A regular meeting of the Civil Service Commission was held on Wednesday, August 19, 2009, in Trenton, New Jersey.

      PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, and John Currie; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

      In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2008, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

          ACTION:     The Civil Service Commission acknowledged the settlements.

A-2    NICOLE BALDWIN

Nicole Baldwin, County Correction Officer, Mercer County, Department of Public Safety, fine of $2,950.50 (equal to 10 days' pay) on charges of chronic and excessive absenteeism and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the fine of $2,950.50 (equal to 10 days' pay).

ACTION:     The Civil Service Commission modified the recommendation of the Administrative Law Judge to a 10-day suspension in lieu of the fine equal to 10 days' pay.

A-3    DENISE BROWN
         
Denise Brown, Police Sergeant, City of Newark, Police Department, six-day suspension on charges of violation of Department rules regarding insubordination, obedience to orders and language.

Recommendation of the Administrative Law Judge - Modify the six-day suspension to a five-day suspension.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4      VERONICA GRAVES

Veronica Graves, Technical Assistant 3, Ancora Psychiatric Hospital, Department of Human Services, release at the end of the working test period effective March 17, 2008.

Recommendation of the Administrative Law Judge - Uphold the release at the end of the working test period.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5    THOMAS ALALA

Thomas Alala, Fire Captain, City of Paterson, Fire Department, removal effective January 26, 2009, on charges of conduct unbecoming a public employee and violation of various Department rules and regulations.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-6    KASON CHEEKS

Kason Cheeks, Police Officer, City of Newark, Police Department, removal effective November 3, 2008, on charges of conduct unbecoming a public employee and violation of Police Department rules regarding conduct in public and private, false statements, outside employment and disobedience of orders.

Recommendation of the Administrative Law Judge - Grant appellant's motion to dismiss and reverse the removal.

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge to dismiss the charges related to engaging in outside employment without notice and approval, and remanded to the Office of Administrative Law the charges related to engaging in outside employment while on sick leave and the charge of falsification.

A-7    CHARLES MARKEY (SETTLEMENT)

Charles Markey, Library Associate, Jersey City Library, 82-working day suspension, on charges of violation of the Disciplinary Action Policy - Mental or Verbal Abuse.

Recommendation of the Administrative Law Judge - Acknowledge the settlement.

ACTION:      The Civil Service Commission acknowledged the settlement as clarified.

B-1    MAURA BROWN

Maura Brown, a Clinical Specialist in Psychiatric Nursing at Hagedorn Psychiatric Hospital, Department of Human Services, represented by Robert O. Yaeger, Principal Staff Representative, CWA Local 1040, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-2    MARK FAHEY

Mark Fahey, a former Construction and Maintenance Technician 4 with the Department of Transportation, represented by Ross Begelman, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-3    MICHAEL GALVIN

Michael Galvin, a Senior Correction Officer with Albert C. Wagner Youth Correctional Facility, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

Charles Mitchell, a Senior Correction Officer with Northern State Prison, Department of Corrections, represented by Henry J. Cistrelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-5    RONALD PAYTON

Ronald Payton, a Teacher 1 (12 months) at Albert C. Wagner Youth Correctional Facility, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted in part.

B-6    CHARICE POWELL

Charice Powell, a Senior Correction Officer at Mountainview Youth Correctional Facility, Department of Corrections (DOC), represented by Henry J. Cistrelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.

Cynthia Wright, a Principal Clerk Stenographer with the Hunterdon Developmental Center, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

William Rogers, a Project Specialist with The College of New Jersey, represented by Sean Byrnes, Esq., appeals the denial of sick leave injury (SLI) benefits.

Ronald Smallwood, a Senior Correction Officer with Northern State Prison, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.

Laviv Younger, a Senior Correction Officer at Northern State Prison, Department of Corrections, represented by John McGovern, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-12   MICHAEL P. CASSIDY

Michael P. Cassidy appeals the decision of the former Division of State Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Correction Officer Recruit (S9999H), Department of Corrections eligible list on the basis of an unsatisfactory driving record.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-13   ADMINISTRATIVE ANALYST 2, PROCUREMENT (PS5719F) AND (PS6689F), DEPARTMENT OF EDUCATION

The Department of Education requests permission not to make an appointment from the February 20, 2009 certification for Administrative Analyst 2, Procurement (PS5719F) and (PS6689F).

