789 BUSINESS MEETING BOARD OF EXAMINERS OF ELECTRICAL CONTRACTORS
(PUBLIC SESSION) - - - SEPTEMBER 7, 2005

The Board Minutes of September 7, 2005, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of October 5, 2005. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of September 7, 2005, was called to order at 9:00 A.M. The following members were present.

The Board saluted the flag.

Mr. Schooley requested a moment of silence for the people who have been affected by Hurricane Katrina. Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve the Minutes of the Special Meeting held July 20, 2005.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve the Minutes of the 788 Meeting held August 3, 2005.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to approve (23) Initial Licenses effective September 7, 2005 to March 31, 2006.

Postal Money Order in the amount of $300.00 received from John J. Helmstetter, License #7192, as the fifteenth installment of a civil penalty in the amount of $7,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8.1 et seq. Payments started June 7, 2004 and the balance due is $3,000.00.

The Board accepted the payment.

Check in the amount of $25.00 received from Frank D’Arpa, License #8778, as the thirty-first installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started September 25, 2002 and the balance due is $1,725.00.

The Board accepted the payment.

Mr. William Hartz and Mr. Tim Guerre appeared before the Board.

Mrs. Cook stated that Mr. Guerre has advised that there are many applicants taking the electrical contractor’s examination and would like to know if the Board would allow a Saturday test date in addition to the regularly scheduled examination dates.

Mr. Schooley asked whether or not two different testing sites could be utilized as in the past?

Mr. Guerre stated that is a problem as there are not enough proctors during the week; wherein more proctors are available on a Saturday. The test would be a Tuesday and then the next Saturday of that week.

DAG Carboni asked whether or not different questions would be utilized for the Saturday date?

Mr. Guerre stated that 40% to 60% of the same questions are on all examinations; the rest are a combination of questions so that all applicants do not get the same questions.

Mr. Schooley stated that he attended a continuing education seminar and was approached by approximately 15 individuals who complained about the integrity of the examination. Mr. Schooley stated that he was advised that there were no code books; applicants had palm pilots; lap tops; phones and beepers at their desk.

Mr. Guerre stated that he would look into this for the Board.

Mr. Hartz asked the Board if they have made a decision concerning the computerized examination?

Mrs. Cook stated that Mr. Hartz was not able to provide a visual presentation when he appeared to discuss the electronic examination.

Mr. Guerre stated that there are six locations, West Orange, Fairlawn, Hamilton, Deptford, Toms River, and Clark, New Jersey

Mr. Hartz stated that there are approximately15 to 20 computers at each site.

Mr. Schooley stated that he does not want the applicant to be able to choose to take only one portion of the examination at a time; the applicant must take all three parts of the examination.

Mr. Hartz stated that he will provide the Board with a listing of all of the examination sites; how many computers are at each site; whether or not calculators and code books will be provided; and the number of applicants that can be tested at each site.

Letter dated August 22, 2005, received from John J. Murphy, President, S.M. Electric Company, Inc., requesting a six-month continuance of business under permit #191 according to N.J.S.A. 45:5A-14. The licensee, Peter V. Cheche, Sr., died on August 11, 2005.

Mr. Murphy stated that Peter V. Cheche, Jr., License #5225, will supervise the work being performed.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that a letter be sent to Mr. Cheche advising him that the Board has granted the firm of S.M. Electric Company, Inc., a six-month continuance of business permit #191 according to N.J.S.A. 45:5A-14.

Letter dated August 24, 2005, received from Dominick M. Yannetta, Yannetta Electric Company, Inc., requesting a fourth six-month continuance of business under Permit #1109 according to N.J.S.A. 45:5A-14. The licensee, Angelo Yannetta, died on August 7, 2003.

Motion made by Mr. Robert A. McCullough and seconded by Mrs. Pushpavati Amin, and unanimously passed, that the firm of Yannetta Electric Company, Inc. be granted an additional one month extension to complete any unfinished jobs. At the end of the one month extension, Mr. Yannetta will be required to return the pressure seal issued to Yannetta Electric Company, Inc.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Richard Van Wert requesting approval of new courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that the following courses, and instructor, are approved as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Mark Crowley requesting approval of new courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that the following courses, and instructors, are approved as submitted.

