    A regular meeting of the Civil Service Commission was held on Tuesday, March 27, 2018, in Trenton, New Jersey.

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on March 22, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

Rebecca French-Mesch appeals the Town of Hammonton’s decision to remove her name from the Water Treatment Plant Operator Apprentice (M0223V), Town of Hammonton, eligible list on the basis of her failure to complete pre-employment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-21  JUNE GAZEK-HARRIS – CSC DOCKET NO. 2018-723

 

          June Gazek-Harris appeals her removal from the eligible list for Environmental Specialist 4 (PS3969G), Department of Environmental Protection for failing to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

          Dirk Gordon appeals his removal from the eligible list for Correction Officer Recruit (S9999R), Juvenile Justice Commission, on the basis of falsification of his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

R.M. appeals the removal of his name from the eligible list for Correction Officer Recruit Juvenile Justice Commission (S9999R) on the basis of an unsatisfactory criminal record.

Tamisha Ocasio appeals the removal of her name from the eligible list for Police Officer (S9999U), Union City, on the basis of falsifying her application.

Tony Tate appeals the Department of Corrections request to remove his name from the eligible list for Correction Officer Recruit (S9988T), on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-27  NAZIA MUGHIS-SOHRAWARDY AND CHANGI WU – CSC DOCKET NOS. 2017-3345 AND 2017-2887

 

Nazia Mughis-Sohrawardy, an Environmental Engineer 3, and Changi Wu, an Environmental Scientist 3, Water Resources, challenge the Division of Agency Services’ determination that Brian Salvo met the requirements for the promotional examination for Environmental Scientist 2, Water Resources (PS3149G), Department of Environmental Protection. Mughis-Sohrawardy also appeals the bypass of her name on the Environmental Scientist 2, Water Resources (PS3149G), Department of Environmental Protection, eligible list.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

The Division of Agency Services seeks enforcement of the Civil Service Commission decision rendered on July 26, 2017, which ordered Newark to immediately dispose of the November 2, 2016 certification of the Chief, Finance and Accounts (M0257U) eligible list pursuant to N.J.A.C. 4A:4-4.2(c)2i.

 

ACTION:     The Civil Service Commission orders the appointing authority to remove the provisional appointee, make an appointment from the certification, and pay a $10,000 fine and $1,000 in compliance costs.

          The Borough of Ringwood requests that the provisions of N.J.A.C. 4A:4-71A(b) be relaxed in order to permit the Intergovernmental Transfer to Alejandro Santiago from the title of State Park Police Officer, Department of Environmental Protection to the title of Police Officer, Ringwood.

Terence Smith, a Principal Investigator, Parole and Secured Facilities, with the Department of Corrections (DOC), represented by Brian M. Cige, Esq., seeks resolution of a dispute concerning counsel fees arising from the decision of the Civil Service Commission (Commission), In the Matter of Christopher Birardi and Terence Smith (CSC, decided August 16, 2017), denying DOC’s request for reconsideration of the deemed adopted final decision of the Commission which reversed the 30 working day suspension of the petitioner.

 

ACTION:     The Civil Service Commission directed that this request be granted in part and orders DOC to pay Terence Smith $37,460 in counsel fees and $600 for costs.

          Tonnesha Kidd, a former Direct Care (CWA) employee with Trenton Psychiatric Hospital, Department of Human Services, petitions the Civil Service Commission for review of her separation from employment.

B-102 JAMAL STOKES – CSC DOCKET NO. 2017-737

 

The Department of Human Services requests reinstatement of the appeal of the removal of Jamal Stokes, an Affirmative Action Officer 2 and referral to the Office of Administrative Law for a hearing.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-103 TELINA HAIRSTON - CSC DOCKET NOS. 2017-4013 AND 2018-739

 

The Superior Court of New Jersey, Appellate Division, has vacated the decision of the Administrative Law Judge, which was deemed adopted as the final decision of the Civil Service Commission (Commission), reversing the 100 calendar day suspension of Telina Hairston, a Police Officer with the City of East Orange, and remanded the matter to the Commission for further proceedings. See In the Matter of Telina Hairston, City of East Orange Police Department, Docket No. A-4850-15T2 (App. Div. September 7, 2017). Additionally, Hairston requests enforcement of the Commission’s decision, In the Matter of Telina Hairston (CSC, decided February 8, 2017), which denied the appointing authority’s stay request and granted her back pay and counsel fees.

 

ACTION:     The Civil Service Commission vacated the February 8, 2017 decision and upheld the suspension.

 

B-104 ALICIA BROWN – CSC DOCKET NOS. 2018-301 AND 2018-303

 

          Alicia Brown, represented by Kevin P. McGovern, Esq., appeals her removal from employment as an Employee Benefits Specialist with the Newark School District, effective July 14, 2017, and her layoff rights.

 

ACTION:     The Civil Service Commission dismissed the removal appeal for lack of jurisdiction and denied the layoff rights appeal.

 

B-105 ALAN BRUNDAGE, ET AL. – CSC DOCKET NOS. 2018-307, ET AL.

 

Alan Brundage, et al., represented by Michael A. Bukosky, Esq., on behalf of the Policemen’s Benevolent Association Local 49, appeal the determinations of their layoff rights by the Division of Agency Services.

          A.E., a Child Care Quality Assurance Inspector 2 with the Department of Children and Families (DCF), appeals the determination of the Director, Office of Administration, DCF, that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-108 M.M. – CSC DOCKET NO. 2018-138

 

M.M., a Clinical Psychologist 2, Division of Mental Health with Ancora Psychiatric Hospital, Department of Human Services, represented by Robert Lytle, Esq., appeals the determination of the Assistant Commissioner, Office of Legal Affairs, Department of Human Services, which found sufficient evidence that she had violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be dismissed for lack of jurisdiction .

 

B-109 L.N. – CSC DOCKET NO. 2018-856

 

          L.N., a Senior Correction Officer with East Jersey State Prison, Department of Corrections, appeals the decision of the Director, Equal Employment Division which did not substantiate her allegations to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-110 R.S. – CSC DOCKET NO. 2017-856

 

R.S., an Assistant Engineer Transportation with the Department of Transportation (DOT), appeals the decision of the Deputy Commissioner, DOT, which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-111 D.W. – CSC DOCKET NO. 2017-2360

 

D.W., a Senior Practical Nurse at Woodbine Developmental Center, appeals the determination of the Assistant Commissioner of Human Resources, Department of Human Services, which found that she had failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission remanded this matter to the appointing authority’s Equal Employment Opportunity/ Affirmative Action Officer.

 

B-112 VINCENT FISCELLA, JR. – CSC DOCKET NO. 2018-1674

 

The Superior Court of New Jersey, Appellant Division has remanded the matter of Vincent Fiscella, Jr.’s penalty and award of counsel fees from the Township of Belleville to the Civil Service Commission.

 

ACTION:     The Civil Service Commission directed that this request be granted in part and awarded counsel fees in the amount of $58,273.75 and costs in the amount of $1,806.90.

 

B-113 SECURITIES MARKET TRADER TRAINEE – CSC DOCKET NO. 2018-1629

 

The Division of Agency Services recommends the reactivation and reallocation of the Securities Market Trader Trainee title.
