Bureau of Hazardous Waste Compliance & Enforcement

About Us
The Hazardous Waste Compliance and Enforcement program administers the RCRA (Resource Conservation Recovery Act) program in New Jersey. There is also a transportation oversight function that includes, in coordination with the State Police, roadside operations and hazardous waste transporter terminal audits.

What We Do
The Hazardous Waste Compliance and Enforcement program performs the following activities to ensure that hazardous waste is properly identified and collected, transported, treated and disposed of in an environmentally sound manner:

  • Provides compliance assistance
  • Investigates complaints
  • Conducts inspections
  • Issues enforcement documents, both formal and informal, which may include assessed penalties
  • Assists the Attorney General in developing enforcement cases and testifies in court
  • Negotiates compliance schedule and penalty settlements
  • Registers, tracks, and bills medical waste generators
  • Manages permissions for MyRCRAid to allow access to RCRAInfo
  • Reviews Biennial Hazardous Waste Reports
  • Maintains Uniform Hazardous Waste Manifest data used to identify generators that manage hazardous waste off-site, and transporters, storage, and disposal facilities which receive or manage hazardous waste in New Jersey

Announcements
All hazardous waste facilities and handlers should review the EPA’s e-Manifest System Compliance Advisory issued March 14, 2023 to reduce data quality issues with Hazardous Waste Manifests. The recommended actions support facility compliance and assists handlers with tracking and managing waste records.

Batteries, including lithium or lithium ion batteries, have recently experienced an increase in use and interest in how they are regulated and managed as a waste stream. Please refer to the US Environmental Protection Agency memo issued May 24, 2023 for Frequently Asked Questions on Battery Recycling and the applicability of the hazardous waste and RCRA recycling regulations. As stated in the Memo, NJDEP encourages the recycling of lithium-ion batteries wherever possible in a manner that protects communities and the environment.

Hazardous Waste Regulations for New Jersey
New Jersey’s hazardous waste regulations are found at N.J.A.C. 7:26G-1 et seq., adopted October 21, 1996 and announced at 28 NJR 4606. By this adoption, the Department “incorporated by reference” (with limited exception) the July 1, 1993 version of the Federal hazardous waste regulations at 40 CFR Parts 124, 260-266, 268 and 270, mandated by the Resource Conservation and Recovery Act of 1976 (RCRA) and amended by the 1984 Hazardous and Solid Waste Amendments (HSWA). Effective January 19, 1999 the Department amended the regulations to allow for prospective incorporation by reference, which means that all provisions of 40 CFR Parts 124, 260-266, 268 and 270 incorporated by reference are continually automatically updated in order to maintain consistency with the most current Federal rules.

The requirements for hazardous waste generators are specifically found at N.J.A.C. 7:26G-6 et seq., which references 40 CFR Part 262 of the Federal regulations (with some exceptions and/or changes).
