    A regular meeting of the Civil Service Commission was held on Wednesday, April 1, 2015, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Yvette Franklin, Cook-12 months, New Jersey Department of Children and Families, 7 working day suspension.

 

Thomas Lasky, Ocean County Department of Security, release at the end of working test period.

 

ACTION:       The Civil Service Commission noted the dismissal of appeals without prejudice.

Arnold Alfano, Firefighter, City of Hoboken, Fire Department, removal effective November 16, 2012, on charges of conduct unbecoming a public employee, violation of rules and regulations, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Grant summary decision and uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3      ANDREW J. BISCIEGLIA  

 

Andrew J. Biscieglia, Firefighter, City of Atlantic City, Fire Department, removal effective August 19, 2014, on charges of conduct unbecoming a public employee, neglect of duty, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the removal to a five-day suspension.

 

ACTION:       The Civil Service Commission ordered a review of the hearing record.

 

A-4      DOUGLAS DAND 

 

Douglas Dand, County Correction Officer, Monmouth County, Department of Corrections and Youth Services, 10-day suspension on charges of inability to perform duties, neglect of duty, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the 10-day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Jaime Dela Cruz, Mechanical Equipment Specialist, Ramapo College of New Jersey, removal effective November 27, 2013 on charges of incompetency, inefficiency, or failure to perform duties; conduct unbecoming a public employee, and discrimination that affects equal employment opportunity including sexual harassment.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6      JESSICA FACKLER   

Jessica Fackler, Public Safety Telecommunicator, Salem County, Sheriff's Department, removal effective November 6, 2013, on charges of chronic or excessive absenteeism or lateness.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

            ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a 10 working day suspension.

 

A-7      DAVID KENNEY

 

David Kenney, County Correction Officer, Burlington County Jail, 20-day suspension on charges of conduct unbecoming a public employee, neglect of duty, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the 20-day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8      NICOLA KNOX    

Nicola Knox, Firefighter, Atlantic City, Fire Department, removal effective September 18, 2014, on charges of inability to perform duties, chronic or excessive absenteeism, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

            ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a six month suspension and ordered that the appellant undergo a fitness for duty examination before returning to work.

 

A-9      ROBERT LACAILLADE 

 

Robert Lacaillade, Correction Sergeant, Bayside State Prison, Department of Corrections, removal effective August 1, 2014, on charges of conduct unbecoming a public employee, neglect of duty, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-10    RAYMOND POWELL (REMAND)

 

Raymond Powell, Code Enforcement Officer, Jackson Township, Department of Community Development, removal effective July 22, 2013, on charges of conduct unbecoming a public employee and other sufficient cause.

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

The Division of Agency Services requests reactivating the title of Social Work Supervisor, Bilingual in Spanish and English.

 

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-2      A. M. - CSC DOCKET NO. 2015-119

 

A. M. appeals the request by the County of Essex to remove his name from the County Correction Officer (C9979M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-3      C. M. - CSC DOCKET NO. 2014-1041

 

C. M. appeals the request by the City of Newark to remove his name from the Fire Fighter (M2554M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-4      G. W. - CSC DOCKET NO. 2014-1304

 

G. W. appeals the request by the County of Hudson to remove her name from the County Correction Officer (C9977M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-5      MARIE DIEUJUSTE - CSC DOCKET NO. 2015-1728

 

Marie Dieujuste, a Human Services Assistant with the Department of Human Services, Greystone Park Psychiatric Hospital, appeals her lateral displacement in lieu of layoff to the same title, part-time, at Trenton Psychiatric Hospital.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-6      DONALD GOURDINE - CSC DOCKET NO. 2011-5022

 

Donald Gourdine, a former Supervising Security Guard with Jersey City, appeals the determination of his layoff rights by the Division of State and Local Operations.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part.

 

B-7      LINDA BROWN - CSC DOCKET NO. 2015-852

 

Linda Brown, a Senior Library Assistant with Atlantic County, petitions the Civil Service Commission for interim relief of a 45 working day suspension.

 

ACTION:       The Civil Service Commission directed that this matter be referred to the Office of Administrative Law for a hearing.

 

B-8      JOHN BUONANNO - CSC DOCKET NO. 2015-407

 

The Superior Court of New Jersey, Appellate Division, has remanded the issue of John Buonanno's status as a Construction Official with the Borough of Elmwood Park to the Civil Service Commission.

 

ACTION:       The Civil Service Commission determined that the appellant is not entitled to a permanent appointment as a Construction Official.

 

B-9      STANLEY KOLBE, JR. - CSC DOCKET NO. 2015-1186

 

Stanley Kolbe, Jr., a Fire Fighter with the City of Pleasantville, represented by Mark E. Belland, Esq., requests enforcement of the final decision rendered on May 21, 2014 which ordered his retroactive appointment for salary step placement and seniority-based purposes.

