Administrative Order 2002-14 To Amend and Supplement ADMINISTRATIVE ORDERS 2002-05 and 2002-07

I, Bradley M. Campbell, Commissioner of the New Jersey Department of Environmental Protection (Department), pursuant to the authority vested in me by Executive Order No. 11, issued by Governor James E. McGreevey on March 4, 2002, the Water Supply Management Act, N.J.S.A. 58:1A-1 et seq., and its implementing rules, N.J.A.C. 7:19, previously issued Administrative Order Nos. 2002-05 and 2002-07, imposing Phase I - Mandatory Water Use Restrictions. This Administrative Order is intended to supplement Administrative Orders No. 2002-05 and 2002-07. Administrative Order No. 2002-05 and 2002-07 shall remain in effect.

In issuing Administrative Order 2002-05 on March 11, 2002, the Department began the process of implementing Executive Order No. 11, with an initial set of conservative water use restrictions and other provisions intended to reduce water use while minimizing disproportionate burdens on specific sectors of the economy. Additions and revisions to the initial set of restrictions were implemented with the issuance of Administrative Order 2002-07 on March 15, 2002. Additional actions are necessary at this time in order to increase the transfer of water from the Central Drought Region to the Northeast Drought Region, and thus to reduce demands upon water sources and reservoir storage in the Northeast Drought Region.

Accordingly, based upon the powers of the Commissioner during a water emergency, set forth in the Water Supply Allocation Rules at N.J.A.C. 7:19-10.2, I undertake the following actions in order to preserve water storage and to otherwise help alleviate the severity of the water emergency.

Section III. General Provisions Applicable Statewide

The provisions included in Section III of Administrative Order No. 2002-05, as amended and supplemented by Administrative Order No. 2002-07, are hereby further supplemented as follows:

    1- 15. (see previous Administrative Orders No. 2002-05 and 2002-07)

    1. The New Jersey American Water Company, in the Northeast Drought Region, shall immediately increase the amount of water accepted from the Elizabethtown Water Company, in the Central Drought Region, to the maximum amount practically possible.

    2. In order to maximize the transfer of water into the Northeast Drought Region through the Virginia Street interconnection, the Newark Department of Water and Sewer Utilities, the North Jersey District Water Supply Commission, and the Elizabethtown Water Company shall together develop a plan for modifying the water supply infrastructure associated with the Belleville reservoir site as necessary to increase the transfer of water through the site and into the Northeast Drought Region to the maximum amount practically possible. The plan shall specifically address all precautions necessary to protect existing water supply infrastructure. A draft of the plan shall be submitted to the Department by April 26, 2002. The final plan shall be submitted by May 10, 2002.

    3. By June 1, 2002, each water company will provide the following information to the Drought Coordinator:

      1. The difference between the amount of water that leaves the water company system and the amount for which the water company bills (amount of unaccounted-for-water), expressed as a total amount and as a percentage of the company's total water output. This should cover the current water year.

      2. A discussion of short term measures that are underway or could be initiated to reduce the amount of unaccounted-for-water.

      3. A plan of action containing long term measures to reduce the amount of unaccounted-for-water.

This Order shall take effect immediately and shall remain in effect until superseded or terminated by my action or by action of the Governor of the State of New Jersey. All previous Orders issued by me shall remain in effect, except to the extent that they conflict with this Order.
