The Board Minutes of August 6, 2003, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of September 3, 2003. All requirements of the "Open Public Meetings Act" have been complied with according to N.J. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of August 6, 2003, was called to order at 9:00 A.M.

Mr. Schooley welcomed the office's summer interns, Chantell Thomas and George Reynolds.

Chantell stated that she is going into her Junior Year at Rutgers University and is studying Criminal Justice.

George stated that he is going into his Senior Year at Rutgers University and is studying Economics.

Check in the amount of $500.00 received from Jason Ronchi, License #12230, as the eleventh installment of a civil penalty, and costs, in the amount of $6,162.00 for violation of N.J.S.A. 45:5A-9; N.J.A.C. 13:45C-1.2; and N.J.A.C. 13:31-1.10(c) (recodified as N.J.A.C. 13:31-3.3(c). Payments started August 21, 2002 and the balance due is $502.00.

The Board accepted the payment.

Check in the amount of $2,300.00 received from Michael Gaykowski, Unlicensed, as the second and final installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9. Payments started April 6, 1999.

Three (3) checks in the amount of $500.00 each received from Theodore Newcomer, License #4714 (Expired), as the first and final installment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-9.

Check in the amount of $25.00 received from Frank D'Arpa, License #8778, as the eighth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. and N.J.S.A. 56:8-1 et seq. Payments started September 25, 2002 and the balance due is $2,300.00.

The Board accepted the payment.

The Board requested that a letter be sent to Mr. D'Arpa asking him if he is now financially able to send in additional monies each month towards his civil penalty.

Check in the amount of $100.00 received from Dave Costabile, Unlicensed, as the eighth installment of a civil penalty in the amount of $1,000.00 for violation of N.J.S.A. 45:5A-9. Payments started September 20, 2002 and the balance due is $200.00.

Postal Money Order in the amount of $25.00 received from Emile Ayoub, Unlicensed, as the second installment of a civil penalty in the amount of $600.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started May 28, 2003 and the balance due is $550.00.

The Board accepted the payment.

Check in the amount of $200.00 received from Patrick O'Neill, License #12849, as the second installment of a civil penalty in the amount of $1,000.00 for violation of N.J.S.A. 13:45C-1.2. Payments started June 19, 2003, and the balance due is $600.00.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Scott Cohen, Electrical Training Course, requesting approval of 24 new courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Cohen advising him that the course entitled Analysis for the New York City Code is denied. The codes of New York City have no relevance to New Jersey Licensed Electrical Contractors. Additionally, the course entitled Master Electrician's License Preparation is also denied. Licensees who have already taken and passed the examination would not need to take such a class. Mr. Cohen will be advised that he may retitle this course for the Board's possible approval. The remaining 22 courses are approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Anthony T. Urbanik, Instructor #134, requesting approval of pre-approved courses and 118 new courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Urbanik advising him that the pre-approved courses have been approved and the 118 new courses have been approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Lois D'Apuzzo, Institute for Continuing Education, requesting approval of pre-approved courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Ms. D'Apuzzo advising her that the pre-approved courses have been approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Joe Bello, Technical Educational Services, requesting approval of 28 new courses and new instructors.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Robert A. McCullough, and unanimously passed, that a letter be sent to Mr. Bello advising him that the 28 new courses and the new instructors have been approved.

Mr. Bello will also be advised that even though the course entitled Defensive Driving is approved, the Board would like to know how much "course time" will be used for "video time". Mr. Bello will be further advised that he is not approved as the instructor for this course until such time as he provides the Board with his qualifications to teach such a course.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Joseph P. Kempker, Instructor #144, requesting approval of pre-approved courses; four new courses; and a new instructor.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Kempker advising him that the pre-approved courses have been approved; the four new courses have been approved, including the instructor.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Steven Ripley, Executive Director, New Jersey Electrical Contractors Association, requesting approval of pre-approved courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Ripley advising him that the pre-approved courses have been approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Jennifer Montalvo, Warshauer Electric Supply Co., requesting approval of pre-approved courses; 17 new courses; and new instructors

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Robert A. McCullough, and unanimously passed, that a letter be sent to Ms. Montalvo advising her that the pre-approved courses have been approved; the 17 new courses have been approved, including the instructors.

