A regular meeting of the Merit System Board was held on
Wednesday, May 29, 2002, in Trenton, New Jersey.
PRESENT: Chairwoman Ida L. Castro, Merit System Board

In accordance with L.1975, c.231, Chairwoman Ida L. Castro
opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and
Star Ledger on March 7, 2002, and posted at the Department
of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.
CONFIDENTIAL APPOINTMENTS
The Merit System Board recorded the following Confidential
Appointments under N.J.S.A. 11A:3-4(h):
Mr. Christopher Campos appointed as Confidential
Assistant, Department of Transportation effective April 20,
2002, salary of $60,000.00 per annum.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE
CASES - SETTLEMENT
ACTION: The Merit System Board acknowledged the settlements.
A-2 WARREN GRIFFITH AND AUSTIN JACKSON (CONSOLIDATION)
Warren Griffith and Austin Jackson, Police Officers, City
of Newark, Police Department, 30-day suspensions, on charges
of violation of Police Department rules and regulations regarding
disobedience of orders, leaving an assigned post, neglect
of duty, and personal conduct.
Recommendation of the Administrative Law Judge - Modify
the 30-day suspensions to 20-day suspensions.
ACTION: The Merit System Board reversed the recommendation
of the
Administrative Law Judge.
A-3 HARRY WILLIAMS
Harry Williams, Senior Correction Officer, Northern State
Prison, Department of Corrections, five-day and 15-day suspensions
on charges of violation of various Department rules regarding,
inter alia, intentional misrepresentation of facts and leaving
an assigned work area creating a danger to persons or property.
Recommendation of the Administrative Law Judge - Reverse
the five-day suspension. It is noted that the ALJ initially
identified the second discipline as a 15-day suspension on
pages 1 and 3 of his initial decision. However consistently
thereafter, he refers to the discipline as a ten-day suspension.
His recommendation is to modify the penalty to a four-day
suspension.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.
A-4 ROBERT BLADES
Robert Blades, County Correction Officer, County of Burlington,
County Jail, removal effective April 6, 2000, on charges of
incompetency, inefficiency or failure to perform duties, insubordination,
neglect of duty, and violation of rules and regulations.
Recommendation of the Administrative Law Judge - Uphold
the removal.
ACTION: The Merit System Board modified the recommendation
of the
Administrative Law Judge to a six-month suspension.
A-5 ROBIN GRIER
Robin Grier, Senior Correction Officer, Northern State Prison,
Department of Corrections, removal effective October 5, 1999,
on charges of conviction of a crime, conduct unbecoming a
public employee, and other sufficient cause.
Recommendation of the Administrative Law Judge - Pursuant
to an order of forfeiture, dismiss the appeal as moot.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.
A-6 STEPHEN MARKUS
Stephen Markus, Senior Correction Officer, Edna Mahan Correctional
Facility for Women, Department of Corrections, removal effective
January 12, 2001, on charges of conduct unbecoming a public
employee, violation of Department rules regarding physical
or mental abuse of an inmate, personal conduct, safety and
security precautions and improper or unauthorized contact
with inmate, undue familiarity with inmates, parolees, their
families or friends.
Recommendation of the Administrative Law Judge - Uphold
the removal.
ACTION: The Merit System Board affirmed the recommendation

1998, on charges of conduct unbecoming a public employee,

ACTION: The Merit System Board affirmed the recommendation

Patricella Jackson, Communications Operator, East Jersey
State Prison, Department of Corrections, removal effective
February 14, 2001, on charges of conduct unbecoming a public
employee, actual or attempted theft of State property, intentional
abuse or misuse of authority of position and falsification.

Robert Burnside, City of Atlantic City, Department of Public
Safety, initial 30-day suspension charges of conduct unbecoming
a public employee, insubordination, and general causes. Settled
to a fine of $823.52 equal to five day's pay.
Recommendation of the Administrative Law Judge - Acknowledge
the settlement.

Kuomar Fitzgerald appeals the decision of Selection Services
which upheld the removal of the appellant's name from the
Correction Officer Recruit (S9999A), Department of Corrections,
eligible list due to an unsatisfactory criminal record.

the decision of Selection Services which upheld the bypass
of his name for appointment from the April 3, 2001 certification
of the Correction Sergeant (PS7099I), Department of Corrections,
eligible list. Additionally, the appellant appeals the bypass
of his name for appointment from the July 23, 2001 certification
of the subject eligible list as it pertains to Bayside State
Prison, Southern State Correctional Facility, and South Woods
State Prison.

