State Board of Examiners Legal Decisions

Decisions of the State Board of Examiners issued prior to 1992 are available by writing to Director, Office of Licensure and Credentials, New Jersey State Department of Education, 100 River View, P.O. Box 500, Trenton, NJ 08625-500.

Decisions issued from 1992 through July 10, 1997 are published in the New Jersey Administrative Reports (N.J.A.R.1).

In some cases, a State Board of Examiners' decision represents the adoption, rejection, or modification of an initial decision of the Office of Administrative Law (OAL). In such cases, the OAL decision will not precede the State Board of Examiners' decision. Readers wishing to access the OAL decision separately are referred to the Rutgers University Law School - Administrative Law Decisions page, where OAL decisions are posted; a link to this site is provided in the navigation bar on the left of each page.

Please note that, prior to enactment of P.L. 2008, c. 36 on July 7, 2008, State Board of Examiners decisions regarding revocation or suspension of certificate were appealable to the State Board of Education, while other types of Board of Examiners decisions were generally appealable to the Commissioner. Subsequent to July 7, 2008, all decisions are appealable to the Commissioner.  Therefore, before relying on any decision included in this site as legal precedent, regardless of date, its appeal status should be checked.
