The Emission Statement rule, N.J.A.C. 7:27-21, establishes regulations for the annual reporting of air contaminant emissions from stationary sources. The air contaminants reported in the emission statements include Carbon Monoxide (CO), Sulfur Dioxide (SO2), Ammonia (NH3), Particulate Matter (TSP, PM10, PM2.5), Lead (Pb), Volatile Organic Compounds (VOC), Oxides of Nitrogen (NOx), Carbon Dioxide (CO2), Methane (CH4) and 36 toxic air pollutants. Emission statements provide an estimate of the actual emissions to assist in the monitoring of the State’s progress toward the emissions reduction goals and attainment of the National Ambient Air Quality Standards.
The Department requires an emission statement from any facility whose actual emissions or facility wide potential to emit meet or exceed any of the following thresholds (N.J.A.C. 7:27-21.2):
5 tons per year of Pb
10 tons per year of VOC
25 tons per year of NOx
100 tons per year of any of the following – CO, NH3, PM2.5, PM10, SO2, or TSP
Program Update for the COVID-19 Pandemic
In response to the COVID-19 national emergency, the New Jersey Department of Environmental Protection is extending the due date for the 2019 Annual Air Emission Statements to June 15, 2020. This extension does not require a formal request as described in N.J.A.C. 7:27-21.9.
Emission Statement submittals on paper, due to confidentiality claims or on hardship grounds consistent with N.J.A.C. 7:21.4(d), are due annually by April 15.
Emission Statements submitted electronically are due annually by May 15.
RADIUS Information for Emission Statements
RADUIS Software: The latest version of RADIUS is required for preparing and submitting emission statements. RADIUS software and other related information is available on the Department’s RADIUS webpage. Submitting Emission Statements in RADIUS: The “Submit” function in RADIUS does not automatically send the emission statement to the Department. The "Submit" function only initiates the Administrative Check and creates an export file. For details on submitting emission statements, check User Guide for RADIUS Submittals.
Electronic Submittal through NJDEP Online Portal: In order to remain compliant with EPA’s Federal Regulation Cross-Media Electronic Reporting Regulation (CROMMER), emission statements cannot be submitted via e-mail. All electronic submittals must be sent through the NJDEP Online Portal, www.njdeponline.com. Alternatively, emission statements can be mailed to the Department on a CD along with a signed paper certification (Certification Form).
Transferring Emission Statement to another Computer: To transfer an emission statement file to another computer, be sure to use only the “Export” function in RADIUS. The user will not be able to import an emission statement saved outside of RADIUS 5.0 that used the ‘Submit’ function.