Kathleen Gray, a former Education Program Development Specialist,
Special Education with the Juvenile Justice Commission, Department
of Law & Public Safety, represented by Mario A. Iavicoli,

to support a finding that she had been subjected to violations

the provisional appointee, make an appointment from the

B-27 CHARLES J. ROWAN, JR.
Charles J. Rowan, Jr., represented by James P. Madden, Esq.,
seeks enforcement of the Merit System Board decisions, rendered
on September 28, 1999 and November 14, 2000, which ordered
his reinstatement to the position of Fire Fighter with the
Town of Kearny with Seniority and benefits from the February
26, 1999 and awarded him back pay from November 5, 1999 to
the date of actual reinstatement.
ACTION: The Merit System Board granted the appellant
the gross amount
of $46,276.87 for back pay plus longevity increases, but denied
the
requests for counsel fees, interest and fines.
B-28 TELISSA DOWLING
Telissa Dowling, represented by Maha Munayyer, Esq., and
Hudson County, represented by Assistant County Counsel Charles
D'Amico, petition the Merit System Board for acknowledgment
of the settlement agreement reached by the parties regarding
Dowling's employment status. This matter was held over by
the Merit System Board at its April 10, 2002 meeting.
ACTION: The Merit System Board directed that this
matter be held over.
B-29 JOHN RAUBE
John Raube, a Senior Correction Officer at Bayside State
Prison, Department of Corrections, petitions the Merit System
Board of back pay, benefits, seniority and counsel fees.
ACTION: The Merit System Board granted the appellant
back pay in the
gross amount of $33,756.94 and awarded seniority, vacation
and
sick leave, but denied the requests for administrative leave
and
counsel fees.
B-30 BARBARA CATLETT, ET AL.
The consolidated appeals of Barbara Catlett and Elena McAllister,
both Head Nurses, and Janet Cook Flanagan, a Pharmacy Assistant,
at Southern State Correctional Facility, Department of Corrections,
of their resignations not in good standing and the appeals
of Catlett and McAllister of the denial of sick leave injury
(SLI) benefits, were heard by Administrative Law Judge Robert
W. Scott (ALJ), who rendered his initial decision on December
13, 2002. At its meeting on April 10, 2002, the Merit System
Board (Board) did not adopt the ALJ's recommendation to uphold
the appellants resignations not in good standing. Additionally,
the Board did not adopt the ALJ's recommendation to uphold
the denial of SLI benefits for Catlett and McAllister. Rather,
the Board reversed the resignations not in good standing of
the appellants and granted SLI benefits to Catlett and McAllister.
The proposed final decision is now submitted for the Board's
review.
ACTION: The Merit System Board adopted the final
decision.

B-31 CRAIG DICKSON
The appeal of Craig Dickson, a Truck Driver with the Department
of Public Works, Township of Pennsauken, of his removal effective
December 1, 2000 on charges, was heard by Administrative Law
Judge Bruce R. Campbell (ALJ), who rendered his initial decision
on March 11, 2002, upholding the removal. At its meeting on
April 24, 2002, the Merit System Board did not adopt the ALJ's
recommendation. Rather, the Board ordered that the matter
be remanded to the Office of Administrative Law. The proposed
decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the decision.

The appeal of Robert Lockett, an Industrial Manager 2 at
the Albert C. Wagner Youth Correctional Facility, Department
of Corrections, of his removal effective December 1, 1999
on charges, was heard by Administrative Law Judge John R.
Tassini (ALJ), who rendered his initial decision on January
18, 2002, reversing the removal. At its meeting on April 24,
2002, the Board ordered that this matter be remanded to the
Office of Administrative Law. The proposed decision is now
submitted for the Board's review.
ACTION: The Merit System Board adopted the final
decision.

B-33 ROMONA HARVEY v. DIVISION OF YOUTH AND FAMILY SERVICES
(DYFS), DEPARTMENT OF HUMAN SERVICES
Administrative Law Judge (ALJ) Kathryn A. Clark issued an
Order of Consolidation and Predominant Interest in the above-captioned
matter. Based on the ALJ's Order, the Merit System Board and
DYFS developed a joint order which is now submitted for the
Board's review.
ACTION: The Merit System Board adopted the joint
order.

Edward J. Adams appeals the determination of the Division
of Selection Services which found that he did not meet the
experience requirement for the Program Specialist, Alcohol
Abuse Activities (M1679C), Freehold Township, open competitive
examination.
ACTION: The Merit System Board directed that this
appeal be denied.

Dorothy Burton appeals the determination of the Division
of Selection Services, which found that, per the substitution
clause for education, she did not meet the experience requirements
