Chairman Litwin called the meeting to order at 10:32 a.m.

Chairman Litwin read the Open Public Meetings Statement.

Chairman Litwin led all present in the salute to the flag.

Ms. Buckelew called the roll as follows:

Present: Chairman Larry Litwin, Grayson Barber, Thomas Cafferty, George Cevasco, Richard DeAngelis, William Kearns, Pamela McCauley, Jack McEntee, Rosemary Karcher-Reavey, and Karen Sutcliffe.

Absent: Edithe Fulton, John Hutchinson and H. Lawrence Wilson.

Also present: Marc Pfeiffer, Acting Executive Director of the Government Records Council, Paul Dice, Assistant Executive Director of the Government Records Council, Catherine Starghill, Legal Specialist and Lori Buckelew, Division of Local Government Services staff.

Mr. Cafferty moved to approve the minutes of March 21, 2003, with a second by Judge Karcher-Reavey. The motion was adopted on a call of ayes and nays as follows:

Ayes: Chairman Litwin, Ms. Barber, Mr. Cafferty, Mr. Cevasco, Mr. DeAngelis, Ms. McCauley, Mr. McEntee, and Judge Karcher-Reavey.

Nays: None.

Abstain: Mr. Kearns and Ms. Sutcliffe.

Ms. Barber presented a proposal to solicit written comments on home addresses. Chairman Litwin suggested that the Privacy Study Commission solicit comments from organizations. Mr. Kearns suggested that comments should be accepted through e-mail, written or at the public hearing and should not be limited only to the issue of home addresses. Mr. DeAngelis suggested that solicitation of comments and the public hearing notice be placed in the New Jersey Registrar. Ms. Starghill noted that the newly designed Privacy Study Commission website will have a page for the public to submit comments.

Subcommittee Reports were discussed as follows:

Special Directive: Ms. Barber reported that the subcommittee is compiling information on how other States and jurisdictions handle the release of home addresses and phone numbers.

New Jersey Practices: Mr. Pfeiffer provided a brief recap of OPRA and GRC related privacy issues.

Outside New Jersey: Ms. Starghill provided a detail analysis comparing New Jersey to the benchmark States of California, Connecticut, and Florida. Mr. DeAngelis requested that the analysis include the practical effect law has had in the benchmark States.

Public Interest: Judge Karcher-Reavey stated that there has been a delay in holding the public hearings. Ms. Starghill noted that there will be three public hearings in June, one in each region of the State.

Technology: Mr. Kearns stated that there will be a meeting with OIT to demonstrate data gathering systems including Geographic Information System.

Commercial Use: Mr. Cafferty stated that the subcommittee will have their first meeting on May 5th and will be meeting with Lexis Nexis.

Ms. Starghill provided the Commission with a staff update. Ms. Starghill noted that the Privacy Study Commission e-mail address is privacy@dca.state.nj.us and that the website will be live in approximately 3 weeks.

Chairman Litwin opened the meeting for public comment. Hearing no one, Mr. Kearns moved to adjourn, with a second Ms. Barber.

Chairman Litwin adjourned the meeting at 12:05 p.m.
