Bilingual Program Waiver Request 2010-2011
New Jersey law and administrative code, N.J.A.C. 6A:15, requires school districts to establish bilingual education programs whenever there are 20 or more limited English proficient (LEP) students in any one language classification enrolled in the district, pursuant to N.J.S.A. 18A:35-18. Districts that enroll 20 or more limited English proficient (LEP) students from the same language classification may request a waiver from the requirement for a full-time bilingual education program if the district is able to demonstrate that due to the age range, grade span and/or geographic location of eligible students, it would be impractical to provide a full-time bilingual program. Such waiver requests must be submitted annually to and approved by the Department of Education.
If your district is not currently providing a full-time bilingual education program, as required by law, and meets the criteria for an alternative program, you must request a waiver for a bilingual instructional program alternative for the 2010-2011 school year. The bilingual program instructional alternatives that must be established include but are not limited to: bilingual part-time component, bilingual resource program, bilingual tutorial, sheltered English instruction, and high-intensity ESL.

A separate form must be completed for each language in which an alternative program will be offered.