Letter dated June 21, 2003, received from Jon M. Stephenson, Sales Engineer, Olympic Wire & Cable Corp., responding to the Board's request that additional information be submitted to better explain the increase in the length of hours, and a better description concerning the revisions of the pre-approved courses. The Board disapproved the courses as submitted but did approve Mr. Stephenson as an instructor.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Robert A. McCullough, and unanimously passed, that a letter be sent to Mr. Stephenson advising him that the pre-approved courses have been approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Robert J. Czarnecki requesting to be approved as an instructor and approval of four courses.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Robert A. McCullough, and unanimously passed, that a letter be sent to Mr. Czarnecki advising him that the five courses have been approved and he is approved as an instructor.

Letter received from Thomas Valeo requesting approval to teach the Nine Hours of Code Changes and the One Hour of Laws, Rules and Regulations pursuant to N.J.S.A. 45:5A-13.3. As per the Board's request, Mr. Valeo has provided a letter from the Department of Community Affairs advising that his employment with Frank Bennett Electrical Corp. and his employment as an Electrical Sub-Code Official/Electrical Inspector is not a conflict of interest

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve Mr. Valeo to teach the Nine Hours of Code Changes and the One Hour of Laws, Rules, and Regulations.

Letter received from Stu Reiter, Instructor #13, requesting to become the sponsor/instructor for the pre-approved courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve Mr. Reiter as a sponsor/instructor of the pre-approved courses.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Michael Johnston, International Association of Electrical Inspectors, requesting approval of pre-approved courses; 3 new courses; and new instructors

Mr. Robert A. McCullough abstained from the motion as he is an instructor for the above indicated courses. Therefore, the following motion is to be ratified at the Board's next meeting of September 3, 2003.

The sub-committee voted to send a letter to Mr. Johnston advising him that the pre-approved courses have been approved; the 3 new courses have been approved, including the new instructors.

The Board reviewed and discussed the Department of Community Affairs, Division of Codes and Standards, approved Code Advisory Board Meeting Minutes of April 11, 2003.

Signed cease and desist agreements were received from: Daniel F. Coletta, Jr., t/a HP Home Repair, Newton, New Jersey; John Dwyer, Sloatsburg, New Jersey; Barry Friedman, Cherry Hill, New Jersey; Len Smukler, Livingston, New Jersey.

The Board accepted the signed cease and desist agreements.

The Board reviewed applications for the written examination to be administered by Experior Assessments, LLC. Forty-two (42) applications were approved.

Barbara A. Cook advised the Board that the proposed amendment - N.J.A.C. 13:31.3.4 - Definitions; Supervision of Electrical Work, was published in the August 5, 2003 New Jersey Register.

Mrs. Cook also advised the Board that she has completed entering the attendance of the licensees at CE Course/Seminars based on the sign in/sign out sheets for the continuing education code course seminars for the 2003 to 2006 renewal. There are 577 licensees that will receive a letter within the next few months asking to forward to the Board a copy of their 2002 Continuing Education Code Course Certificate.

Mrs. Cook further stated that the Board will start renewing Journeyman Electricians; there are approximately 2,600 Journeymen Electricians registered with the Board. There will be a $60.00 charge for a three year period, and they will be required to attend ten hours of continuing education, nine of code and one hour of law. Individuals who are currently registered will have the option of continuing their registration or not.

Mr. McCullough suggested that the Board send a letter to the Department of Community Affairs requesting that they publish an article in the Code Communicator informing the authority having jurisdiction that all journeyman cards will soon expire. New cards will be issued to be renewable every three years.

Mrs. Cook stated that the Board has 2,500 pending candidates on the shelf; 350 of which still need to be entered into the computer.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board's investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
