In accordance with N.J.S.A. 13:1D-51 through -58, the State of New Jersey, Department of Environmental Protection ("NJDEP") will hold two public hearings to seek comments on the proposed conveyance of property in the City of Millville, Cumberland County.

The property proposed for conveyance is designated for tax purposes as Block 578, Lot 19 (comprising approximately 81 acres, hereafter "the Property.") The NJDEP proposes to convey the Property through a direct sale to either the City of Millville ("City"), the Millville Urban Redevelopment Corporation ("MURC"), the Cumberland County Improvement Authority or any other nonprofit or public entity designated by the City. The Property was purchased by the NJDEP from the prior owner, Durand Glass Manufacturing Company, Inc. ("Durand"), in July 2013 for $335,000. The proposed sale price for the conveyance by the NJDEP to the City or its designee is $395,000. If the property is conveyed by the NJDEP to the City or its designee, it will be used for commercial industrial/purposes consistent with current zoning.

The Property is located off Gorton Road; the street address of the Property is 1 Gorton Road. It is irregularly shaped, with a maximum depth of about 2700 linear feet and a frontage of about 735 feet. The property is currently administered by the NJDEP's Division of Fish and Wildlife as part of the 474-acre Menantico Ponds Wildlife Management Area.

The proposed sale price is based on three components: the $369,579 full fair market value of the Property as of January 2013 (as established by appraisals commissioned by the NJDEP as part of the purchase); approximately $12,241 in technical costs incurred by the NJDEP as part of the purchase of the Property and $13,000 for administrative costs associated with the proposed conveyance.

If the proposed conveyance of the Property is approved and the Property is sold to the City or its designee, the NJDEP intends to deposit the funds received from the City or its designee into the Garden State Preservation Trust Fund, to be used for a future State acquisition project as required by N.J.S.A. 13:1D-57 and N.J.S.A. 13:8C-31. It is the NJDEP's intention to identify and purchase other suitable replacement land of at least equal acreage to the Property, in fee, within Cumberland County with these funds.

In March 2014, the NJDEP proposed to convey the Property to the City and to use a portion of the sale proceeds to purchase approximately 900 acres of land elsewhere in Millville (within a 1300-acre parcel known as the Holly Farm property) for addition to the WMA. After conducting public hearings on the proposal in May 2014 and performing further review of the proposal, the NJDEP has determined that linking this conveyance to the Holly Farm purchase is no longer feasible. Therefore, the NJDEP is re-proposing this conveyance under N.J.S.A. 13:1D-51 et seq.

State House Commission approval is required for this proposal. If approved, the Department anticipates that the earliest the proposed conveyance could occur is late April 2015.

The affected properties on which the Township holds conservation easements are:

1. Block 79, Lot 16.08 - 507 Barton Lane (owned by Transcontinental Gas Pipe Line Company, LLC)

2. Block 79, Lot 16.07 - 505 Barton Lane (owned by Joseph A. Basile and Jeanette A. Basile)

As to said lands, a permanent right of way and easement (totaling 0.102 acres) and temporary workspace (totaling 0.170 acres) is proposed to be acquired from said landowners by Transcontinental Gas Pipe Line Company, LLC (Transco) for the expansion of Transco's existing underground natural gas pipeline transmission system and easement. The lands in question are encumbered by State of New Jersey Green Acres restrictions, and the Township has submitted a final application for the major diversion of said lands to the New Jersey Department of Environmental Protection, Green Acres Program, for approval by the Department's Commissioner and by the State House Commission. As compensation to the Township for the diversion of lands and for the partial release of the conservation restriction described above, Transco has agreed to pay the Township $33,000.00.

This hearing will serve as the public hearing required under N.J.S.A. 13:8B-5 in connection with the partial release of the conservation restriction across both of the abovementioned parcels.

The Township of Readington will hold a public hearing for the purpose of receiving public comment about the proposed major diversions of certain portions of open space property which Readington Township owns and other portions of property upon which Readington Township holds conservation restrictions, all of which were preserved with State of New Jersey Green Acres funds and encumbered by Green Acres rules and regulations. The affected open space properties which Readington Township owns are known as:

Block 50, Lot 13 - 143 Stanton Road Block 50, Lot 14.01 - 141 Stanton Road Block 50, Lot 41 - 114 Dreahook Road Block 75, Lot 32.03 - 127A Pleasant Run Road; and Block 76, Lot 3.01 - 176 Pleasant Run Road.