ACTION:      The Civil Service Commission granted the request for an appointment waiver and assessed no selection costs at this time.

B-14   ASSESSING CLERK (M1317H), DEPTFORD

Deptford, represented by Michael J. DiPiero, Esq., requests reconsideration of In the Matter of Assessing Clerk (M1317H), Deptford (CSC, decided February 25, 2009), which denied an appointment waiver and ordered it to properly dispose of the certification with 30 days.

ACTION:      The Civil Service granted the request for reconsideration and an appointment waiver but assessed selection costs in the amount of $2,048 and prior costs of $1000 for compliance.

B-15   INSTITUTIONAL TRADE INSTRUCTOR 1, WAREHOUSING (S6995J), DEPARTMENT OF CORRECTIONS

The Department of Corrections requests permission not to make an appointment from the June 20, 2008 certification for Institutional Trade Instructor 1, Warehousing (S6955J).

ACTION:      The Civil Service Commission granted the request for an appointment waiver and assessed no selection costs at this time.

B-16   PRINCIPAL ACCOUNT CLERK (M0202K), EAST ORANGE

East Orange requests permission not to make an appointment from the September 16, 2008 certification for Principal Account Clerk (M0202K).

ACTION:      The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.

B-17   PRINICIPAL CLERK (M1054H), NEWARK

Newark requests permission not to make an appointment from the February 8, 2007 certification for Principal Clerk (M1054H).

ACTION:      The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.

B-18   BEVERLY LAPSLEY

Beverly Lapsley, a Deputy Attorney General 3 with the Department of Law and Public Safety, appeals the determination of the First Assistant Attorney General, which found that the appellant failed to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-19   GOLDEN BROWN

Golden Brown appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Senior Claims Adjudicator, Disability Determinations.  The appellant seeks a Senior Claims Adjudicator Specialist, Disability Determinations classification.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-20   RALPH D'ARIES AND DENISE WEBB

Ralph D'Aries and Denise Webb, represented by Eric Giuliano, Esq., appeal the decisions of the Division of Local Human Resource Management that the proper classification of Mr. D'Aries' position is Principal Registered Environmental Health Specialist, Public Health and that the proper classification of Ms. Webb's position is Registered Environmental Health Specialist, Public Health Specialist.  Mr. D'Aries seeks an Assistant Health Officer classification and Ms. Webb seeks a Senior Registered Environmental Health Specialist, Public Health classification.

ACTION:      The Civil Service Commission directed that these appeals be denied.

B-21   JENNIFER PINEDA

Jennifer Pineda appeals the decision of the Division of State Human Resource Management that her position is properly classified as Principal Payroll Clerk.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-22   SHERIEFA SALEH

Sheriefa Saleh appeals the decision of the Division of State Human Resource Management which found that her position is properly classified as Accountant 3.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-23   JOSEPH BATTITO

Joseph Battito, a Veterans Service Officer 2 with the Department of Military and Veterans Affairs, appeals the denial of a second step grievance regarding two days of sick leave.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-24   WINIFRED JONES

The appointing authority requests that the provisions of N.J.A.C. 4A:6-3.4(a), which govern the time period in which employees must file an application for Supplemental Compensation on Retirement (SCOR), be relaxed to permit Winifred Jones, a former Supervisor, Food Service Area Operations, with Ancora Psychiatric Hospital, Department of Human Services, to submit a late application for SCOR benefits.

ACTION:      The Civil Service Commission granted the request.

 B-25   DANIEL WENGERT

Daniel Wengert, a Senior Correction Officer at the New Jersey State Prison, Department of Corrections, represented by Robert A. Fagella, Esq., petitions the Civil Service Commission for interim relief of his immediate suspension.

ACTION:      The Civil Service Commission denied the request for interim relief.

B-26   LATERAL TITLE CHANGE FROM COUNTY CORRECTION OFFICER TO SHERIFF'S OFFICER II, BERGEN COUNTY SHERIFF'S OFFICE

The Bergen County Sheriff's Office (Sheriff's Office), represented by Deborah J. Bracaglia, Esq., petitions for a stay of the decision, In the Matter of Lateral Title Change from County Correction Officer to Sheriff's Officer, Bergen County Sheriff's Office (CSC, decided June 24, 2009),  which ordered that County Correction Officers who had been assigned duties consistent with Sheriff's Officer classifications be recorded as provisional pending open competitive procedures, and the current Law Enforcement Examination (LEE) be certified against those positions or that the Sheriff's Office reassign those employees duties consistent with their permanent title of County Correction Officer, pending the outcome of its appeal to the Appellate Division of Superior Court.

