Asbestos Compliance Assistance

Asbestos Abatement Work

In New Jersey all asbestos abatement work must be conducted by a NJ Department of Labor and Workforce Development (DOLWD) licensed asbestos abatement contractor.  All of the contractor’s employees who conduct the asbestos abatement work must have a valid NJ DOLWD supervisor or worker permit.

All licensed contractors are required to submit notice to agencies designated, of any asbestos abatement covered by NJAC 8:60 and 5:16 at least 10 days in advance of the beginning of the work. 

The Asbestos Hazard Emergency Response Act (AHERA)

The federal law entitled the Asbestos Hazard Emergency Response Act (AHERA), sets down requirements for the identification and management of asbestos containing materials in school buildings. That rule and the regulations promulgated, outline requirements for the inspection, identification, and management of asbestos in any educational buildings which fall under the Act.  Asbestos inspectors, management planners, and project designers must possess currently valid certification from a state authorized by US Environmental Protection Agency (EPA) to certify those disciplines.  Although NJ does not have EPA authorization to certify those disciplines, they must still possess the appropriate AHERA certification when conducting work in NJ.

Vinyl Asbestos Floor Tiles (VAT) Removal

Part of the provisions of NJAC 8:60 and 12:120 allows for the exemption of non-friable asbestos containing materials (ACM).  The DOH may exempt from the permit requirements those designated asbestos-activities based upon sufficient data which indicates that no significant exposure exists while performing the abatement of the non-friable materials. In accordance with that regulatory requirement, there are procedures in place to allow for the exemption of VAT. Waste Disposal

The disposal of asbestos waste in NJ is regulated by the Department of Environmental Protection.  For information on those regulations, you can go to their Guidance Document for the Management of Asbestos Containing Materials page.
