    A regular meeting of the Civil Service Commission was held on Wednesday, October 17, 2018 at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2017, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    MARILYN CAMP

 

Marilyn Camp, Employment Specialist, Atlantic County, Department of Administrator, removal effective August 2, 2017 on charges of other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    GERRELL ELLIOTT

 

Gerrell Elliott, Battalion Fire Chief, City of Newark, Department of Public Safety, nine working day suspension on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the nine working day suspension to a five working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    ROBERT MAPES

 

Robert Mapes, County Correction Sergeant, Morris County Sheriff’s Office, 30 working day suspension on charges of other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 30 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5    NEEHAM ROGHANCHI

 

Neeham Roghanchi, Laborer 1, Township of Union, Department of Public Works, initial release at the end of the working test period effective September 5, 2017.

 

Recommendation of the Administrative Law Judge – Uphold the release at the end of the working test period.

 

ACTION:     The Civil Service Commission dismissed the appeal as moot.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    K.M.D. – CSC DOCKET NO. 2016-3102

 

          K.M.D., represented by Michael L. Prigoff, Esq., appeals his rejection as a Police Officer candidate by the Township of Verona and its request to remove his name from the eligible list for Police Officer (S9999R), Verona on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    T.C.B. – CSC DOCKET NO. 2018-196

 

          T.C.B. appeals his rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9988U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    C.V.D. – CSC DOCKET NO. 2018-280

 

          C.V.D., represented by Michael L. Prigoff, Esq., appeals his rejection as a Police Officer candidate by the Waldwick Borough Police Department and its request to remove his name from the eligible list for Police Officer (S9999R), Waldwick Borough on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-4    C.T. – CSC DOCKET NO. 2018-510

 

          C.T. appeals her rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove her name from the eligible list for Correctional Police Officer (S9988U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    N.Z. – CSC DOCKET NO. 2018-411

 

          N.Z., represented by Donald Barbati, Esq., appeals his rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9988U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    RACHEL JAMISON – CSC DOCKET NO. 2018-3175

 

          Rachel Jamison appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Supervising Community Program Specialist (PS3797K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    AYOUBA KOSIAH – CSC DOCKET NO. 2019-505

 

          Ayouba Kosiah appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Senior Therapy Program Assistant (PS3882K), Hunterdon Developmental Center.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    BREE PILE – CSC DOCKET NO. 2018-3487

 

          Bree Pile appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Senior Fiscal Analyst (PS5859H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-9    CASONDRA SALES AND NICOLE WALKER – CSC DOCKET NOS. 2018-3706 AND 2018-3685

 

          Casondra Sales and Nicole Walker appeal the determinations of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Claims Adjudicator Support Specialist 2 (PS6593N), Department of Labor and Workforce Development.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-10  FRANCOIS LARMONY – CSC DOCKET NO. 2018-3386

 

          Francois Larmony requests that he be permitted to amend his residency on his application after closing date for the open-competitive examination for Fire Fighter (M1540T), Irvington.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-11  VAN JENKINS – CSC DOCKET NO. 2019-201

 

          Van Jenkins, a Mechanic with the City of Camden, represented by James Katz, Esq., requests back pay and counsel fees in accordance with the Civil Service Commission decision rendered on May 2, 2018.

 

ACTION:     The Civil Service Commission awarded back pay in the amount of $23,905.57, counsel fees in the amount of $17,160, and costs in the amount of $2,570.92.

          Submitted for adoption are the Civil Service Commission minutes of its meeting of October 3, 2018.

B-13  ASHLEY LAUDERDALE – CSC DOCKET NO. 2018-3461

 

          Ashley Lauderdale appeals her removal from the eligible list for Police Officer (S9999U), Newark, on the basis of falsification of her pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14  MATTHEW MCMONAGLE – CSC DOCKET NO. 2019-627

 

          Matthew McMonagle appeals the removal of his name from the Fire Fighter (M1537T), Harrison eligible list due to his failure to appear for the physical performance test.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15  MONIQUE GARRETT, HEATHER MACAULEY AND JOANAL VENDERVORT – CSC DOCKET NOS. 2019-747, ET AL.

 

          Monique Garrett, Heather Macauley and Joanal Vendervort appeal the determinations of the Division of Agency Services that the proper classification of their positions with the Department of Health is Agency Services Representative 2. The appellant seeks a Technical Assistant 1 job classification.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-16  JOHN CONTE – CSC DOCKET NO, 2019-521

 

          John Conte appeals the determination of the Division of Agency Services, which found him ineligible for the promotional examination for Senior Bridge Repairer (PC0806W), Monmouth County on the basis of an incomplete application.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-17  PATRICK LITTLEFORD AND MICHAEL NORTON, JR. – CSC DOCKET NOS. 2019-523 AND 2019-498

 

          Patrick Littleford and Michael Norton, Jr. appeal the determinations of the Division of Agency Services which found that they did not meet the minimum requirements in experience for the promotional examination for Building Services Coordinator 1 (PS3958K), Department of Children and Families.

 

ACTION:     The Civil Service Commission directed that these appeals be denied and Littleford’s position undergo a classification review.

 

B-18  DONNA WISNESKI – CSC DOCKET NO. 2018-3353

 

          Donna Wisneski appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Head Cook 3 (PS6458EN), Department of Military and Veterans Affairs.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-19  J.J. – CSC DOCKET NO. 2018-56

 

          J.J., represented by John D. Feeley, Esq., appeals his rejection as a Sheriff’s Officer candidate by the Bergen County Sheriff’s Department and its request to remove his name from the eligible list for Sheriff’s Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-20  M.T. – CSC DOCKET NO. 2018-1305

 

          M.T. appeals her rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove her name from the eligible list for Correctional Police Officer (S9987M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-21  LIVIER SIERRA – CSC DOCKET NO. 2019-950

 

          Livier Sierra appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Keyboarding Clerk 2, Bilingual in Spanish and English (M0091W), Morristown.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-22  ENZO GENCARELLI – CSC DOCKET NO. 2019-644

 

          Enzo Gencarelli appeals the multiple choice portion of the promotional examination for Sheriff’s Officer Captain (PC2630V), Passaic County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23  DAVID DAILEY – CSC DOCKET NO. 2019-714

 

          The Civil Service Commission, on its own motion, reconsiders In the Matter of David Dailey, Police Captain (PM0655V), Monroe Township (CSC, decided September 5, 2018).

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-24  JOHN TOMASONE – CSC DOCKET NO. 2018-3416

 

          John Tomasone requests reconsideration of the decision rendered on April 18, 2018, which found that his position with the Department of Community Affairs should be classified as a Sub-Code Official.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-25  ROBERT PIENCIAK – CSC DOCKET NO. 2018-1935

 

          Robert Pienciak, represented by Michael L. Prigoff, Esq., appeals his removal from the eligible list for Fire Captain (PM1122S), Hillside on the basis that he possessed an unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.
