A regular meeting of the Merit System Board was held on Wednesday, December 17, 2003 , in Trenton , New Jersey .

 PRESENT: Ida L. Castro, Chairwoman, Merit System Board Members, Josephine DiRienzo, Margaret E. L. Howard and Robert J. Long; Lisa Ruch, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Presiding Board Member Howard opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2003, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

DEPARTMENT OF MILITARY AND VETERANS AFFAIRS

The Department of Military and Veterans Affairs requests a three-range upward salary re-evaluation for the Director and Assistant Director of Nursing Services titles.

The Department cites a change in the accountability factors affecting the Hay evaluation. The job descriptions have been updated to reflect these changes, and the experience requirements have been increased. The Department also requests a title verbiage change at the Director's level for consistency in nomenclature.

This salary re-evaluation will place these titles on a par with their counterparts at Human Services who are performing similar duties.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION: The Merit System Board acknowledged the settlements.

A-2 JAMES BONSPER

James Bonsper, Fire and Ambulance Dispatcher, City of Jersey City, Department of Fire and Safety Services, fine equal to 33 days' and 5.5 hours' pay, on charges of incompetency, inefficiency or failure to perform duties, insubordination and neglect of duty.

Recommendation of the Administrative Law Judge - Modify the fine equal to 33 days' and 5.5 hours' pay to a 30-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-3 GLOUCESTER COUNTY LAYOFF

Kathleen McCann, Jeanne McManus and Anthony Strickland, various titles, County of Gloucester , appeal the good faith of their layoff effective May 20, 2002 , for reasons of economy and efficiency.

Recommendation of the Administrative Law Judge - Modify the 60-day suspension to a 120-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-6 RICHARD SHEPPARD

Richard Sheppard, Senior Correction Officer, Southern State Correctional Facility, Department of Corrections, 30-day suspension on the charges of conduct unbecoming a public employee, verbal abuse, discrimination, and threatening, harassing, coercing, or interfering with fellow employees on state property.

Recommendation of the Administrative Law Judge - Uphold the 30-day suspension.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 120-day suspension.

A-7 BARRY BAILEY

Barry Bailey, Custodial Worker, Newark School District , removal effective

July 15, 2002 , on charges of insubordination, chronic or excessive absenteeism or lateness, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-8 SHEILA HUGHES

Sheila Hughes, Investigator Public Defender, Law Guardian, Office of the Public Defender, removal effective January 28, 2000 , on charges of incompetency, inefficiency or failure to perform duties and neglect of duty.

Recommendation of the Administrative Law Judge - Modify the removal to a six-month.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold the removal.

A-9 BAISHAWN JONES

Baishawn Jones, Customer Service Representative 3, Department of Health and Senior Services, two removals effective May 20, 2002, on charges of insubordination, conduct unbecoming a public employee, and creating a hostile work environment.

Recommendation of the Administrative Law Judge - Uphold the removals.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-10 CHARLES MOTLEY

Charles Motley, Laborer, City of Newark, Engineering Department, removal effective March 17, 1999, on the charge of failure to comply with the City of Newark's residency ordinance.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION: The Merit System Board directed that this matter be held over.

A-11 ERIC PRICE

Eric Price, Cottage Training Technician, New Lisbon Developmental Center , Department of Human Services, removal effective June 7, 2002 , on the charge of physical abuse of a client.

Recommendation of the Administrative Law Judge - Modify the removal to a 15-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

SECTION B - MISCELLANEOUS MATTERS

B-1 GARY HUHN

Gary Huhn, represented by Timothy Smith, Esq., appeals his rejection as a County Correction Officer candidate by the County of Monmouth and its request to remove his name from the eligible list for County Correction Officer on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal be denied.

B-2 IRENE LECHER

Irene Lecher, a Supervisor 2, Word Processing Center , with Trenton Psychiatric Hospital , Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal be denied.

B-3 ALAN P. BORES

Alan P. Bores appeals the determination of the Division of Human Resource Information Services (HRIS) which upheld the removal of his name from the eligible list for Sheriff's Officer (S9999D), Burlington County on the basis that he did not complete pre-employment processing.

ACTION: The Merit System Board directed that this appeal be granted.

B-4 RENEE CABINESS

Renee Cabiness appeals the decision of Human Resource Information Services (HRIS), which upheld the removal of her name from the County Correction Officer (S9999A), Hudson County , eligible list based on an unsatisfactory employment record.

ACTION: The Merit System Board directed that this appeal be granted but that the appellant's name be reflected on the February 22, 2000 certification as bypassed.

B-5 SETH JACKSON

Seth Jackson, represented by Steven J. Kossup, Esq., appeals the decision of Human Resource Information Services (HRIS), which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Fire Fighter (M2070A), City of Newark , on the basis of an unsatisfactory background report.

ACTION: The Merit System Board directed that this appeal be denied and Seth Jackson's status be recorded as forever disqualified from public employment pursuant to N.J.S.A. 2C:51-2(d).

ACTION: The Merit System Board denied the request for reconsideration.

B-21 SEAN CHINSOON

Sean Chinsoon, a County Correction Officer with Monmouth County , Department of Corrections, seeks enforcement of the Merit System Board decision, rendered on August 12, 2003 , which awarded him back pay and benefits.

ACTION: The Merit System Board granted a hearing.

B-22 LAWRENCE DAVIS

Lawrence Davis, a Police Officer with the City of Trenton, represented by Kevin Kovacks, Esq., requests counsel fees in accordance with the Merit System Board decision, rendered on May 7, 2003, which reversed his removal. The appellant also requests an award of interest on his back pay award.

ACTION: The Merit System Board awarded counsel fees in the amount of $65,317.50 and costs in the amount of $30,334.25 but denied the request for interest.

B-23 JOHN CARTER

Bordentown Township , represented by Gregory J. Sullivan, Esq., requests interlocutory review of the decision of Acting Chief Administrative Law Judge Jeff S. Masin (ALJ) in John Carter v. Bordentown Township, pursuant to N.J.A.C. 1:1-14.10(a).

ACTION: The Merit System Board granted the request for interlocutory reviews and directed that the ALJ be reversed and the charges reinstated.

B-24 ROBIN BLOUNT

Robin Blount, Senior Correction Officer, South Woods State Prison, Department of Corrections, represented by Michael K. Sharp, PBA Local #105, appeals minor discipline of a five day suspension.

ACTION: The Merit System Board directed that this appeal be granted.

Veronica Allen appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Administrative Analyst 4 (PS4635K), Ancora Psychiatric Hospital .

ACTION: The Merit System Board directed that this appeal be denied.
