The Division of Land Use Regulation (Division) is within the Department's Land Use Management Program. The Division's main responsibility is overseeing the implementation of various Land Use statutes and implementing regulations. The Permit review process oversees regulated activities to ensure the associated environmental impacts are minimized in accordance with the applicable regulations. Environmentally sensitive areas under the purview of the Division include freshwater wetlands, coastal areas and flood prone areas.

The Bureau of Tidelands and Application Support breaks down into two distinct units - each tasked with different responsibilities. Application Support is responsible for the administrative functions of the entire Division which includes: mail receipt and distribution, pre-review of applications, database maintenance, file maintenance, and OPRA request processing. Tidelands staff conducts technical reviews and appraisal reviews as well as engineering reviews of survey and title information for both Tidelands license and grant applications. Office of Dredging & Sediment Technology

The Office of Dredging & Sediment Technology is under Site Remediation, but handles all Land Use permitting for purposes of investigation, remediation, closure and/or redevelopment of a property under the purview of the Site Remediation Program or the Division of Solid and Hazardous Waste. Permit applications which fall under this category may include:
- Freshwater Wetlands General Permit #4 – Hazardous Site Investigation/Cleanup
- Freshwater Wetlands General Permit #5 – Landfill Closure
- Freshwater Wetlands General Permit #27 – Redevelopment of Previously Disturbed Areas
- Individual Freshwater Wetlands Permit
- Flood Hazard Act Permit
- CAFRA General Permit #15
- Individual Waterfront Development Permit
Note: For larger properties undergoing remediation and redevelopment, a combination of one or more of the above permit applications would be submitted at one time (referred to by developers as a multiple permit application package) depending on regulatory jurisdiction.
ODST handles all permitting (Waterfront Development, Water Quality Certifications, CAFRA, Federal Consistency, Acceptable Use Determinations) for dredging and dredged material management associated with tidal waters, and dredging and other regulated activities at marinas. On the NY/NJ Harbor Complex and Delaware Estuary they handle construction activities at a port, commercial and/or industrial facility with berthing facilities on these estuaries.
