A regular meeting of the Merit System Board was held on Wednesday, March 13, 2002, in Trenton, New Jersey.

PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Alan Dexter Bowman, Josephine DiRienzo, and Leo R. Vartan; Barbara Bereski, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on February 13, 2002, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

CONFIDENTIAL APPOINTMENTS
The Merit System Board recorded the following Confidential Appointments under N.J.S.A. 11A:3-4(h):

Kathleen Treacy appointed as Confidential Secretary, Department of Labor effective January 22, 2002, salary of $ 40,000.00 per annum.

Jody Massimino appointed as Confidential Secretary, Department of Labor effective January 22, 2002, salary of $60,000.00 per annum.

Settled to a resignation in good standing effective November 17, 2001 and a lump sum payment of $3,300.

George Aninwene, formerly an Associate Hospital Administrator 2, Greystone Park Psychiatric Hospital, Department of Human Services (DHS), represented by Dena Epstein, Esq., appeals the determination of the Assistant Commissioner for Human Resources, DHS, which found there was no violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-44 BONAFACE EMEANA
Bonaface Emeana, a Classification Officer 2 with Northern State Prison, Department of Corrections, appeals the determination of the Assistant Commissioner for Human Resources, Department of Human Services (DHS), which found that he failed to present sufficient evidence to support a finding that he had been subject to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace. It is noted that at the time of appellant's complaint, he was employed as a Family Service Specialist 3 with the Division of Youth and Family Services, DHS.

ACTION: The Merit System Board directed that this appeal be denied.

B-45 PETER JACKSON
Peter Jackson, a former Associate Professor at Kean University (University), appeals the determination of the President of the University, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-46 MARGO MORGAN
Margo Morgan, Clinical Psychologist 2, with Ancora Psychiatric Hospital, Department of Human Services (DHS), appeals the determination of the Assistant Commissioner for Human Resources, DHS, which found that the appellant failed to present sufficient evidence to support a finding of probable cause that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-47 KATHRYN C. HAUCK
Kathryn C. Hauck, a Head Nurse (12 Months) with the Senator Garrett W. Hagedorn Psychiatric Hospital, Department of Human Services (DHS), appeals the decision of the Assistant Commissioner for Human Resources denying her request for a reasonable accommodation.

ACTION: The Merit System Board directed that this appeal be denied.

B-48 GARY DIMATTIA
Gary DiMattia, an Assistant Engineer in Charge of Maintenance 2 at Riverfront State Prison, Department of Corrections, represented by Robert Yaeger, CWA Local 1040, petitions the Merit System Board (Board) for reconsideration of the final decision rendered on September 25, 2001, which upheld the 30-day suspension and recommended that the appellant complete a training program on the supervision and handling of subordinates and on behavior management.

ACTION: The Merit System Board denied the request for reconsideration.

Robert Smith appeals the decision of the Division of Selection Services which found that he lacked the required amount of permanent status in a title to which the examination was open for Manager 1 Human Resources (PS0903K), Hunterdon Developmental Center.

The Rockaway Township Police Department appeals the determination of the Director, Office of Intergovernmental Services, which denied its request for the transfer of Jason Tozzi from the title of Sheriff's Officer, Hunterdon County Sheriff's Office, to the title of Police Officer, Rockaway Township Police Department.

ACTION: The Merit System Board directed that this appeal be granted.
