          A regular meeting of the Civil Service Commission was held on Wednesday, June 12, 2019, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 20, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    ALEX NAVAS

 

Alex Navas, Laborer 1, Town of West New York, Department of Public Safety, 30 working day suspension on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty, misuse of public property and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the 30 working day suspension to a 20 working day suspension.

 

ACTION:     The Civil Service Commission rejected the recommendation of the Administrative Law Judge and reversed the 30 working day suspension.

 

A-3    JEANETTE MELENDEZ (Consolidated)

 

Jeanette Melendez, Building Maintenance Worker, Hudson County, Department of Roads and Public Property, 60 working day suspension and removal effective May 19, 2018 on charges of conduct unbecoming a public employee, neglect of duty, insubordination and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 60 working day suspension and removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    GERTRUDE SAMUELS

 

Gertrude Samuels, Cottage Training Technician, Hunterdon Developmental Center, Department of Human Services, removal effective September 9, 2017 on charges of physical or mental abuse of a client, inappropriate physical contact, insubordination, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1    M.B. – CSC DOCKET NO. 2018-3170

 

          M.B. appeals her rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove her name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    D.M. – CSC DOCKET NO. 2018-3419

 

          D.M., represented by Ricardo Gonzalez, Esq., appeals his rejection as a Police Officer candidate by the City of Newark and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that the appellant be referred for an independent psychological evaluation.

 

B-3    K.R. – CSC DOCKET NO. 2018-3079

 

          K.R. appeals her rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove her name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    A.T.B. – CSC DOCKET NO. 2018-3625

 

          A.T.B., represented by Luretha M. Stribling, Esq., appeals the removal of his name from the eligible list for Police Officer (S9999U), City of Newark, on the on the basis of medical unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    SANTIAGO BARRENECHE – CSC DOCKET NO. 2019-1690

 

          Santiago Barreneche appeals the removal of his name from the Correctional Police Officer (S9999U), Department of Corrections, eligible list based on an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-6    NETU JAMES – CSC DOCKET NO. 2019-930

 

          Netu James appeals the removal of his name from the eligible list for Fire Fighter (M1566T), Plainfield on the basis that he did not appear for preemployment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    LEISHA MALDONADO – CSC DOCKET NO. 2019-2001

 

          Leisha Maldonado appeals her removal from the eligible list for Correctional Police Officer (S9988V), Statewide on the basis that she possessed an unsatisfactory criminal background.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    ARIEL MARRERO – CSC DOCKET NO. 2019-1666

 

          Ariel Marrero appeals his removal from the eligible list for Correctional Police Officer (S9988T), Statewide, on the basis of falsification and not completing his preemployment application.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

         

 

B-9    JOHN WHITLEY – CSC DOCKET NO. 2019-1999

 

          John Whitley appeals his removal from the eligible list for Correctional Police Officer (S9988U), Statewide on the basis that he possessed an unsatisfactory criminal background.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10  RAY CURREY, JR. – CSC DOCKET NO. 2019-2520

 

          Ray Currey, Jr., appeals the determination of the Division of Agency Services that he did not meet the education and experience requirements for the promotional examination for Habilitation Plan Coordinator (PS4342K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11  BRUCE GLATTER AND MARIE NYLAND – CSC DOCKET NOS. 2019-2236 AND 2019-2326

 

          Bruce Glatter and Marie Nyland appeal the determinations of the Division of Agency Services, which found that they did not meet the education requirements for the promotional examination for Social Work Specialist (PC2116W), Passaic County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that these appeals be denied and Bruce Glatter be returned to his permanent title.

 

B-12  LORI DESANTIS – CSC DOCKET NOS. 2019-1774, ET AL.

 

          Lori Desantis appeals the bypasses of her name on the Supervising Vocational Rehabilitation Counselor (PS5895N), Department of Labor and Workforce Development eligible list.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

          Hendrik Martinez, represented by Michael L. Prigoff, Esq., appeals his non- appointment from the eligible list for Fire Fighter (M1544T), Jersey City.

