Effective June 19, 2006, there were a number of significant amendments to the scope of negotiations
rules. Among them are amendments that require that facts contained in supporting briefs be supported by certifications based on personal knowledge. In cases arising from the withholding of a teaching
staff member’s salary increment, the employer must now provide a copy of the statement of reasons issued to the teacher at the time the increment was withheld. Briefs should no longer be submitted
with a petition. Parties will receive a notice of filing from the Commission that will include a briefing schedule or otherwise describe how the case will be processed. Other changes require the filing
of more complete briefs including citations to, and discussion of, pertinent precedent.
Parties are advised to consult the new rules and new forms that reflect the rule changes.