Mr. Crowley will be advised that the Board does not approve half hour increments. Therefore, any courses that are one and one half hours in length will be considered a one hour course. Should Mr. Crowley wish the courses to be two hours in length, he must resubmit his request.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from John P. Judge requesting approval of new courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that a letter be sent to Mr. Judge advising him that his request to teach continuing education courses is disapproved. The courses submitted by Mr. Judge did not provide enough of a detailed breakdown and course description. Additionally, Mr. Judge did not indicate which instructors are teaching the courses submitted. Mr. Judge will be further advised that he may resubmit his request.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Andre Cartal requesting approval of new courses.

Mr. McCullough abstained from the discussion and the motion as he is listed as one of the instructors.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mrs. Pushpavati Amin, and passed, that the following course, and instructors, are approved as submitted.

Mr. Malec, sub-committee member, also approved the following course, and instructors, via the telephone.

DAG Carboni stated that she agrees with this decision because she is aware that the full Board would approve this course, and the fact that another Board member, Mr. Malec, approved this course. Any conflict that exists is more technical than actual.

"NEC Code Update" (9 hours of code changes and 1 hour of laws, rules, and regulations)

Mr. Schnaper will be requested to forward to the Board a more detailed resume for Phil Acone.

Maryann Sheehan, Regulatory Analyst, Director’s Office, appeared before the Board to discuss a draft of N.J.A.C. 13:31-1.9 Business Name Change which states that a business permit holder who seeks to change the legal name of his or her electrical contracting business shall submit a written application to the Board requesting such change and shall disclose any legal judgement or decree that has been entered against the electrical contracting business by any court or by the regulatory authority in any state.

Motion made by Mr. Robert A. McCullough and seconded by Mrs. Pushpavati Amin, and unanimously passed, to approve the language as drafted regarding N.J.A.C. 13:31-1.9.

The Board also discussed proposing a rule that would require the qualifying licensee to notify the Board when he/she will no longer endorse the business permit to a company.

DAG Carboni stated that the regulations should stipulate that once a licensee no longer endorses his business permit to a company, that licensee must immediately advise the Board of same.

Mr. Schooley stated that the licensee, and the owner of the company, should advise the Board within five business days that the licensee is no longer endorsing his business permit to the company. The licensee should also be required to inform the townships that he is no longer the contractor of record concerning any outstanding permits on file.

The Board held this matter in abeyance for further discussion as it was undecided as to whether or not a company would be allowed to utilize the pressure seal of the licensee who is leaving the company as reflected in N.J.A.C. 13:31-3.3 Pressure Seal and Signature Requirements.

The Board reviewed, for adoption, N.J.A.C. 13:31A-2.7 Locksmith Employees which states that any person employed by a licensee to perform unsupervised locksmithing services shall have successfully completed a total of four hours of training in the Barrier Free Subcode, N.J.A.C. 5:23-7, the New Jersey Uniform Construction Code, N.J.A.C. 5:23, exclusive of the Barrier Free Subcode, and the Americans with Disabilities Act Code, 36 C.F. R. § 1191; four hours of training in basic electronics; and four hours of training in trade related subjects, or have successfully passed a competency examination administered by the Committee, or have obtained a Certified Registered Locksmith rating by the Associated Locksmiths of America (ALOA), or have obtained a Certified Institutional Locksmith rating by the Institutional Locksmiths’ Association (ILA). (Addition in bold)

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, to adopt N.J.A.C. 13:31A2.7 Locksmith Employees.

The Board reviewed the redesigned Telecommunications Wiring Exemption Card which would make clear that the card is issued for the installation of telecommunications wiring only.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that the word "Limited" be included on the front of the card under the wording Telecommunications which would read "Limited Wiring Exemption". The Board requested that the card produced by Mrs. Cook be utilized as soon as possible.

The Board reviewed applications for the written examination to be administered by Experior Assessments, LLC. Twenty-three (23) applications were approved

Motion made by Mr. Robert A. McCullough and seconded by Mrs. Pushpavati Amin, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