The affected properties on which Readington Township holds conservation restrictions are: Block 50, Lot 14 - 139 Stanton Road (owned by Judith Garfield); and Block 75, Lot 32 - 127 Pleasant Run Road (owned by Marcia Zweerink).

The proposed diversions consist of conveying both permanent right of way (totaling 2.488 acres) and temporary workspace easements (totaling 6.039 acres) to Transcontinental Gas Pipe Line Company, LLC ("Transco"), which seeks to expand its previously existing underground natural gas pipeline transmission system and easement area. Transco proposes to compensate the landowners for any easements and workspace it acquires.

Please take further notice that, the lands in question are encumbered by State of New Jersey Green Acres restrictions, and, in accordance with Green Acres rules and regulations, a final application for the major diversions of the aforesaid lands has been submitted to the New Jersey Department of Environmental Protection, Green Acres Program, for approval by the Department's Commissioner and by the State House Commission. As compensation to the Township for the diversion of lands and for the partial release of the conservation restrictions described above, Transco has agreed to pay the Township $450,000.00.

The lands in question are encumbered by State of New Jersey Green Acres restrictions, and a final application for the major diversion of said lands has been submitted to the New Jersey Department of Environmental Protection, Green Acres Program, for approval by the Department's Commissioner and by the State House Commission. As compensation to the Township for the diversion of lands and for the partial release of the conservation restrictions described above, Transco has proposed to pay the Township $937,200.00.

The Borough of Roosevelt has filed a request with the New Jersey Department of Environmental Protection, Green Acres Program, proposing the diversion of 2.56 acres of Borough owned, Green Acres Restricted Land in connection with the acquisition of additional Green Acres Restricted Land fronting on South Valley Road. As compensation for the proposed diversion, the Borough of Roosevelt proposes to divert 2.56 acres of Borough Owned land, commonly known as Lot 23, Block 7 as shown on the tax maps of the Borough of Roosevelt, having frontage on Clarksburg Road and Spruce Lane, to the owner of the adjacent land known as Lot 10.02, Block 7, in exchange for 12.80 acres consisting of a portion of Lot 10.01, Block 7, having frontage on South Valley Road. The proposed diversion of compensation allows the Borough of Roosevelt the ability to add to the Greenbelt land located behind the residential properties adjacent to a portion of Lot 10.01 in Block 7. The proposed diversion would also preserve the view shed from Route 571 in front of Lot 23, Block 7.

The Camden County Parks Department will hold a public hearing to obtain comments regarding its application to the NJDEP Green Acres Program, proposing to divert a total of approximately 0.013 acres of parkland (the "Park") situated within Block 1.01, Lot 1 on the tax maps of the Borough of Oaklyn, Camden County, for the construction of a proposed underground electrical circuit as part of Public Service Electric and Gas Company's (PSE&G's) regional electrical upgrades (the Project). Pursuant to N.J.A.C. 7:36-26.11(e), a hearing to obtain public comment on this request will be held.

The proposed parkland diversion would involve the installation of subsurface electrical circuits beneath Newton Lake adjacent to Black Horse Pike using microtunneling techniques. This involves boring horizontally below the bottom of the lake from pits dug on nearby properties. No disturbance to the lake will occur due to the construction, and the entirety of the lake will remain undisturbed when the Project is complete. In accordance with NJAC 7:36-26.10(e), Monetary compensation in the amount of $2,500 for this diversion will be made into the Garden State Preservation Trust Fund.

The Board of Chosen Freeholders of the County of Burlington has filed a request with the New Jersey Department of Environmental Protection, Green Acres Program, proposing to transfer ownership of parkland from Burlington County to Westampton Township.

Subject to the requirements of N.J.A.C. 7:36-25.5 et seq., N.J.S.A. 40A:12-13 et seq. and other applicable statutes, the Board of Chosen Freeholders of the County of Burlington has authorized the sale of property known as the "Rowan Property", a portion of Block 201, Lots 1 and 2, 371 and 375 Bridge Street, Westampton Township, Burlington County, New Jersey, measuring approximately 80 acres (the "Property") to Westampton Township which is subject to Green Acres restrictions. The Green Acres restrictions on the parkland will be transferred with the parkland and will run with the property in perpetuity.

In accordance with New Jersey law, Burlington County will hold public hearings to explain the proposed sale and to take public comments on it. Said sale is scheduled to take place no earlier than August 2014 subject to the approval by the Green Acres Program.

