          A regular meeting of the Civil Service Commission was held on Tuesday, November 19, 2019, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamula Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 20, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

A-2    ERIC BEAGIN

 

Eric Beagin, Fire Fighter, City of Paterson, Fire Department, removal effective September 18, 2015, on charges of conduct unbecoming a public employee and other sufficient cause.

Recommendation of the Administrative Law JudgeReverse the removal.

 

ACTION:    The Civil Service Commission directed that this matter be held over.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    INSTITUTIONAL ATTENDANT, BILINGUAL IN SPANISH AND ENGLISH – CSC DOCKET NO. 2020-1306

 

          The Division of Agency Services requests the creation of the non-competitive title of Institutional Attendant, Bilingual in Spanish and English.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-2    S.D. – CSC DOCKET NO. 2019-457

 

          S.D., represented by Bette R. Grayson, Esq., appeals his rejection as a County Correction Officer candidate by Essex County and its request to remove his name from the eligible list for County Correction Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    PRISCILLA GUZMAN – CSC DOCKET NO. 2020-482

 

          Priscilla Guzman appeals her removal from the eligible list for Correctional Police Officer (S9999U), Department of Corrections based on an unsatisfactory criminal record and falsification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    VERNON LINCOLN – CSC DOCKET NO. 2020-475

 

          Vernon Lincoln appeals his removal from the eligibility list for Correctional Police Officer (S9999U), Department of Corrections, on the basis of an unsatisfactory background report and falsification of his employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    JENNIFER MARTINEZ – CSC DOCKET NO. 2020-612

 

          Jennifer Martinez appeals her removal from the eligible list for Correctional Police Officer (S9988A), Department of Corrections based on an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    BRENDAN QUIGLEY – CSC DOCKET NO. 2019-2595

 

          Brendan Quigley appeals the removal of his name from the Correctional Police Officer (S9988U), Department of Corrections eligible list on the basis of an unsatisfactory driving record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    D.W. – CSC DOCKET NO. 2019-3594

 

          D.W. appeals the removal of her name from the eligible list for Correctional Police Officer, JJC (S9999U), Juvenile Justice Commission, on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    D.W. – CSC DOCKET NO. 2020-239

 

          D.W. appeals the removal of her name from the eligible list for Police Officer (S9999U), Linden, on the basis that she resided outside of the residency scope.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-9    ENVIRONMENTAL SPECIALIST 4 (PS3581G) – CSC DOCKET NO. 2020-562

 

          The Department of Environmental Protection requests that the Environmental Specialist 4 (PS3581G) eligible list be revived to allow it to make a regular appointment.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-10  PATRICIA CIRILLO – CSC DOCKET NO. 2020-1152

 

          Patricia Cirillo appeals the determination of the Division of Agency Services that the proper classification of her position with the Department of the Treasury is Secretarial Assistant 2, Non-Stenographic. The appellant seeks an Administrative Assistant 3 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11  DAVID LOSS – CSC DOCKET NO. 2020-1276

 

          David Loss appeals the determination of the Division of Agency Services that the proper classification of his position with the Department of the Treasury is Pensions Benefits Specialist 1. The appellant seeks a Pensions Benefits Specialist 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12  HANY SAWIRES – CSC DOCKET NO. 2019-3507

 

          Hany Sawires appeals the decision of the Division of Agency Services that the proper classification of his position with Hudson County is Truck Driver. The appellant seeks a Maintenance Worker, Grounds job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13  EDWARD KELLY – CSC DOCKET NO. 2020-912

 

          Edward Kelly appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Assistant Maintenance Superintendent (PC0437A), Burlington County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-14  WILLIAM WEIDELE – CSC DOCKET NO. 2020-975

 

          William Weidele appeals his score on the examination for Deputy Fire Chief (PM3055W), Newark.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15  JOSHUA CARTER – CSC DOCKET NO. 2020-976

 

          Joshua Carter appeals his score on the examination for Deputy Fire Chief (PM0331A), North Wildwood.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-16  LOUIS BAINBRIDGE – CSC DOCKET NO. 2020-996

 

          Louis Bainbridge appeals his score on the examination for Deputy Fire Chief (PM0121A), Trenton.

          Henry Sisbarro appeals his score on the examination for Deputy Fire Chief (PM3059W), Union Township.

