Wastewater Treatment Ponds or Lagoons

EXISTING wastewater treatment systems, including treatment ponds or lagoons designed and constructed to meet the requirements of the Federal Clean Water Act (other than cooling ponds) are not regulated under the Freshwater Wetlands Protection Act;

NEW Wastewater Treatment Ponds or Lagoons (WTP) constructed outside of all areas regulated by the Division of Land Use Regulation (DLUR) does not require DLUR permits for either construction or maintenance.

NEW WTP facilities that are proposed within areas regulated by the DLUR may require a DLUR permit. If you are planning to construct a new facility, please contact the Division for more information.

NOTE: If maintenance requires that sediment or other material be removed from the WTP, this material may NOT be placed, either temporarily or permanently, within areas regulated by DLUR without a permit.
