The Highlands Land Use Capability Zone Map uses overlay zones to address the requirements of the Highlands Water Protection and Planning Act (Highlands Act) and to provide regional guidance for the implementation of the policies in the Regional Master Plan.
Purpose:
Implementation of the Highlands Regional Master Plan will be guided by the Highlands Land Use Capability Zone Map that, through the identification of geographic zones, provides for a comprehensive evaluation of both resource constraints and development opportunity. It addresses the potential for conflict between natural resource protection and economic growth by identifying constraints and capacity limitations of land and infrastructure, and identify those areas within the Highlands that can best support appropriate and varying levels of development activity.

THIS IS THE PARCEL-BASED LAND USE CAPABILITY ZONE MAP (LUCM) WHICH WAS DERIVED FROM THE ORIGINAL REGIONAL LUCM BY MEANS OF THE PROCESS DESCRIBED IN THE "PROCESS" TAB OF THE "DATA QUALITY" SECTION OF THIS METADATA.
The overlay zones distinguish between high resource value lands that are important to maintaining water quality, water quantity, and sensitive ecological resources and processes (Protection Zone), and those lands with regionally significant concentrated development that signify existing communities (Existing Community Zone). In addition, the Conservation Zone identifies those areas with significant agricultural use lands interspersed with associated woodlands and environmental features that should be preserved when possible.
Within the overlay zones exist overlay subzones which recognize the occurrence of environmentally significant features within the Protection, Existing Community and Conservation zones. The Wildlife Management Sub-Zone consists of both areas managed by the United States Fish and Wildlife Service as part of the National Wildlife Refuge System and Wildlife Management Area System administered by the NJDEP Division of Fish & Wildlife's Bureau of Land Management. These areas are part of a network of lands and waters for conservation, management, and where appropriate, restoration of fish, wildlife, and plant resources and their habitats and permit compatible wildlife-dependent recreational uses. The Existing Community Zone - Environmental Constrained Sub-Zone consists of significant contiguous critical habitat, steep slopes, and forested lands within the Existing Community Zone that should be protected from further fragmentation. The Lake Community Sub-Zone consists of patterns of community development around lakes that are within the Existing Community in order to protect water quality, resource features, shoreline development recreation, scenic quality and community character. The Conservation Zone - Environmental Constrained Sub-Zone consists of significant environmental features within the Conservation Zone that should be preserved and protected from non-agricultural development.
Overlay zones serve to establish an area that addresses distinguishing circumstances or landscape features, and is superimposed over existing municipal zoning. Overlay zones do not replace existing municipal zoning, but rather build upon base zoning by establishing additional standards and criteria, and are intended to provide a means to address issues of special public interest identified in the Highlands Act (e.g. watershed management area, open space preservation, historic preservation, urban enterprise zone) that the underlying base zoning may not otherwise take into consideration.
In the Highlands Region, overlay zones will provide all levels of government (Federal, State, county, and municipal) and the public with an indication of areas where special consideration is required to protect regionally significant resources. Overlay zones also indicate where and how development initiatives may occur based on the ability of areas to accommodate growth. The LANDS model was designed to develop these overlay zones each with their own purpose, application, and minimum standards as generally discussed below and these will collectively be referred to as overlay designations.

For all data contained herein, Highlands Council makes no representations of any kind, including, but not limited to, the warranties of merchantability or fitness for a particular use, nor are any such warranties to be implied with respect to the digital data layers furnished hereunder. The Highlands Council assumes no responsibility to maintain them in any manner or form.
II. Terms of Agreement
1. Digital data received from the Highlands Council are to be used solely for internal purposes in the conduct of daily affairs.
2. The data are provided, as is, without warranty of any kind and the user is responsible for understanding the accuracy limitations of all digital data layers provided herein, as documented in any accompanying Data Dictionary and Readme files. Any reproduction or manipulation of the above data must ensure that the coordinate reference system remains intact.
3. Digital data received from the Highlands Council may not be reproduced or redistributed for use by anyone without first obtaining written permission from the NJ Highlands Council. This clause is not intended to restrict distribution of printed mapped information produced from the digital data.
4. Any maps, publications, reports, or other documents produced as a result of this project that utilize Highlands Council digital data will credit the Highlands Council's Geographic Information System (GIS) as the source of the data with the following credit/disclaimer:
"This (map/publication/report) was developed using New Jersey Highlands Water Protection and Planning Council's Geographic Information System digital data, but this secondary product has not been verified by the Highlands Council and is not state-authorized."
5. Users shall require any independent contractor, hired to undertake work that will utilize digital data obtained from the Highlands Council, to agree not to use, reproduce, or redistribute Highlands Council GIS data for any purpose other than the specified contractual work. All copies of Highlands Council GIS data utilized by an independent contractor will be required to be returned to the original user at the close of such contractual work.
Users hereby agree to abide by the use and reproduction conditions specified above and agree to hold any independent contractor to the same terms. By using data provided herein, the user acknowledges that terms and conditions have been read and that the user is bound by these criteria.

Primary Zones: 1. Regional LUCZ map is intersected with the latest Highlands parcel dataset which excludes all road rights-of-way. 2. WMA parcels are reverted to their "underlying zone". 3. All lots with >=98% single zone are placed entirely into that zone regardless of parcel size. 4. Lots with <=5 acre total parcel size, of which more than 50% is a single zone are placed entirely into that zone. 5. Lots with >=50% single zone and less than 10% AND 3 acres of each other zone are placed entirely into the primary zone. 6. Remaining parcels with more than one zone are processed with the "Smoothing" ArcGIS tool (PAEK algorithm, 300 foot tolerance). 7. Identify polygons in remaining parcels that are less than 1 acre. Remove and fill with majority adjoining LUCZ within the parcel (adjacent polygon with which it shares the largest boundary). 8. Lots with >=50% single zone and less than 10% AND 5 acres of each other zone are placed entirely into the primary zone regardless of parcel size. 9. Remaining parcels maintain multiple zones with smooth boundaries. 10. WMA parcels are added back, replacing the zone(s) on those properties.

Environmentally Constrained Sub Zones: 1. Smoothed Constrained Sub Zone layer (derived by selecting the two Environmentally Constrained sub-zones from the Regional LUCM and running them through the same PAEK smoothing algorithm, 300 foot tolerance) is overlaid on the Primary Zone layer from first steps. 2. Constrained areas are removed from WMA and Protection Zone areas. 3. On parcels with constrained areas, polygons of Existing Community Primary Zone are changed to Existing Community Constrained Sub Zone WHERE: parcel <= 1 acre, polygon <= 1400 sqft (0.0321396 acre); parcel > 1 acre and <= 5 acres, polygon <= 1/8 acre; parcel > 5 acres, polygon <= 1/4 acre. 4. On parcels with constrained areas, polygons of Conservation Primary Zone are changed to Conservation Constrained Sub Zone WHERE: parcel <= 1 acre, polygon <= 1400 sqft; parcel > 1 acre and <= 5 acres, polygon <= 1/8 acre; parcel > 5 acres, polygon <= 1/2 acre. 5.