 

ACTION:       The Civil Service Commission directed that the request for enforcement be dismissed for lack of jurisdiction.

 

B-10    JOSE BERRIOS - CSC DOCKET NO. 2014-2327

 

Jose Berrios appeals the determination of the Division of Selection Services that he lacked the required amount of permanent status in a title to which the examination is open for the promotional examination for Deputy Fire Chief (PM2159R) Camden.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-11    MATTHEW DIBBS - CSC DOCKET NO. 2015-1623

 

The Department of Environmental Protection requests that Matthew Dibbs' out-of-title work experience in the title of Environmental Specialist 2 be accepted to qualify him for the promotional examination for Administrative Analyst 2, Fiscal Management (PS9487G).

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-12    EDWARD FORTUNE - CSC DOCKET NO. 2015-489

 

Edward Fortune requests that his application for the Entry Level Law Enforcement Examination (S9999R), Statewide be processed.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-13    FRANKLIN HERNANDEZ - CSC DOCKET NO. 2015-377

 

Franklin Hernandez requests that he be permitted to file an application after the closing date for the promotional examination for Police Sergeant (PM5144N), Perth Amboy.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-14    KEITH SPENCE - CSC DOCKET NO. 2014-1323

 

Keith Spence appeals his disqualification from the Entry Level Law Enforcement Examination (S9999R), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-15    OLAMIDE TORRES - CSC DOCKET NO. 2014-2930

 

Olamide Torres requests that she be permitted to submit the application fee for the open-competitive examination for the Law Enforcement Series (S9999R), Statewide.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-16    JAIME COLON - CSC DOCKET NO. 2014-453

 

Jaime Colon, represented by Arthur G. Margeotes, Esq., appeals the bypass of his name on the Police Captain (PM7506M), Elizabeth eligible list.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-17    DONALD INGRASSELINO - CSC DOCKET NO. 2015-93

 

Donald Ingrasselino appeals the bypass of his name on the Deputy County Emergency Management Coordinator (C0641R), Bergen County eligible list.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Janie Reid appeals the bypass of her name on the Police Lieutenant (PM5014M), East Orange eligible list.

B-19    MELANIE MILADINOV - CSC DOCKET NO. 2015-1618

 

The Department of Law and Public Safety requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Melanie Miladinov to be provisionally appointed, pending promotional examination procedures, to the competitive title of Principal Clerk.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-20    CHANTAE RAMOS - CSC DOCKET NO. 2015-586

 

The Division of Agency Services, on behalf of the Department of the Treasury, requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Chantae Ramos to be provisionally appointed, pending promotional examination procedures, to the competitive title of Technical Assistant 3.

 

ACTION:       The Civil Service Commission directed that this request be granted.

Thomas Farrell appeals the determination of the Division of Selection Services denying his request for a make-up examination for Sheriff's Officer Captain (PC2156R), Middlesex County.

Aruna Patel requests a make-up for the open competitive examination for Human Services Specialist 1, (C0446S), Hudson County.

Kenneth Connelly appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Human Services Specialist 4 (PC1388R), Union County, eligible list due to his failure to respond to the Notice of Certification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-25    JENNIFER FERNANDEZ - CSC DOCKET NO. 2015-340

 

Jennifer Fernandez appeals the decision of the former Division of Classification and Personnel Management, which upheld the removal of her name from the Correction Officer Recruit (S9988R), Department of Corrections, eligible list on the basis of an unsatisfactory criminal history.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-26    JOHN GERVATO - CSC DOCKET NO. 2015-295

 

John Gervato appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Fire Prevention Specialist (M0558R), City of Hoboken, eligible list due to his failure to respond to the Notice of Certification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-27    WILLIAM PEREZ - CSC DOCKET NO. 2014-2589

 

William Perez, represented by Michael L. Prigoff, Esq., appeals the decision of the former Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the State Park Police Officer Trainee (S9999M), Department of Environmental Protection, eligible list due to his unsatisfactory driving record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-28    DAVID THOMAS - CSC DOCKET NO. 2014-2984

 

David Thomas appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Public Information Assistant (M0284R), City of Elizabeth, eligible list due to his failure to respond to the Notice of Certification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-29    A. D. - CSC DOCKET NO. 2013-2950

 

A. D., an Institutional Trade Instructor 1, Cooking with the Department of Corrections, represented by Estelle Flynn Lord, Esq., appeals the determination of the Commissioner of the DOC, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-30    K. E. - CSC DOCKET NO. 2014-407

 

K. E., a Chaplain with Greystone Park Psychiatric Hospital, Department of Human Services, appeals the determination of the former Chief of Staff of DHS, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to additional violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied but the new allegation be remanded to the appointing authority.

