NOTICE OF READOPTION WITH AMENDMENTS
Financial Assistance Programs for Environmental Infrastructure Facilities, N.J.A.C. 7:22

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection and the NJ Environmental Infrastructure Trust are proposing to readopt N.J.A.C. 7:22 without change. The Financial Assistance Programs for Environmental Infrastructure Facilities rules were scheduled to expire on December 8, 2010. The filing of this proposal with the Office of Administrative Law before that date automatically extended the expiration date 180 days, until June 5, 2011, in accordance with the Administrative Procedure Act. (See N.J.S.A. 52:14B-5.1c.)  The Department and the Trust have reviewed these rules and have determined them to be necessary, reasonable and proper for the purpose for which they were originally promulgated.  Therefore, the Department and the Trust propose to readopt this chapter without change.

N.J.A.C. 7:22 contains the rules of the Department and the Trust governing the financial assistance application and award procedures, as well as other related requirements, for project sponsors to qualify for State monies to finance environmental infrastructure projects, including wastewater treatment, water supply and stormwater/nonpoint source management facilities. The Financing Program, administered under these rules, has provided over $5.4 billion worth of financial assistance over the past 24 years.
