Prevailing Wage Act
The New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25 et seq.) was created to enforce a prevailing wage level for workers engaged in public work in order to protect them as well as their employers from the effects of serious and unfair competition.
- Prevailing Wage Rate Determinations lists wage and fringe benefit rates based on collective bargaining agreements established for a particular craft or trade on the locality in which the public work is performed.
Please note that in New Jersey, rates vary by county and statewide and by the type of work performed. All rates designated as expired "remain in effect" until new rates are posted.
- Payroll Certification [pdf 27k] for Public Works Projects (for Contractor and Sub-Contractor's Use for Weekly and Final Certification) requires that a business must submit certified payroll records to the public body for each employee on the project. The General Contractor is responsible for ensuring that each sub-contractor submits the certified payroll within ten (10) days of the payment.
- Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48, et seq.) requires all contractors, subcontractors, or lower tier subcontractors (including subcontractors listed in bid proposals) who bid on or engage in the performance of any public work register with the Department of Labor and Workforce Development.
Official Prevailing Wage Determinations are issued by the New Jersey Department of Labor and Workforce Development, Division of Wage and Hour Compliance, Public Contracts Section, for specific projects by request of the contracting Public Entity. TO ACQUIRE OFFICIAL PREVAILING WAGE RATES FOR A SPECIFIC PROJECT, YOU MUST CONTACT THE CONTRACTING PUBLIC ENTITY.