          Joseph Bencivenne, Amy Brams, Melanie Callender, Robert Eckert, Jr., Fred Eisner, Angela Fairweather, Helen Feldman, Joycelyn Fierstein, Turhan Floyd, Pamela Foley, Howard Mangel, Teissy Meza, Thomas Plattovinsak, Annamaria Pruscino, Steven Reed, Jane Shapiro, Wayne Tillman, Leslie Williams and Joseph Wieliczko appeal the determinations of the Division of Agency Services that the Medical Consultant, Psychologist title is not entitled to a salary reevaluation and that the positions with the Department of Labor and Workforce Development are properly classified as Medical Consultant, Psychologist. They seek a Medical Consultant job classification.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-15  VRUNDA PATIL-KULKARNI – CSC DOCKET NO. 2019-1419

 

          Vrunda Patil-Kulkarni, represented by Dudley Burdge, Senior Staff Representative CWA Local 1032, appeals the decision of the Division of Agency Services that the proper classification of her position with the Department of Transportation is Software Development Specialist 1.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-16  ADMINISTRATIVE CLERK, BILINGUAL IN SPANISH AND ENGLISH – CSC DOCKET NO. 2019-2198

 

          Bergen County requests permission not to make an appointment from the certification for Administrative Clerk, Bilingual in Spanish and English (C0225T), Bergen County.

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-17  COMPUTER SERVICE TECHNICIAN – CSC DOCKET NO. 2019-3149

 

          The Union Township Library requests permission not to make an appointment from the March 18, 2019 certification for Computer Service Technician (M0814W).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

          Morgan Carlson appeals the determination of the Division of Agency Services which found that she did not meet the minimum requirements in experience for the open-competitive examination for Clerk Typist 1, Evidence Handling (S0818W), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-20  CASEY CONFOY – CSC DOCKET NO. 2019-2784

 

          Casey Confoy appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirement for the promotional examination for Senior Management Assistant (PS8230J), Thomas Edison State University and State Library.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-21  JENNEAN JORDAN-GADSDEN – CSC DOCKET NO. 2019-2127

 

          Jennean Jordan-Gadsden appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Assistant Municipal Tax Collector (PM1496W), Paterson.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

          Richard Booth appeals the determination of the Division of Agency Services that he did not pass the qualifying examination for Veterans Service Officer, Hunterdon County.

          Daniel Pasquinucci appeals his score on the oral portion of the promotional examination for Police Captain (PM1799W), Freehold.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-26  EVAN MAGEE – CSC DOCKET NO. 2019-2897

 

          Evan Magee requests that additional volunteer points be added to his final average for the eligible list for Fire Fighter (M1864W), Pennsauken, produced from the examination for Fire Fighter (M9999W).

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-27  MADHARSHI DELA-CRUZ AND RICHARD F. KEELEY – CSC DOCKET NOS. 2019-2744 AND 2019-2743

 

          Bergenfield requests that Madharshi Dela-Cruz be provided with a retroactive date of permanent appointment to the title of Deputy Registrar of Vital Statistics. It also requests that Richard F. Keeley be provided with retroactive dates of permanent appointment to the titles of Elevator Subcode Official and Elevator Inspector.

 

ACTION:     The Civil Service Commission directed that these requests be granted in part.

 

B-28  BENJAMIN NIEWINSKI – CSC DOCKET NO. 2018-3688

 

          Benjamin Niewinski requests a retroactive date of permanent appointment to the title of Police Lieutenant, effective January 16, 2017.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-29  KYLE BELLE – CSC DOCKET NO. 2019-2963

 

          Kyle Belle, a Police Officer Recruit, Human Services with the Department of Human Services, represented by Shelia D. Ellington, Esq., petitions the Civil Service Commission for reconsideration of the decision, rendered on March 14, 2019, in which the Director of the Division of Appeals and Regulatory Affairs denied his request for a hearing with respect to his removal.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-30  TERRY BUCHANAN – CSC DOCKET NO. 2019-2868

 

          Terry Buchanan, a Code Enforcement Officer Trainee with the City of Newark, Department of Engineering, represented by Seth Gollin, Staff Representative, AFSCME, petitions the Civil Service Commission for reconsideration of the decision rendered on March 6, 2019, in which the Director of the Division of Appeals and Regulatory Affairs denied his request for a hearing with respect to his removal.

