SUBJECT: Extension of COBRA Subsidy Eligibility through March 31, 2010
President Obama has signed H.R. 4691, the Temporary Extension Act of 2010, into law. This Act extends eligibility for the COBRA-ARRA premium subsidy from February 28, 2010 until MARCH 31, 2010.
COBRA Applications and other COBRA related information have been updated and are available on the SHBP/SEHBP Web site: http://www.state.nj.us/treasury/pensions/health-benefits.shtml
Assistance eligible individuals affected by the extension include individuals involuntary terminated from employment anytime between September 1, 2008 and March 31, 2010*.
*Additional eligibility restrictions may apply. See the Certifying Officer Letter of March 11, 2009 for full details on eligibility for the COBRA ARRA premium subsidy.
The Act also contains a new rule where the initial qualifying event is/was a reduction in hours. This means assistance eligible individuals who experience a reduction in hours anytime after September 1, 2008 and then are involuntary terminated on or after March 2, 2010 and on or before March 31, 2010 are now eligible for the subsidy. There is also a new election period for anyone who had a reduction in hours and did not choose COBRA or who chose COBRA and subsequently lost coverage and were later involuntary terminated from employment on or after March 2, 2010 and on or before March 31, 2010.
The amount of the subsidized COBRA premium remains unchanged — qualified individuals continue to pay 35 percent of the regular COBRA premium.
Similarly, the 15 month subsidy period remains unchanged (this period was extended from 9 months in December 2009 by the Department of Defense Appropriations Act of 2010 and is discussed in the Division’s Certifying Officer Letter of February 1, 2010).

SUBJECT: Extension of COBRA Subsidy Letter and HIPAA Required Notices to SHBP/SEHBP Enrollees
The Health Benefits Bureau of the Division of Pensions and Benefits is issuing the two attached documents to employers who participate in the State Health Benefits Program (SHBP) or the School Employees' Health Benefits Program (SEHBP).
- The attached Certifying
Officer Letter addresses the extension of eligibility and duration for the COBRA premium subsidy available to certain individuals
under the American Recovery and Reinvestment Act of 2009 (ARRA).
Please note that employer responsibility regarding the extended subsidy involves recent or soon-to-be COBRA enrollees — the Health Benefits Bureau has already notified COBRA members enrolled prior to December 31, 2010 of the extended subsidy.
- The second attachment is the HIPAA Required Notices to SHBP/SEHBP Enrollees which employers are required to provide to new enrollees in the SHBP or SEHBP — and is also required to be provided to all of your SHBP or SEHBP enrollees a minimum of once every three years.

and Benefits as notice of
the Dependent Eligibility Verification Audit (DEVA) being conducted by Aon Consulting for the State Health Benefits Program (SHBP) and School Employees' Health Benefits Program (SEHBP). DEVA mailings directly to employee home addresses are scheduled to begin February 10, 2010.
Employee compliance with DEVA is required under State law. Employees must provide specific documentation to verify that persons listed as eligible dependents meet the standards for dependent coverage under the SHBP or SEHBP.
