A regular meeting of the Civil Service Commission was held on Wednesday, February 2, 2011, in Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION:    The Civil Service Commission acknowledged all of the settlements except for the second matter regarding Darlene Hannah-Collins, which was held over.

Somers Givens, Institutional Trade Instructor 1, Bayside State Prison, Department of Corrections, resignation not in good standing effective April 6, 2010, on the charge of job abandonment.

Recommendation of the Administrative Law Judge - Modify the resignation not in good standing to a six-month suspension.

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Taariq Aziz, Senior Correction Officer, Northern State Prison, Department of Corrections, removal effective February 4, 2010, on charges of conduct unbecoming a public employee, other sufficient cause and violation of a rule, regulation, policy, procedure, order or administrative decision.

Recommendation of the Administrative Law Judge - Modify the removal to an oral reprimand.

ACTION:  The Civil Service Commission modified the recommendation of the Administrative Law Judge to a 60-working day suspension.

A-4     KELLY CARMICHAEL

Kelly Carmichael, Security Guard, Jersey City School District, removal effective April 12, 2010, on charges of chronic and excessive absenteeism.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Rasheed Chambers, County Correction Officer, Hudson County, Department of Corrections, removal effective July 9, 2010, on charges of conduct unbecoming a public employee, neglect of duty, incompetency, inefficiency or failure to perform duties and other sufficient cause.

ACTION:       The Civil Service Commission directed that this matter be held over.

Recommendation of the Administrative Law Judge - Deny the motion to enforce the settlement and uphold the removal.

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Patricia Hayes, Licensed Practical Nurse, North Jersey Developmental Center, Department of Human Services, removal effective February 25, 2008, on charges of verbal abuse of a client, physical abuse of a client and inappropriate physical contact or mistreatment of a client.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

LaShauna Swinney, Police Officer, City of Jersey City, Police Department, removal effective July 19, 2010, on charges of insubordination, conduct unbecoming a public employee, and other sufficient cause.

Recommendation of the Administrative Law Judge - Modify the removal to a 30-working day suspension.

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-18   MARTIN BROOKS AND EMILY REED

Martin Brooks, Senior Youth Worker, and Emily Reed, Youth Worker, Arthur Brisbane Child Treatment Center, removals effective June 20, 2003, on charges.

Recommendation of the Administrative Law Judge - Uphold the removals of Martin Brooks and Emily Reed.

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge and dismissed the charge of falsification against Martin Brooks.

In In the Matter of Administrative Analyst 1 (PS5546K), Department of Human Services (CSC, decided June 10, 2009), the Civil Service Commission granted the appointing authority's request for an appointment waiver from the October 2, 2008 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration. However, the appointing authority did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

B-53   EXECUTIVE ASSISTANT (M0582K), PLAINFIELD HOUSING AUTHORITY

In In the Matter of Executive Assistant (M0582K), Plainfield Housing Authority (CSC, decided July 21, 2010), the Civil Service Commission held in abeyance Plainfield Housing Authority's request for a waiver of the appointment requirement pending the determination of the Division of State and Local Operations (SLO)) regarding the classification of Lewis Hurd's position. SLO determined that Hurd was to be considered serving in the unclassified title of Director of Redevelopment, Housing Authority, and the matter is now being presented to the Commission.

The appeal of Joseph Desmond, a Senior Correction Officer with the South Woods State Prison, Department of Corrections, of his 30-day suspension and removal, effective March 18, 2010, on charges, was heard by Administrative Law Judge Bruce M. Gorman, who rendered his initial decision on October 7, 2010.  At its meeting on January 19, 2011, the Civil Service Commission adopted the ALJ's recommendation to acknowledge the settlement agreement between the parties. However, the Commission found it necessary to address the exceptions and cross-exceptions filed by the parties. The proposed final decision is now submitted for the Commission's review. 

ACTION:    The Civil Service Commission adopted the final decision.

B-59   KIM GOINES

The appeal of Kim Goines, a Juvenile Detention Officer with Middlesex County, Department of Adult Corrections, of her removal on charges, was heard by Administrative Law Judge Walter M. Braswell, who rendered his initial decision on October 22, 2010.  At its meeting on January 19, 2011, the Civil Service Commission did not adopt the ALJ's recommendation to modify the removal to a six-month suspension.  Rather, the Commission upheld the removal.  The proposed final decision is now submitted for the Commission's review. 

ACTION:    The Civil Service Commission adopted the final decision.