ACTION:      The Civil Service Commission denied the request for a stay.

B-27   ALEXANDER LOY

Alexander Loy, a Police Officer with the Harrison Police Department, represented by Martin Morrison, Esq., petitions the Civil Service Commission for a stay of his four-month suspension effective April 25, 2009, pending the outcome of his hearing at the Office of Administrative Law.

ACTION:      The Civil Service Commission denied the request for a stay.

B-28   LISA DEVRIES-HARTER

Lisa DeVries-Harter, an Administrative Analyst 2 with the Department of Transportation, represented by Paul Pologruto, CWA Local 1032, appeals the decision of the Department of Transportation, which denied her request to participate in the donated leave program.

ACTION:     The Civil Service Commission directed that this appeal be granted.

 B-29   KATHY J. FOX

Kathy J. Fox, a Technical Support Specialist 1 with the Juvenile Justice Commission, requests reimbursement of her earned benefit time utilized prior to her participation in the donated leave program.

ACTION:      The Civil Service Commission denied the request.

B-30   MICHAEL CURTIN

The Superior Court, Appellate Division, had remanded the decision of Michael Curtin, concerning his scores for the oral portion of the examination for Battalion Fire Chief (PM3593G), Elizabeth.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-31   SANTANA THOMAS

Santana Thomas a former Police Officer with the Asbury Park Police Department, represented by Michael J. Pappa, Esq., petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on June 5, 2009, in which the Director of the Division of Merit System Practices and Labor Relations, denied his request for a hearing with respect to his resignation not in good standing.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-32   RALPH D'ARIES

Ralph D'Aries, a former Municipal Department Head with Sparta Township, represented by Eric Giuliano, Esq., requests reconsideration of the decision rendered on June 11, 2008, directing that his appeal of his 10-day suspension be withdrawn and the case removed from the hearing calendar and considered closed.

ACTION:      The Civil Service Commission granted reconsideration but dismissed the appeal for the Civil Service Commission's lack of jurisdiction.

B-33   ANDREW GALES

The City of Paterson requests reconsideration of the decision rendered on June 10, 2009, restoring Andrew L. Gales' name to the Police Assistant (M1343H), Paterson eligible list and Mr. Gales, represented by Michael Garcia, Esq., requests enforcement of that decision.

ACTION:      The Civil Service Commission denied the request for reconsideration but granted the request for enforcement.

B-34   KARLA JACKSON

The appeal of Karla Jackson, a Human Services Assistant with Ancora Psychiatric Hospital, Department of Human Services, of her resignation not in good standing effective November 27, 2007, on charges, was heard by Administrative Law Judge Susan M. Scarola (ALJ), who rendered her initial decision on June 11, 2009, modifying the resignation not in good standing to a resignation in good standing.   At its meeting on August 5, 2009, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation.  Rather, the Commission upheld the resignation not in good standing.  The proposed final decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the final decision.

B-35   DANIEL MARCANO AND CHRISTOPHER FRUCCI

The appeals of Daniel Marcano and Christopher Frucci, Police Officers with the City of Camden, of their removals, effective May 8, 2007 and December 13, 2007, respectively, on charges, were heard by Administrative Law Judge Joseph Lavery (ALJ), who rendered his initial decision on June 16, 2009.  At its meeting on August 5, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to reverse the appellants' removals.  The proposed decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the decision.

B-36   STEVEN J. WINTERS

The appeal of Steven J. Winters, a Fire Officer 1, with the North Hudson Regional Fire and Rescue, of his 60-day suspension and demotion to Fire Fighter effective December 5, 2005, on charges, was heard by Administrative Law Judge Joseph Paone (ALJ), who rendered his initial decision on June 11, 2009.  At its meeting on July 22, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to uphold the 60-day suspension and demotion to Fire Fighter.  The proposed final decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the final decision.

B-37   MICHAEL ALEMZADEH

Michael Alemzadeh appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for a qualifying lateral title change to Principal Environmental Engineer, Water Resources, Department of Environmental Protection.

