           A regular meeting of the Civil Service Commission was held on Tuesday, April 4, 2018, in Trenton, New Jersey.

 

          PRESENT: Deirdre L. Webster Cobb, Acting Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2017, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Gyula Lekics, Data Processing Programmer, Middlesex County Board of Social Services, 30 working day suspension.

 

ACTION:    The Civil Service Commission noted the dismissal of appeals without prejudice.

William Able, Senior Custodian, Newark Public School District, removal effective September 16, 2015 on charges of conduct unbecoming a public employee, misuse of public property and other sufficient cause.

 

Recommendation of the Administrative Law JudgeModify the removal to a six-month suspension.  

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    JERMAINE CURRY

 

Jermaine Curry, Senior Correction Officer, New Jersey State Prison, Department of Corrections, 60 working day suspension on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the 60 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    YAMALIS DIAZ

 

Yamalis Diaz, County Correction Officer, Burlington County, Department of Corrections, 30 working day suspension on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the 30 working day suspension to a 15 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    CAROL FOX

 

Carol Fox, Public Safety Telecommunicator, Borough of Keyport, Police Department, removal effective September 20, 2017 on charges of incompetency, inefficiency or failure to perform duties, neglect of duties and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the removal.  

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    TONYA HOWARD

 

Tonya Howard, Police Communications Clerk, City of Newark, Department of Public Safety, removal effective September 22, 2016 on charges of intoxication or illegal use of drugs and disobedience of orders.

 

Recommendation of the Administrative Law Judge - Grant the motion for summary decision and uphold the removal.

 

ACTION:     The Civil Service Commission modified the removal to a 45 working day suspension and a pre-reinstatement drug test.

B-117 A.B.C. – CSC DOCKET NO. 2017-737

 

A.B.C., represented by Daniel J. Zirrith, Esq., appeals his rejection as a Fire Fighter candidate by Jersey City and its request to remove his name from the eligible list for Fire Fighter (M1544T) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:   The Civil Service Commission directed that this appeal be denied.

 

B-118 K.C. – CSC DOCKET NO. 2017-727

 

K.C., represented by John D. Feeley, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988T) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:   The Civil Service Commission directed that this appeal be granted.

 

B-119 S.D. – CSC DOCKET NO. 2017-1527

 

S.D., represented by Kevin G. Roe, Esq., appeals her rejection as Correction Officer Recruit candidate by the Department of Corrections and its request to remove her name from the eligible list for Correction Officer Recruit (S9988T) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:   The Civil Service Commission directed that this appeal be granted.

 

B-120 W.M.P. – CSC DOCKET NO. 2017-1523

 

W.M.P., represented by Charles M. Grossman, Esq., appeals his rejection as a Fire Fighter candidate by Newark and its request to remove his name from the eligible list for Fire Fighter (M2554M) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:   The Civil Service Commission directed that this appeal be granted.

 

B-121 KEITH LEFFERTS – CSC DOCKET NO. 2018-454

 

Keith Lefferts, represented by Nicholas J. Palma, Esq., appeals the bypass of his name on the Police Captain (PM0886S), Parsippany-Troy Hills, eligible list.

         

ACTION:   The Civil Service Commission directed that this appeal be denied.

 

B-122 FIRE PROTECTION SUBCODE OFFICIAL (M0160V), TOWNSHIP OF PARSIPPANY-TROY HILLS – CSC DOCKET NO. 2018-2081

 

The Township of Parsippany-Troy Hills, represented by Stephen E. Trimboli, Esq., requests permission not to make an appointment from the June 26, 2017 certification for Fire Protection Subcode Official (M0160V).

ACTION:   The Civil Service Commission granted the appointment waiver and assessed no current costs.

 

B-123 MICHAEL ADAMSHICK – CSC DOCKET NO. 2018-915

 

Michael Adamshick appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Chief Accountant (PM0370V), Perth Amboy.

 

ACTION:   The Civil Service Commission directed that this appeal be denied and the classification of the appellant’s position be referred to the Division of Agency Services for review.

 

B-124 JEFFREY EASTHOPE AND SH-KEER MILBOURNE – CSC DOCKET NOS. 2017-2119 AND 2017-2411

 

Jeffrey Easthope and Sh-Keer Milbourne appeal the determinations of the Division of Agency Services, which found that they did not meet the experience requirements for the promotional examination for Contract Administrator 2 (PS1625K), Department of Human Services.

         

ACTION:   The Civil Service Commission directed that these appeals be granted.

 

B-125 MATTHEW RIDGE – CSC DOCKET NO. 2018-1816

 

Matthew Ridge appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirement for the open competitive examination for Welder (C0553V), Union County.

         

ACTION:   The Civil Service Commission directed that this appeal be granted.

 

B-126 REALLOCATION OF TITLES IN THE OFFICE OF INFORMATION TECHNOLOGY – CSC DOCKET NOS. 2018-1390, ET AL.

 

The Division of Agency Services requests the reallocation of the titles Network Administrator 1 and Network Administrator 2 to the noncompetitive division of the career service from March 31, 2018 to April 14, 2018.

ACTION:   The Civil Service Commission directed that this request be granted.

 

B-127 PAUL CREARY, JR. – CSC DOCKET NO. 2018-1741

 

Paul Creary, Jr., appeals the removal of his name from the Police Officer (S9999U), South Orange, eligible list for failure to maintain residency.

         

ACTION:   The Civil Service Commission directed that this appeal be denied.

 

B-128 CORINNE HARLOS – CSC DOCKET NO. 2018-1734

 

Corinne Harlos appeals the removal of her name from the Correction Officer Recruit (S9988T), Department of Corrections, eligible list on the basis of an unsatisfactory employment record and falsification of the employment application.

         

ACTION:   The Civil Service Commission directed that this appeal be denied.

 

B-129 LINDA BENEDETTI AND TIM O’SULLIVAN – CSC DOCKET NOS. 2018-1908 AND 2018-1911

 

Linda Benedetti and Tim O’Sullivan appeal the determination of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Manager 2, Information Processing (PS3381K), Department of Human Services.

         

ACTION:   The Civil Service Commission directed that these appeals be granted.

 

B-130 DWAYNE ROGALINSKI – CSC DOCKET NO. 2017-1736

 

Dwayne Rogalinski appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Automotive Mechanic (S0646U), Statewide.

         

ACTION:   The Civil Service Commission directed that this appeal be denied.
