The Board Minutes of September 5, 2007, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of October 3, 2007. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve the Minutes of the 812th Meeting held August 1, 2007 with the following corrections:

Page 3, paragraph 8:

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that thirty (30) of the thirty-two (32) courses, and instructors, are approved as submitted.

Page 4, paragraph 10:

The first sentence of the motion is to read as follows:

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Reif advising him that the installation of gas piping, hydronic piping, boilers, and warm air furnaces is not considered electrical work.

Page 4, paragraph 4:

The Board was advised that no comments were received concerning the proposed draft of the Board’s Rules and Regulations which were to Sunset on May 2, 2007 but that date was extended by operation of law by six months.

Page 5, paragraph 7

Mr. McCullough stated that the Board has not approved any courses that are instructional manuals for computer programs such as Quick Books, Word, Excel, Access; these are commercially available programs. There is help built within the program, and the Board has always denied those specifically related training programs.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve (47) Initial Licenses effective September 5, 2007 to March 31, 2009.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (36) Initial Business Permits effective September 5, 2007 to March 31, 2009.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (4) Initial Business Permit Previously Expired effective September 5, 2007 to March 31, 2009.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve (13) Changes in Business Permits effective September 5, 2007 to March 31, 2009.

Check in the amount of $100.00 received from Nick Ortense, Unlicensed, as the eighteenth, nineteenth, twentieth, and twenty-first installment of a civil penalty in the amount of $1,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started October 18, 2005 and the balance due is $450.00.

The Board accepted the payment.

Check in the amount of $250.00 received from Daniel W. Anderson, Jr., Unlicensed, as the first and final payment of a civil penalty in the amount of $250.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq.

The Board accepted the payment.

Check in the amount of $1,000.00 received from David J. Paltjon, License #7282, as the second installment of a civil penalty in the amount of $3,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3 (c). Payments started June 19, 2007 and the balance due is $1,500.00.

The Board accepted the payment.

Check in the amount of $500.00 received from Christopher Page, License #13710, t/a Northwest Electrical Construction, as the second and third installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9; N.J.A.C. 13:31-3.3 (c); and N.J.S.A. 56:8-1 et seq. Payments started July 3, 2007 and the balance due is $1,750.00.

The Board accepted the payment.

Two Postal Money Orders in the amount of $100.00 each were received from James H. Gandy, Unlicensed, as the third and fourth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $2,100.00.

The Board accepted the payment.

Postal Money Order in the amount of $300.00 received from Jack Giaimo, License #7375, t/a Powermaster Electric, as the fifth installment of a civil penalty in the amount of $3,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started April 16, 2007 and the balance due is $2,100.00.

The Board accepted the payment.

Letter dated August 24, 2007, received from Glenn C. Strouse, requesting a six-month continuance of business under permit #5589 according to N.J.S.A. 45:5A-14. The licensee, David S. Strouse, Jr., passed away on August 8, 2007.

Mr. Strouse stated that he recently passed the electrical contractors examination and needs the six-month period to file the necessary paperwork to apply for the license and business permit.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that a letter be sent to Mr. Strouse advising him that the Board has granted the firm of Strouse Electric Co., Inc., a six-month continuance of Business Permit #5589 according to N.J.S.A. 45:5A-14.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Joseph P. Dunne.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that five (5) courses, and instructors, are approved as submitted. The previously approved courses are also approved.

Mr. Robert A. McCullough abstained from the following motion as he is one of the instructors who will be teaching the courses being presented to the sub-committee.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Andre Cartal, South Jersey Chapter IAEI.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and passed, that five (5) new courses, and instructors, are approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Jean Francis, New Jersey Electrical Contractors Association.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the courses entitled "Fall Protection", "Occupational Heath and Safety Act", "Excavation and Trenching Safety", "General Safety and Health", and "Personal Protection" are being denied as the course descriptions were not included. Additionally, the ten (10) remaining new courses, and instructors, are approved. The previously approved courses are also approved.

The Board reviewed the Fire Alarm, Burglar Alarm and Locksmith Advisory Committee proposed regulation to decrease the business licensee fee for big businesses. The comment period ended August 3, 2007 and no comments have been received.

Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to adopt the proposed regulation to decrease the business license fee for big businesses.

The Board reviewed an E-Mail dated August 2, 2007, received from Gina Gizzi stating that the licensing examination has a 95% failure rate. Ms. Gizzi also stated that the examination does not accurately measure knowledge and skills. Ms. Gizzi further stated that she is not suggesting that the examination be easy; however, it should be relevant to ones work and obtainable through good experience and education.

Mr. Flaherty stated that this examination was not developed by the Board; it is a nationally developed electrical contractors licensing examination.

Mrs. Cook stated that we have an increasing number of candidates taking the test and the passing rates have increased.

Mr. Cantalupo stated that many of the applicants are qualified; unfortunately they find it hard to take an examination.

Mr. Schooley stated that the Board utilizes the services of an international testing service; the test questions are derived from experts in the electrical contracting field. The test questions are based on the knowledge of the electrical contractor’s daily function. The Statute requires the testing of all phases of electrical contracting.

Mr. Malec requested that Thomson Prometric provide the Board with the number of candidates who have passed all three parts of the examination the first time; number of candidates who have passed all three parts of the examination the second time; and the number of candidates who have passed all three parts of the examination the third time.

The Board reviewed a Civil Action Final Order and Judgment filed on June 26, 2007 ordering that Roy Leeflang, Unlicensed, individually, and Know How Construction Company, Inc., are permanently restrained and enjoined from offering to engage in or engaging in the practice of electrical contracting or plumbing contracting in the State of New Jersey unless and until they are licensed to do so; are permanently enjoined from the employment of deceptive business practices, misrepresentation and/or false pretense, whereby defendants purport to subcontract electrical work or plumbing work to a licensed electrical contractor or plumbing contractor, obtaining thereby a permit from the municipality to perform electrical work or plumbing work, and then have unlicensed persons unaffiliated with the licensed electrical contractor or plumbing contractor perform the actual electrical and/or plumbing work without the supervision of a licensed electrical contractor or master plumber; pay restitution in the amount of $7,012,65 to Linda Montgomery; pay a civil penalty in the amount of $2,500.00; pay attorney fees in the amount of $10,261.00; and pay costs in the amount of $1,662.00.

Signed cease and desist agreements were received from Robert Smith, Dover, Delaware and Daniel W. Anderson, Tinton Falls, New Jersey.

The Board accepted the signed cease and desist agreements.

Mr. Malec advised the Board that licensees who have chosen "inactive" status for their license are not being provided with a certificate of completion from the instructor because the licensee does not have a current identification card.

Mr. Malec also stated that the continuing education sponsors should be notified that an "inactive" licensee is not provided with a certificate; however, upon the request of the licensee, the Board can provide a letter which reflects that the license has been placed in an "inactive" status. Such a letter would be an acceptable form of identification.

The Board requested that all sponsors be notified in writing of same.

Mr. Gianella stated that in regards to the Board’s discussion concerning the examination, individuals who only perform residential work should not have take all three parts of the examination.

Mr. McCullough stated that the Statute makes no such provision; an applicant would have to take and pass all three parts of the examination in order to become licensed.

Mr. Cantalupo stated that the Board cannot make such a change; this would have to be done through legislation.

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Fifteen (15) applications were approved.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