B-60   DONNA JACKSON

The appeal of Donna Jackson, a County Correction Officer with Hudson County, of her removal, effective May 6, 2010, on charges, was heard by Administrative Law Judge Imre Karaszegi, Jr., who rendered his initial decision on September 1, 2010.  At its meeting on January 19, 2011, the Civil Service Commission did not adopt the ALJ's recommendation to uphold the removal.  Rather, the Commission remanded the matter to the Office of Administrative Law for further proceedings. The proposed decision is now submitted for the Commission's review.

B-92   PROPOSED AMENDMENTS: N.J.A.C. 4A:2-1.1 AND 4A:4-2.17; PROPOSED NEW RULE 4A:2-1.8, APPEAL AND EXAMINATION FEES

Submitted for the Commission's approval is a Notice of Proposal of amendments to N.J.A.C. 4A:2-1.1, Filing of appeals, and 4A:4-2.17, Application processing fees; and new rule N.J.A.C. 4A:2-1.8, Appeal processing fees.  P.L.2010, c. 26, amended Title 11A of the New Jersey Statutes to establish a new processing fee of $20 for appeals submitted to the Civil Service Commission, and to increase the examination processing fee from $15 to $25 for tests not involving law enforcement or firefighter positions, although veterans would be exempt from the fee increase.  Individuals receiving public assistance would continue to be exempt from the examination processing fee for open competitive testing, and such individuals would also be exempt from the new appeal processing fee, as would veterans.  Therefore, amendments and a new rule are needed to implement the law.  It is recommended that this proposal be approved for publication in the New Jersey Register for public notice and comment.

ACTION:    The Civil Service Commission approved the proposal for publication.

B-93   ADOPTED AMENDMENT: N.J.A.C. 4A:6-1.2, VACATION LEAVE (PAID LEAVE BANK FOR STATE COLLEGES)

Submitted for the Commission's approval is a Notice of Adoption of a proposal to amend N.J.A.C. 4A:6-1.2, Vacation leave. The amendment would codify the Paid Leave Bank provisions of the Memoranda of Agreement between the State and those collective negotiations units representing employees of the State colleges and universities.  No comments were received during the public comment period.  Therefore, it is recommended that this proposal be adopted without change. 

ACTION:    The Civil Service Commission adopted the amendment.

B-95   ERNEST COURSEY, JR.

Ernest Coursey, Jr., a former Program Coordinator, Demolition, with Atlantic City, represented by George L. Farmer, Esq., petitions the Civil Service Commission to determine whether the Commission has jurisdiction to review issues transferred to it by the Superior Court.

ACTION:    The Civil Service Commission granted the request in part.

B-96   LAURIE VAN GENDEREN

Burlington County petitions the Civil Service Commission for a determination of Laurie Van Genderen's entitlement to permanent status. This matter was held over at the January 19, 2011 Civil Service Commission meeting for further review.

ACTION:    The Civil Service Commission granted the request in part.

B-97   JUSTIN SCHLUSSELFELD

The Borough of Milltown, on behalf of Justin Schlusselfeld, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remaineder of his working test period as a Police Officer with Milltown.

ACTION:    The Civil Service Commission granted the request.
 
B-98   SHERIFF'S OFFICER (S9999K), PASSAIC COUNTY SHERIFF'S OFFICE

The Division of State and Local Operations requests that the Passaic County Sheriff's Office be ordered to return the December 7, 2009 certification of the eligible list for Sheriff's Officer (S9999K) for proper disposition.

ACTION:    The Civil Service Commission granted the request.

B-99   ANGELO ANDRIANI

The appeal of Angelo Andriani, a Police Lieutenant with Hoboken, of his removal, on charges, was heard by Administrative Law Judge Margaret M. Monaco, who rendered her initial decision on October 1, 2010.  At its meeting on January 19, 2011, the Civil Service Commission, did not adopt the ALJ's recommendation to modify the removal to a 90-day suspension. Rather, the Commission modified the removal to a six-month suspension.  The proposed decision is now submitted the Commission's review.

ACTION:    The Civil Service Commission adopted the decision.

B-100 CRAIG DURDEN

The appeal of Craig Durden, a Senior Correction Officer with Garden State Youth Correctional Facility, Department of Corrections, of his 30 working day suspension, on charges, was heard by Administrative Law Judge Robert Bingham, II, who rendered his initial decision on October 18, 2010.  At its meeting on January 19, 2011, the Civil Service Commission, did not adopt the ALJ's recommendation to modify the 30 working day suspension to a 10 working day suspension. Rather, the Commission modified the 30-working day suspension to a 20-working day suspension.  The proposed final decision is now submitted the Commission's review.

ACTION:    The Civil Service Commission adopted the final decision.
