Hazardous Waste Generators and Transporters and Facilities

Which Hazardous Waste Requirements Apply to you? 
The Hazardous Waste Generator requirements as set forth in N.J.A.C. 7:26G-6 et seq., regulate how hazardous waste is handled, stored and transported. The definition and requirements for Small Quantity Generators (SQG), Large Quantity Generators (LQG) and Conditionally Exempt Small Quantity Generators (CESQG) are based upon three factors:

(1) how much hazardous waste is generated monthly
(2) how much hazardous waste is accumulated before disposal
(3) how long hazardous waste is allowed to accumulate before disposal

(1) How much hazardous waste do you generate monthly?
(2) How much hazardous waste do you accumulate before disposal?
(3) How long do you accumulate hazardous waste before disposal?
Generator Category
if you generate
<
220 lbs of hazardous waste &/or < 2.2 lbs acute hazardous waste*
and if youaccumulate
< 2200 lbs of hazardous waste onsite
You may accumulate hazardous waste for an unlimited time Then you are a
Conditionally Exempt Small Quantity Generator (CESQG)
if you generate
> 220 lbs but less than 2200 lbs of hazardous waste &
<
2.2 lbs of acute hazardous waste*
and if you accumulate < 13,200 lbs of hazardous waste & < 2.2 lbs of acute hazardous waste* onsite and do not accumulate this waste for more than 180 days, 270 days if the receiving facility is > 200 miles away Then you are a Small Quantity Generator (SQG) (inspection checklists)
if you generate
> 2200 lbs of hazardous waste or >2.2 lbs. of acute hazardous waste*
You may accumulate an unlimited amount and do not accumulate this waste for more than 90 days Then you are a Large Quantity Generator (LQG)

* An Acute Hazardous Waste is normally designated by a "P" number as its waste code. Acute hazardous waste is a category of hazardous waste that can exerts its toxicity with exposure to smaller quantities and in a shorter period of time than non-acute hazardous waste. This category of hazardous waste for the reasons mentioned has different reporting requirements. Sites that generate in any single calendar month, or accumulated at any time, 1 kg (2.2 lbs.) of acute hazardous waste are a RCRA LQG and must submit a Biennial Hazardous Waste Report to the Department for that reporting year.
