Update on Sampling for Pompton Lakes Plume Residents

The New Jersey Department of Environmental Protection (NJDEP) and the United States Environmental Protection Agency (US EPA) have reached an agreement with DuPont to include contaminants currently unrelated to the DuPont Pompton Lakes Works site investigation in the sub-slab soil testing that is being conducted throughout the investigation area. Residents inside the vapor mitigation area who have not already had soil gas testing conducted may use DuPont, NJDEP or an approved contractor to sample the soil gas and indoor air of their property, at DuPont's expense. At the residents' request, the soil gas sample may now also be analyzed for both the ten contaminants of concern related to the former manufacturing activities at DuPont as well as other volatile organic compounds associated with the analysis being conducted. Regardless of the results, residents located in the vapor mitigation area are eligible and encouraged to have a vapor mitigation system installed. All results will be provided to EPA and NJDEP for review and action, if necessary.

In addition, residents located in the expanded investigation area (aka "buffer zone") who have not yet had sub-slab soil gas testing conducted may also elect to have DuPont, NJDEP or an approved contractor conduct sub-slab soil gas testing include the additional analysis at their property. Those properties where elevated levels of soil gas contamination from the DuPont contaminated ground water plume are identified should have a vapor mitigation system installed at DuPont's expense. If elevated levels of contamination unrelated to the DuPont manufacturing activities are found residents are eligible to have indoor air sampling conducted by either NJDEP or an approved contractor to identify whether a vapor mitigation system is needed. If a mitigation system is needed the resident may continue with the NJDEP or an approved contractor. Any property owner choosing to use their own contractor, rather than NJDEP to conduct sampling and, if necessary, install a mitigation system must comply with the Spill Fund claims rules and will be required to file a claim with the NJ Environmental Claims Administration to be reimbursed for the cost of sampling or, if needed, system installation.