 

B-31    E. H. - CSC DOCKET NO. 2014-475

 

E. H., a Supervisor of Chaplaincy Services with Greystone Park Psychiatric Hospital, Department of Human Services, appeals the determination of the former Chief of Staff of DHS, finding that she had violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-32    L. N. - CSC DOCKET NO. 2014-234

 

L. N., a Truck Driver Single Axle with the Department of Transportation, appeals the decision of the Division of Civil Rights and Affirmative Action for DOT, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-33    A. R. - CSC DOCKET NO. 2015-703

 

Dr. A. R., a Physician Specialist 1 with Ancora Psychiatric Hospital, Department of Human Services, appeals the determination of the Equal Employment Opportunity Director, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-34    M. R. - CSC DOCKET NO. 2013-3554 AND 2014-410

 

M. R., a Family Service Specialist 2 with the Department of Children and Families, appeals the determinations of the Office of Equal Employment Opportunity and Affirmative Action, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that these appeals be granted in part.

 

B-35    S. R. - CSC DOCKET NO. 2014-3019

 

S. R., a Social Worker Supervisor 3 at Ancora Psychiatric Hospital, Department of Human Services, appeals the decision of the Office of Equal Employment Opportunity, which found that the investigation had only substantiated one of the appellant's allegations that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-36    A. W. - CSC DOCKET NO. 2015-758

 

A. W., a Technician with the Motor Vehicle Commission, appeals the determination of the Chairman and Chief Administrator stating that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-38    ROBERT CHOJNACKI - CSC DOCKET NO. 2015-530

 

Robert Chojnacki appeals the decision of the Division of Classification and Personnel Management that his position with the Department of Environmental Protection is properly classified as Network Administrator 1.  The appellant seeks a Network Administrator 2 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-39    LILLIAN CREWS - CSC DOCKET NO. 2015-322

 

Lillian Crews appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Department of Treasury is Technical Support Specialist 2.  The appellant seeks a Technical Support Specialist 1 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-40    SHANNAN ERLSTON - CSC DOCKET NO. 2015-1584

 

Shannan Erlston appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Department of Law and Public Safety is Principal Payroll Clerk.  The appellant seeks a Personnel Aide 1 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part.

 

B-41    CLIFFORD HICKMAN - CSC DOCKET NO. 2015-579

 

Clifford Hickman appeals the decision of the Division of State and Local Operations which found that his position with the Vineland Board of Education is properly classified as Senior Mechanic Diesel.  The appellant seeks a Supervising Mechanic Diesel job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-42    JENNIE HILL - CSC DOCKET NO. 2015-226

 

Jennie Hill appeals the decision of the former Division of Classification and Personnel Management that the proper classification of her position with the Department of the Treasury is Technical Assistant 1, Treasury.  The appellant seeks a Program Technician job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-43    MELANIE MILADINOV - CSC DOCKET NO. 2015-317

 

Melanie Miladinov appeals the decision of the Division of Classification and Personnel Management, which found that her position with the Department of Law and Public Safety is properly classified as a Principal Clerk.  The appellant seeks a Building Services Coordinator 1 job classification.

B-91    K. G. - CSC DOCKET NO. 2014-1070

 

K. G., a Teacher 3, 12 Months, with the Cape May Regional School, Department of Children and Families, appeals the determination of the Director, Office of Equal Employment Opportunity and Affirmative Action, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.  The appellant also appeals the finding that she violated the State Policy.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-92    CRISTINA MATEO - CSC DOCKET NO. 2015-379

 

Cristina Mateo appeals the determination of the Division of Selection Services and Recruitment that she did not meet the experience requirements for the promotional examination for Assistant Housing Manager (PM0494S), Orange Housing Authority.

B-93    HOUSING ZONING INSPECTOR TRAINEE AND HOUSING ZONING INSPECTOR - CSC DOCKET NO. 2015-2636

 

The Division of Agency Services recommends the creation of the non-competitive title of Housing and Zoning Inspector Trainee and Housing and Zoning Inspector.  Agency Services also recommends the inactivation of the Maintenance Repairer/Radio Dispatcher and Building Service Worker/Clerk 2 titles.

 

ACTION:       The Civil Service Commission directed that these requests be granted.

 

B-94    REALLOCATION OF DIRECTOR, PUBLIC LABORATORY SERVICES AND DIRECTOR, ENVIRONMENTAL AND CHEMICAL LABORATORY SERVICES TITLES FROM THE COMPETITIVE TO THE NON-COMPETITIVE DIVISION OF THE CAREER SERVICE- CSC DOCKET NO. 2015-2635

 

The Division of Agency Services recommends the reactivation and reallocation of the Director, Public Health Laboratory Services and Director, Environmental and Chemical Laboratory Services titles to the non-competitive division of the career service in accordance with N.J.A.C. 4A:3-1.2  Agency Services also requests that four titles in the Clinic Nurse title series be designated inactive or archaic.

 

ACTION:       The Civil Service Commission directed that this request be granted.