 

ACTION:     The Civil Service Commission directed that this petition be granted.

 

B-31  A.J-S. – CSC DOCKET NO. 2019-1751

 

          A.J-S., a Community Service Officer 3, Addictions with the Department of Health, appeals the decision of the Chief of Staff, which did not substantiate her allegations to support a finding that she had been subject to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-32  M.F. – CSC DOCKET NO. 2018-571

 

          M.F., represented by Peter B. Paris, Esq., appeals her rejection as a Police Officer candidate by the Roselle Police Department and its request to remove her name from the eligible list for Police Officer (S9999U), Roselle on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-33  M.D.N. – CSC DOCKET NO. 2017-2365

 

          M.D.N. appeals his rejection as a County Correction Officer candidate by Hudson County, and its request to remove his name from the eligible list for County Correction Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-34  E.R. – CSC DOCKET 2017-3402

 

          E.R., represented by Bette R. Grayson, Esq., appeals the removal of his name from the eligible list for Fire Fighter (M2554M), City of Newark, on the basis of psychological unfitness to perform effectively the dues of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be dismissed.

 

B-35  GREG CAVANAGH – CSC DOCKET NO. 2019-3334

 

          Greg Cavanagh appeals the determination of the Division of Agency Services that the proper classification of his position with the Department of Health is Senior Stock Clerk. The appellant seeks a Supply Support Technician 2 job classification.

          William Able, a Senior Custodian with Newark School District, represented by Lesley Sotolongo, Esq., seeks enforcement of the Civil Service Commission decision rendered on April 4, 2018, granting him mitigated back pay, benefits and seniority.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-40  MATTHEW J. CURTIS – CSC DOCKET NO. 2019-1147

 

          Matthew J. Curtis, a former unclassified Administrative Analyst 4 with the Office of the State Comptroller, appeals the determination of the Department of the Treasury, which found that he was ineligible for differential back pay for the period between July 1, 2015 and April 4, 2018.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-41  A.E. – CSC DOCKET NO. 2018-3662

 

          A.E. appeals her rejection as a Police Officer candidate by the Newark Police Department and its request to remove her name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

          Christopher Naddeo appeals the determination of the Division of Agency Services that the proper classification of his position with Camden County is Registered Environmental Health Specialist, Public Health. The appellant seeks a Senior Registered Environmental Health Specialist, Public Health job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-50  PARALEGAL SPECIALIST (M0781V), JERSEY CITY REDEVELOPMENT AGENCY – CSC DOCKET NO. 2019-1174

 

          The Jersey City Redevelopment Agency requests permission not to make an appointment from the March 19, 2018 certification for Paralegal Specialist (M0781V).

 

ACTION:     The Civil Service Commission directed that this request be held in abeyance.

 

B-51  LAWRENCE MARINARI, ET AL. – CSC DOCKET NOS. 2019-3216, ET AL.

 

          Dudley Burdge, Senior Staff Representative with Communications Workers of America Local 1032, requests the retroactive permanent appointments of Lawrence Marinari, Sandra Stevens, Melvin Arroyo, Joseph Diefenbach, Mike Coles, Norman Grieg and Bob Neary.

 

ACTION:     The Civil Service Commission directed that these requests be granted in part.

          Ann Klein Forensic Center requests that Bronda Bessant be assigned a retroactive appointment date to the title of Medical Security Officer Recruit.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-53  KELLY NAPOLITANO – CSC DOCKET NO. 2019-3430

          The Communications Workers of America, AFL-CIO, (CWA), represented by Steven P. Weissman, Esq., requests that, pursuant to N.J.S.A. 11A:3-7, the Civil Service Commission approve a waiver of repayment of salary overpayments for employees covered under a Grievance Settlement between the State and the CWA and that it relax N.J.A.C. 4A:3-4.9 in order to permit these employees to receive a step advancement retroactive to May 1, 2019, while retaining their anniversary dates in accordance with the terms of that Grievance Settlement.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

          K.R., a Senior Parole Officer with the New Jersey State Parole Board (SPB), appeals the determination of the Chairman, SPB, that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.
