A special meeting of the Civil Service Commission was held on Friday, May 22, 2009, in Trenton, New Jersey.
PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, John Currie and Margaret E. L. Howard; Todd Wigder, Deputy Attorney General; Elizabeth Napolitano, Deputy Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on May 19, 2009, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.
B-1 ADOPTION: AMENDMENTS TO N.J.A.C. 4A:8-1.1 AND NEW RULE N.J.A.C. 4A:8-1.1A, TEMPORARY LAYOFFS
Submitted for the Commission's review is a Notice of Adoption regarding the proposed amendments to N.J.A.C. 4A:8-1.1 and proposed new rule N.J.A.C. 4A:8-1.1A.
ACTION: The Civil Service Commission adopted the amendments to N.J.A.C. 4A:8-1.1 and new rule, N.J.A.C. 4A:8-1.1A, with technical changes. Further, in view of the April 17, 2009 Appellate Division opinion concerning the emergency temporary layoff rule, the Commission stayed the provisions of subsections (a) and (d) of N.J.A.C. 4A:8-1.1A that relate to staggered layoffs for a period of 45 days from the date of the filing of the Notice of Adoption in order to permit any interested party to seek review of the rule in the Appellate Division. This stay will expire at the end of the 45-day period.
There being no further business before the Civil Service Commission, the special meeting was adjourned to convene on Wednesday, May 27, 2009, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