The Property is located next to an existing sports complex owned by Westampton Township, Westampton has requested that Burlington County transfer title to a portion of the Property to them for the purpose of constructing additional active recreational fields. Subsequent to the sale of this Property Westampton Township will convey to Burlington County an easement over a portion of Township-owned property required by the County as part of its development of trails on the Rancocas Greenway.

However, if the Holly Farm purchase cannot be concluded within three years of the actual conveyance of the Property, the NJDEP will identify and purchase other suitable replacement land of at least equal acreage, in fee, within Cumberland County using the $367,000 sale proceeds.

State House Commission approval is required for this proposal. If approved, the Department anticipates that the earliest the proposed conveyance could occur is mid-August 2014.

The County of Ocean will hold a public hearing to receive public comment as to the proposed 3.93 acre diversion of a portion of Countyowned lands located at Block 394, Lots 136 and 9 in the Township of Toms River, County of Ocean. The said properties were purchased with Ocean County Natural Lands Trust Funds and are therefore encumbered by State of New Jersey Green Acres regulations.

As to said lands, a permanent easement is proposed to be dedicated for the construction of the proposed access driveway to Ocean County College and related stormwater facilities. Compensation will be provided by Ocean County in the form of replacement land on a nearby Block 394, Lot 6 owned by Ocean County.

An application for the major diversion of said lands has been submitted by the County to the New Jersey Department of Environmental Protection, Green Acres Program, for approval by the Department's Commissioner and by the State House Commission. Pursuant to N.J.A.C. 7:36-26.11(e), a public hearing is required by Green Acres' regulations prior to the submission of Part 2 of the final application for the diversion of the said lands, all of which are forested lands that are not presently used for active recreational activities.

The County of Atlantic will hold a public hearing to obtain comments regarding its application to the NJDEP Green Acres Program, for the proposed minor diversion of parkland to the New Jersey Turnpike Authority. This application is subject to NJDEP Commissioner and State House Commission approval

The proposed parkland disposal at Block 2004, Lot 1 would include a 0.032 acre area for a utility easement to relocate the G4S fiber line (which is an Authority facility) off of the existing bridge in accordance with the Authority's policy and a 0.118 acre area for an aerial easement needed to widen and maintain the bridge structure that carries the traffic on the Parkway over the railroad. In addition, 0.6 acres is required as temporary workspace to be utilized for access during construction. In accordance with N.J.A.C. 7:36-26.5(a)li, as compensation for the diversion, the Authority has agreed to contribute a minimum of $6,000 to the NJDEP Garden State Preservation Trust.

The Township of Readington will hold a public hearing for the purpose of receiving public comment about the proposed major diversions of certain portions of open space property which Readington Township owns and other portions of property upon which Readington Township holds conservation easements. all of which were preserved with State of New Jersey Green Acres funds and encumbered by Green Acres rules and regulations.

The proposed diversions consist of conveying both permanent right of way and temporary workspace easements to Transcontinental Gas Pipe Line Company, LLC ("Transco"), which seeks to expand its previously existing underground natural gas pipeline transmission system and easement area. Transco proposes to compensate the landowners for any easements and workspace it acquires.

Please take further notice that in accordance with Green Acres rules and regulations, one application for the major diversions of the aforesaid lands must be submitted by Readington Township, which is required due to Transco's proposed project, to the New Jersey Department of Environmental Protection Green Acres Program, for the approval by the Department's Commissioner and by the State House Commission. A public scoping hearing is required prior to the submission of any application for the diversions of these lands which are currently forested and/or agricultural fields not presently used for active recreational facilities.

The TOWNSHIP OF STAFFORD, a municipal corporation of the State of New Jersey ("Township"), has been directed by the State of New Jersey, Department of Environmental Protection ("Department") and the State House Commission ("Commission") to modify the compensation that had previously been approved in connection with the Department's and Commission's approval of the Township's application to divert Green Acres encumbered land for the purpose of the development of facilities that produce electrical energy from solar technologies. The original diverted area is approximately 47 acres and is located along Haywood Road within the Stafford Business Park, between New Jersey State Highway Route 72 and the Garden State Parkway, more particularly known as part of Block 25, Lot 39 (and formerly known, as Block 25, Lot 93; and Block 13, Lots 22.01 & 68) as shown on the Official Tax Map of the Township of Stafford, Ocean County, New Jersey (the "Landfill Lot").

The Landfill Lot is also subject to a conservation restriction dated December 7, 2006, and recorded on December 11, 2006, at Deed Book 13446, Page 0118, with the Office of the Ocean County Clerk (the "Conservation Restriction"), by, and between, the Township of Stafford and the New Jersey Pinelands Commission.