          William Jeans appeals his score for the physical performance portion of the examination for Fire Fighter (M1856W), Millburn.

B-19  DAVID CHASMER AND MICHAEL KISFALVI – CSC DOCKET NOS. 2019-2921 AND 2019-2922

 

          David Chasmer (PM2036W), Union City and Michael Kisfalvi (PM2019W), Passaic request reconsideration of the final administrative determination in In the Matter of Mark Moskal, et al., Police Lieutenant (CSC, decided February 20, 2019.

 

ACTION:     The Civil Service Commission directed that these requests be denied.

 

B-20  M.S. – CSC DOCKET NO. 2018-3749

 

          M.S., a Management Improvement Specialist 1 with the Department of Transportation, appeals the determination of the Executive Director, Division of Civil Rights and Affirmative Action, which found that the appellant failed to support a finding that he had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-21  C.T. – CSC DOCKET NO. 2020-460

 

          C.T., an Administrative Analyst 1 with the Division of Aging Services, appeals the decision of the Department of Human Services’ Chief of Staff which did not substantiate her allegations to support a finding that she had been subject to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-22  JASON RODRIGUEZ – CSC DOCKET NO. 2020-811

 

          Jason Rodriguez, represented by Ben Weather, Esq., appeals the removal of his name from the Fire Fighter (M1863W), Paterson eligible list due to his failure to appear for the Physical Performance Test.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23  D.S. – CSC DOCKET NO. 2019-1507

 

          D.S. appeals the removal of her name from the Correctional Police Officer (S9988T), Department of Corrections eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-24  WILLIAM CANIZZARO – CSC DOCKET NO. 2020-1281

 

          William Canizzaro requests to file a late application for the promotional examination for Assistant Supervisor, Public Works (PM1211A), Ocean City.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-25  G.G.B. – CSC DOCKET NO. 2018-2530

 

          G.G.B., represented by Stephen B. Hunter, Esq., appeals his rejection as a Sheriff’s Officer candidate by Middlesex County and its request to remove his name from the eligible list for Sheriff’s Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-26  S.S. – CSC DOCKET NO. 2018-3624

 

          S.S. appeals her rejection as a Police Officer candidate by the Newark Police Department and its request to remove her name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-27  N.B. – CSC DOCKET NO. 2019-312

 

          N.B., represented by Robert K. Chewning, Esq., appeals his rejection as a Police Officer candidate by the Borough of Fort Lee and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-28  O.X.R. – CSC DOCKET NO. 2019-1208

 

          O.X.R., represented by Dominic Iannarella, Esq., appeals his rejection as a Fire Fighter candidate by the City of Newark and its request to remove his name from the eligible list for Fire Fighter (M1556T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-29  A.D.V. – CSC DOCKET NO. 2019-455

 

          A.D.V., represented by Robert K. Chewning, Esq., appeals his rejection as a Fire Fighter candidate by Harrison and its request to remove his name from the eligible list for Fire Fighter (M1537T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-30  TERESA BAKER – CSC DOCKET NO. 2020-686

 

          Teresa Baker appeals Mercer County’s request to remove her name from the eligible list for Senior Library Assistant (PC0090U), on the basis that she failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-31  J.C. – CSC DOCKET NO. 2019-2027

 

          J.C. appeals the removal of his name from the Sheriff’s Officer (S9999U), Hudson County eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-32  ERIC JACKSON – CSC DOCKET NO. 2019-3328

 

          Eric Jackson appeals the appointing authority’s request to remove his name from the eligible list for Correctional Police Officer (S9988V), Department of Corrections, on the basis of unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-33  D.R. – CSC DOCKET NO. 2020-1010

 

          D.R., a former Forensic Scientist 3, Division of State Police, Department of Law and Public Safety, requests a waiver of repayment of a salary overpayment, pursuant to N.J.S.A. 11A:3-7, which provides that when an employee has erroneously received a salary overpayment, the Civil Service Commission may waive repayment based on a review of the case.

 

ACTION:     The Civil Service Commission directed that this request be granted.

         

B-34  T.W. – CSC DOCKET NO. 2019-2611

 

          T.W., a former Clinical Psychiatrist with the Department of Health (DOH), appeals the determination of the Chief of Staff, DOH, which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.
