Municipal Public Access Funds
As an option for increased flexibility in implementing public access enhancements, municipal public access plans may require a monetary contribution in lieu of onsite or offsite physical public access. This option allows a municipality to fairly assess development that may not be appropriate for public access onsite, and where a new off-site location may also not be appropriate. The monies may be used to beneficially enhance other aspects of public access. To do this, the plan must define the circumstances in which the contribution may be required and the allowable uses for the monies received. The monies must be allocated to a municipal public access fund per N.J.A.C. 40A:4-39a-b. A resolution creating the municipal public access fund, dedicating by rider the funds to the municipal budget, and citing N.J.A.C. 7:7E-8.11( e) 5iii and (f), must be adopted by the municipality and sent to NJ DCA Division of Local Government Services. Municipalities should consult with their CFOs and the Division on the specific requirements for this process.
