Department of Agriculture | Hemp Program Update skip to main content skip to main navigation

New Jersey hemp legislation was passed in November of 2018, and in December, the 2018 Farm Bill was passed, which removed hemp from the controlled substances list. This made hemp a legal crop. We are now awaiting the USDA to propose its hemp rules in order for us to receive the requisite federal approvals. Once the USDA rules are approved, the USDA then will have to approve the rules for each state. The USDA has said it intends to review state proposals in the fall of 2019. The rules for each state will include testing procedures, certification methods, inspection plans and additional measures. The New Jersey Department of Agriculture has given this issue the highest priority.
