiatric Hospital.

ACTION: The Merit System Board directed that this appeal
be denied.

B-29 PATRICIA A. JIORLE

Patricia A. Jiorle appeals the determination of the Division
of Selection Services which found that she did not meet the
experience requirements for the promotional examination for
Technical Assistant Management Information Systems
(PS9310K), Hunterdon Developmental Center.

ACTION: The Merit System Board directed that this appeal
be granted.

B-30 RONNIE P. LOTTERMANN

Ronnie P. Lottermann, represented by Thomas M. Zisa, Esq.,
appeals the determination of the Division of Human Resource
Management which found that he was ineligible for the
promotional examination for Public Works Superintendent
(PM0377B), Borough of Fair Lawn, due to his not being
permanent in a title to which the examination was open.

ACTION: The Merit System Board directed that this appeal
be denied.

B-31 FLETCHER MARTINIQUE

Fletcher Martinique appeals the determination of the
Division of Selection Services, which found that he failed
to indicate the proper licensure for the open competitive
examination for Electrical Subcode Official (M9076O),
Middletown Township.

ACTION: The Merit System Board directed that this appeal
be denied.

Veronica McArdle appeals the determination of the Division
of Selection Services, which found that per the substitution
clause for education, she did not meet the experience

be granted.

Edward A. Moore appeals the determination of the Division of

transcript or list of courses and credits required to
evaluate education for the promotional examination for

ACTION: The Merit System Board directed that this appeal

Anna M. Sexton appeals the determination of the Division of
Human Resource Management which found that she was not
permanent in a title to which the promotional examination
was open for Senior Clerk Typist (PC2931A), Morris County.

ACTION: The Merit System Board directed that this appeal
be denied.

B-50 WALLY NANCE

Wally Nance appeals several test items on the promotional
examination for Water Repairer (M0871A), City of Trenton.

ACTION: The Merit System Board directed that this appeal
be denied.

B-51 GEORGE LAUTH, ET AL.

George Lauth, John Moran and Henry Toudy appeal the written
examination for Correction Lieutenant (PS6320I), Department
of Corrections.

ACTION: The Merit System Board directed that this appeal
be granted in part.

B-52 THOMAS AIELLOS

Thomas Aiellos appeals the validity of the examination for
Police Lieutenant (PM2587A), Hackensack.

ACTION: The Merit System Board directed that this appeal
be denied.

B-53 NICHOLAS LUCIVERO

Nicholas Lucivero appeals the attached decision of Human
Resource Information Services (HRIS) removing him from the
Safety Specialist 2 DV special reemployment list due to his
failure to respond to a notice of certification.

ACTION: The Merit System Board directed that this appeal
be granted.

B-54 MERIT SYSTEM BOARD PROPOSED MEETING DATES FOR 2001

The Merit System Board proposed meeting dates for 2001 are
submitted for approval

ACTION: The Merit System Board approved the proposed
meeting dates for 2001.

B-55 JEFFREY MARSHALL

The appeal of Jeffrey Marshall, a Police Sergeant with the
City of Newark of his 15-day suspension on charges, was
heard by Administrative Law Judge Thomas R. Vena (ALJ), who
rendered his initial decision on July 26, 2000, recommending
that the appellant receive a five-day suspension and an
official reprimand. At its meeting on October 24, 2000, the
Board upheld the 15-day suspension. The proposed final
decision is now submitted for the Board's review.

ACTION: The Merit System Board directed that this matter
be held over.

B-56 JOHN FORMISANO AND TYRONE MORTON

The appeals of John Formisano and Tyrone Morton, both Police
Officers with the Newark Police Department, of their 35-day
suspensions beginning March 8, 1999 on charges, was heard by
Administrative Law Judge Michael L. Ravin (ALJ), who
rendered his initial decision on July 20, 2000. At its
meeting on October 24, 2000, the Merit System Board did not
adopt the ALJ's recommendation to vacate the suspensions.
Rather, the Board concluded that the five-day suspensions
were warranted. The proposed final decision is now
submitted for the Board's review.

ACTION: The Merit System Board directed that this matter
be held over.

B-57 DOLORES PHILLIPS

Dolores Phillips, formerly a Senior Parole Officer with the
Department of Corrections (DOC), represented by David
Tykulsker, Esq., appeals DOC's denial of her request to
extend her medical leave of absence.

ACTION: The Merit System Board granted a hearing.

B-58 SHEILA GRAFTON

Sheila Grafton, represented by Steven P. Weissman, Esq., and
the Department of Human Services (DHS), petitions the Merit
System Board for acknowledgement of the settlement agreement
reached by the parties in United States District Court,
Civil Action No. 95-6490(GEB).

ACTION: The Merit System Board acknowledged the
settlement.

B-59 ANDRE KRAWTSCHENKO

Andre Krawtschenko appeals the determination of the Division
of Selection Services regarding the scoring of the
examination for Supervisor Engineer 2, Surface Design
(PS4570T), Department of Transportation.

ACTION: The Merit System Board directed that this appeal
be denied.

B-60 PROBATION OFFICER, ET AL.

The Director, Division of Human Resource Management,
requests that the titles of Probation Officer; Probation
Officer, Bilingual in Spanish and English; Probation Officer
Child Support Enforcement; and Probation Officer Child
Support Enforcement, Bilingual in Spanish and English within
the Judiciary be allocated to the noncompetitive division of
the career service on an interim basis for two complete pay
periods where lists currently do not exist.

ACTION: The Merit System Board granted the request.

B-61 MERIT SYSTEM BOARD MINUTES

The Merit System Board Minutes for the meeting of November
14, 2000 are submitted for adoption.

ACTION: The Merit System Board adopted the minutes of the
meeting of November 14, 2000.

There being no further business before the Merit System
Board, the meeting was adjourned to convene on Tuesday, December
5, 2000, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