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-38   ANNA MARIE BREEN

Anna Marie Breen appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the promotional examination for Secretarial Assistant 1 (Non-Stenographic) (PS1444J), Ramapo College of New Jersey.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-39   MICHAEL L. DEGASPERIS, ET AL.

Michael L. DeGasperis, Beverly J. Fusco, Kelly M. Lavalva, Sharon M. Romans, Richard C. Smith, and Maureen A. Swick, represented by William L. Kaufmann, Staff Representative, CWA Local 1040, appeal the determinations of the Division of Selection Services which found that they did not meet the requirements for the promotional examination for Quality Assurance Specialist, Heath Services (PS4939K), Department of Human Services.

ACTION:      The Civil Service Commission directed that these appeals be denied.

B-40   FRANK A. KELLEY

Frank A. Kelley appeals the determinations of the Division of Selection Services which found that he did not meet the requirements for the open competitive examinations for Graphic Artist 1 (M6019J), Jersey City and Media Technician 1 (M1610J), Newark.

ACTION:      The Civil Service Commission directed that these appeals be denied.

B-41   GEORGE WARDEN

George Warden appeals the determination of the Division of Selection Services which found that he did not meet the education and experience requirements for the promotional examination for Assistant County Park Superintendent (PC1632K), Middlesex County.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-42   SETH KNAUER, ET AL.

Seth Knauer (PC2659K), Ocean County; Joseph Aponte, Deniz Majagah, Robert Picioccio and Thomas Salkins (PC2660K), Passaic County; appeal the promotional examination for County Correction Sergeant (various jurisdictions).

ACTION:      The Civil Service Commission directed that these appeals be denied.

B-43   ERIC SPIERER

Eric Spierer appeals the promotional examination for Correction Captain (PS1511P), Juvenile Justice Commission.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-44   RACHEAL AFANADOR AND SANDRA RIVERA-ALVARADO

Racheal Afanador and Sandra Rivera-Alvarado appeal their examination scores for the bilingual portion of the examination for the open competitive examination for Human Services Specialist 1, Bilingual in Spanish and English (C1808J), Monmouth County.

ACTION:      The Civil Service Commission directed that these appeals be denied.

B-45   PALMER AMOS

Palmer Amos appeals her oral scores of the promotional examination for Police Captain (PM2546K), Newark.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-46   JOYCE E. JAMES

Joyce E. James appeals the administration of the promotional examination for Software Development Specialist 2 (PS7470U), Office of Information Technology.

ACTION:     The Civil Service Commission directed that the eligible list for Software Development Specialist 2 (PS7470U) be rescinded, and directed that a new examination be developed and administered for the subject title, and directed that the certification (PS090518) be cancelled.

B-47   TIMOTHY LOCKWOOD

Timothy Lockwood appeals his oral scores of the promotional examination for Police Captain (PM3536K), Jersey City.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-48   LEE RAGOZZINE

Lee Ragozzine appeals his oral score of the promotional examination for Police Captain (PM3519K), Atlantic City.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-49   BAHRAM B. SALAHI

The Acting Director, Division of State and Local Operations, on behalf of the Department of Environmental Protection, requests that Bahram B. Salahi's out-of-title work experience be accepted to qualify him for the promotional examination for Principal Environmental Engineer, Waste Management (PS2915G).

ACTION:      The Civil Service Commission granted the request.

B-50   MATTHEW GREER

The Acting Director, Division of State and Local Operations, on behalf of Gloucester Township Fire District #6 and Winslow Township Fire District #1, requests that Matthew Greer be permitted to intergovernmentally transfer from Gloucester to Winslow as a Fire Fighter.

ACTION:      The Civil Service Commission directed that this matter be held over.

B-53   RHODA LIVINGSTON

The appeal of Rhoda Livingston, a Senior Correction Officer at Northern State Prison, Department of Corrections, of her removal, effective August 26, 2008, on charges, was heard by Administrative Law Judge Walter M. Braswell (ALJ), who rendered his initial decision on June 25, 2009.  At its meeting on August 5, 2009, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to modify the removal to a 180-day suspension.  Rather, the Commission upheld the removal.  The proposed final decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the final decision.

B-54   PAMELA MORTON

Pamela Morton, a former Youth Worker with the Department of Children and Families, requests reinstatement of the appeal of her resignation not in good standing, which was dismissed based on her failure to appear at a scheduled settlement conference.

ACTION:      The Civil Service Commission granted the request.
