IN THE MATTER OF THE FILING OF )
CERTAIN MEDICAL MALPRACTICE )
INSURANCE INFORMATION ) ORDER
PURSUANT TO P.L. 2002, c. 55 )

This matter having been opened by the Commissioner of the Department of Banking and Insurance pursuant to the authority granted by P.L. 2002, c. 55, N.J.S.A. 17:1-15, 17:29AA-1 et seq., and 17:30D-1 et seq., and all powers expressed or implied therein; and

IT APPEARING that on August 23, 2002 the Commissioner issued Order No. A02-129 requiring all insurers licensed to provide medical malpractice liability insurance to submit certain information pertaining to policies for such insurance to the Department by November 1, 2002; and

IT FURTHER APPEARING that, after reviewing the information submitted subsequent to the issuance of Order No. A02-129 it has become evident that it is necessary to examine additional information concerning the medical malpractice liability insurance policies reported upon by the said insurers pursuant to that Order; now THEREFORE, it is on this 4th day of December, 2002, ORDERED that:

1. All insurers licensed to provide medical malpractice liability insurance pursuant to Title 12 of the Revised Statutes, shall submit the information specified on the attachment hereto (Schedule A, Columns 1 through 17) for each physician, podiatrist and nurse on whose policy the insurer has previously submitted information to the Department in accordance with the terms of Order No. A02-129; and

2. With respect to policies issued to insureds engaged in the practice of obstetrics or gynecology, the said information shall be supplied by on or before December 11, 2002; and

3. With respect to policies issued to insureds engaged in specialties or practice areas other than obstetrics or gynecology, the said information shall be supplied by on or before January 07, 2003; and

4. The above information shall be submitted as an Excel spreadsheet by either e-mail, CD-rom, or floppy diskette no later than the respective dates indicated above to the following address:

5. The spreadsheet form of Schedule A may be accessed at the Department’s website; and

6. Failure of any insurer to comply with this Order may result in the imposition of any and all penalties permitted by law.