The diversion and partial release of the Conservation Restriction were originally approved by the Department on November 7, 2010 and by the State House Commission on December 9, 2010. The Department's and Commission's approvals were appealed to the Superior Court, Appellate Division by various parties challenging the project (the "Appeal"). Based on issues raised by the appellants, the Department asked the court to remand this matter to the Department for reconsideration of the appropriate compensation for the approved diversion and release of conservation restriction. The Appeal is currently subject to an Order of Remand that requires the Department to conclude any remand proceedings by January 4, 2014. In order to comply with the court's order, the Department and Commission issued an Order on Remand directing the Township to amend the diversion application to bring it into compliance with the applicable statutory standards.

The amended application submitted by the Township to the Department differs from the original application in the following material respects:
  • The area proposed for diversion (and the release of the conservation easement) has been reduced from approximately 47 acres to approximately 34 acres.
  • The Township proposes to offer as replacement land two parcels totaling approximately 41 acres (designated for tax purposes as Block 54, Lots 21.02 and 26).
  • In order to comply with a previous Appellate Division Order, the amended applicationincludes supplemental information pertaining to endangered and threatened species habitat on the Landfill Lot.
  • The Township has proposed to revise the financial terms of the lease between the Township and Walters Development Group (the entity responsible for the construction of the solar project.)

Camden County Parks Department, located at 1301 Park Blvd, Cherry Hill, New Jersey 08002, will hold a public hearing to obtain comments regarding its application to the NJDEP Green Acres Program, proposing to divert a total of approximately 0.014 acres of parkland (the "Park") situated within Block 1.01, Lot 1 on the tax maps of the Borough of Oaklyn, Camden County, for the construction of a proposed underground electrical circuit as part of Public Service Electric and Gas Company's (PSE&G's) regional electrical upgrades (the Project).

The proposed parkland diversion would involve the installation of subsurface electrical circuits beneath Newton Lake adjacent to Black Horse Pike using microtunneling techniques. This involves boring horizontally below the bottom of the lake from pits dug on nearby properties. No disturbance to the lake will occur due to the construction, and the entirety of the lake will remain undisturbed when the Project is complete. In accordance with NJAC 7:36-26.1 O(e), monetary compensation will be provided by PSE&G to the County of Camden for parkland acquisition or improvements.

Take Notice that in accordance with N.J.S.A. 13:1D-51 through -58, the State of New Jersey, Department of Environmental Protection (''NJDEP''), Green Acres Program, will hold two public hearings to seek comments on a proposed exchange of property with the Township of South Brunswick, Middlesex County.

The NJDEP property proposed for exchange is an approximately 5-acre portion of a 30-acre property acquired by the Green Acres Program for the Division of Parks and Forestry in 1982 as an addition to Pigeon Swamp State Park. The property is designated for tax purposes as Block 18, Lot 20.01 in the Township of South Brunswick, Middlesex County. The street address for the property is Fresh Ponds Road (but the property does not have direct access to Fresh Ponds Road).

The Township has also requested that the NJDEP convey temporary and permanent easements in Block 18, Lot 10.01 and Block 18, Lot 20.01, as follows:

The proposed conveyances are needed by the Township in conjunction with the construction of a two (2) mile, two (2) lane segment of County Route 522 extending between US Route 130 and Cranbury - South River Road (County Route 535). Although the segment of Ridge Road that runs between US Route 130 and County Route 535 is currently designated as a part of County Route 522, the Township proposes to construct a new roadway north of (and parallel to) Ridge Road as the final segment of Route 522 in order to divert commercial truck traffic away from residential areas along Ridge Road. The proposed road project also involves the construction of a connector road from Route 522 to Fresh Ponds Road in order to limit access by trucks from Route 130 to Fresh Ponds Road. All properties proposed to be conveyed to the Township are wooded undeveloped lands located at the southern edge of Pigeon Swamp State Park and are not currently in active recreational use.

In exchange for the proposed conveyances, the Township and the County will convey to the NJDEP, in fee, two properties totaling approximately 59 acres for addition to Pigeon Swamp State Park (a 5-acre portion of Block 18, Lot 19.01 and all of Block 18, Lot 23). Block 18, Lot 19.01 is primarly wooded uplands; Block 18, Lot 23 contains a large pond, extensive freshwater wetlands and wooded uplands. The acreage proposed for conveyance is approximate and is subject to adjustment of up to 10 percent on the basis of a survey to be reviewed and approved by the NJDEP's Green Acres Program as part of the execution of conveyance documents for this transaction.
