GENERAL PERMIT 24 – Habitat Creation, Restoration, Enhancement and Living Shoreline Activities

General Permit 24 authorizes habitat creation, restoration, enhancement and living shoreline activities necessary to implement a plan for the restoration, creation, enhancement, or protection of the habitat, water quality functions, and values of wetlands, wetland buffers, and open water areas, which is sponsored by a Federal or State agency or other entity described at N.J.A.C. 7:7-6.24.

Please be advised:

  • The “sponsor” must be an active participant in, or a substantial financial contributor to, the activities and must endorse the activities in writing.
  • The nine types of acceptable habitat restoration, creation and enhancement and living shoreline plans are described at N.J.A.C. 7:7-6.24(b).
  • The habitat creation and enhancement activities authorized by the General Permit 24 are described at N.J.A.C. 7:7-6.24(c).
  • The items that must be demonstrated to prove eligibility for the General Permit 24 are described at N.J.A.C. 7:7-6.24(d).
  • Additional requirements apply to restoration, creation and enhancement activities if they are proposed in special areas as defined in N.J.A.C. 7:7-9.  These additional requirements including alternatives, minimization and conservation restrictions and are detailed at N.J.A.C. 7:7-6.24(e).
  • Additional requirements for living shoreline activities include size limits, and minimization of impacts to special areas, are detailed at N.J.A.C. 7:7-6.24(f).
  • Public access is provided in accordance with the Public trust rights rule, N.J.A.C. 7:7-9.48, and the Public access rule, N.J.A.C. 7:7-16.9.

If your project does not meet the requirements of the General Permit 24, it may qualify for another General Permit, Permit-by-rule, or an Individual Permit.  Additional information on these permit types can be found on the Coastal Permitting page.
