A regular meeting of the Merit System Board was held on Wednesday, February 27, 2002, in Trenton, New Jersey.

PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Alan Dexter Bowman, Josephine DiRienzo, Margaret E. L. Howard, and Leo R. Vartan; Barbara Bereski, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on February 13, 2002, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

It is noted that agenda item A-6 was considered at the conclusion of the Hearing Matters. After item A-19, the open session was recessed and, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of legal advice on the matter of A-6 German Naranjo. The Board subsequently reconvened the Public Meeting in order to render a decision in this matter.

All actions were by unanimous vote unless otherwise specified.

CONFIDENTIAL APPOINTMENTS
The Merit System Board recorded the following Confidential Appointments under N.J.S.A. 11A:3-4(h):

Beverly Koblentz appointed as a Confidential Secretary, Department of Law and Public Safety, effective January 26, 2002, salary of $50,000.00 per annum.

Margery M. DellaVecchia appointed as a Confidential Secretary, Department of Community Affairs, effective January 22, 2002, salary of $95,000.00 per annum.

Vincent Bucci, Wesley Rosamilia, and Andre E. Davis, County of Essex, Department of Parks, Recreation and Cultural Affairs, good faith appeals of a layoff or demotion in lieu of layoff effective December 31, 1999 for reasons of economy and efficiency.

Recommendation of the Administrative Law Judge - Dismiss the appeals with prejudice.

ACTION: The Merit System Board affirmed the recommendation of the
Administrative Law Judge.

A-3 MERCER COUNTY DEPARTMENT OF PUBLIC SAFETY LAYOFFS
Various employees of the Mercer County Department of Public Safety appeal the good faith of their layoff or demotion in lieu of layoff, effective September 11, 1998 for reasons of economy and efficiency.

Recommendation of the Administrative Law Judge - Uphold the layoffs.

ACTION: The Merit System Board affirmed the recommendation of the
Administrative Law Judge.

A-4 ELENA MCALLISTER, JANET COOK FLANNAGAN AND BARBARA CATLETT

Elena McAllister and Barbara Catlett, Head Nurses, at Southern State Correctional Facility, Department of Corrections, resignations not in good standing effective October 15, 1994 and October 20, 1994 respectively, on the charge of being absent from duty for five or more consecutive business days without approval. Additionally both appellants also appeal denial of sick leave injury benefits. Janet Cook Flannagan, Pharmacy Assistant, Southern State Correctional Facility, Department of Corrections, resignation not in good standing effective October 17, 1994, on the charge of being absent from duty for five or more consecutive business days without approval.

Recommendation of the Administrative Law Judge - Uphold the resignations not in good standing and uphold the denial of sick leave injury benefits.

ACTION: The Merit System Board directed that this matter be held over.

A-5 ROBERT GREEN
Robert Green, Investigator I, Administrative Office of the Courts, Mercer Vicinage, Judiciary, six-day suspension on the charge of continuous disregard to follow office policy.

Recommendation of the Administrative Law Judge - Reverse the six-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the
Administrative Law Judge.

A-6 GERMAN NARANJO
German Naranjo appeals the removal of his name from the eligible list for Correction Officer Recruit (S9999V), Department of Corrections on the basis of an unsatisfactory employment history which adversely relates to the position sought.

Recommendation of the Administrative Law Judge - Uphold the removal from the eligible list.

ACTION: The Merit System Board reversed the recommendation of the
Administrative Law Judge and ordered the appellant's name to be
restored to the eligible list for Correction Officer Recruit (S9999V).

A-7 SUZANNE G. POLKE
Suzanne G. Polke, Head Nurse, County of Monmouth, Department of Health Care Facilities, ten-day suspension on charges of failure or neglect to perform official duty, insubordination, and deficient or inefficient work performance reflecting discredit upon the employee, department or the County of Monmouth.

Recommendation of the Administrative Law Judge - Uphold the ten-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the
Administrative Law Judge.

A-8 LEIGH SHAW
Leigh Shaw, Principal Engineer Electrical, Division of Human Resources, Department of Transportation, three-month suspension on the charge of sexual harassment.

Recommendation of the Administrative Law Judge - Modify the three-month suspension to a six-month suspension and referral to the State Employee Advisory Service.

ACTION: The Merit System Board affirmed the recommendation of the
Administrative Law Judge.

A-9 BABATUNDE AIYENIGBA (CONSOLIDATION)
Babatunde Aiyenigba, Senior Medical Security Officer, Forensic Psychiatric Hospital, Department of Human Services, (1) removal effective January 16, 2001, on the charge of sleeping while on duty; and (2) removal effective April 11, 2001, on the charges of insubordination.

Recommendation of the Administrative Law Judge - Dismissed for failure to appear.

Anthony Dillard, Senior Correction Officer, South Woods State Prison, Department of Corrections, removal effective May 24, 1999, on charges of other sufficient cause regarding personal conduct, and falsification: Intentional misstatement of material fact in connection with work, employment, application, attendance, or in any record, report, investigation or other proceeding.

A-18 CALVIN PARKMAN
Calvin Parkman, Police Officer, City of Newark, Police Department, 30-day suspension on charges of neglect of duty, care of property, negligent loss or damage of city issued equipment, and making a false statement. This matter was held over from the Merit System Board meeting of January 29, 2002.

Recommendation of the Administrative Law Judge - Modify the 30-day suspension to a 15-day suspension.

ACTION: The Merit System Board modified the recommendation of the
Administrative Law Judge and reversed the 30-day suspension.

Larry Kennie appeals the decision of the appointing authority to remove his name from the eligible list for Police Officer (S9999A), Township of Gloucester, on the basis of his failure to meet the residency requirement.

ACTION: The Merit System Board granted a hearing.

B-12 THOMAS C. LUCKEY
The Department of Community Affairs (DCA) appeals the decision of Human Resource Information Services (HRIS) which found that it had not presented a sufficient basis to remove Thomas C. Luckey's name from the eligible list for Inspector, Fire Safety (S2000A) on the basis of an unsatisfactory employment record. Additionally, DCA's request for the removal of the appellant's name from the eligible list for Safety Inspector (S0552B), on the basis of his falsification of his preemployment application, has been referred to the Merit System Board for review.

ACTION: The Merit Board directed that the appellant's name be restored to the
eligible list for Inspector, Fire Safety (S2000A) and the February 16,
2000 certification be returned for proper disposition; and appellant's
name be removed from the eligible list for Safety Inspector (S0552B).

B-13 BEVERLY D. CONNELLY FIGUEROA
Beverly D. Connelly Figueroa, a Sheriff's Officer with the County of Union, represented by Carl Figueroa, Esq., petitions the Merit System Board (Board) for interim relief regarding her enrollment with the John H. Stamler Police Academy, Union County, and requests enforcement of a Board decision rendered on September 12, 2000.

ACTION: The Merit System Board directed that the request for interim relief
be dismissed as moot and request for enforcement be denied.

B-14 EVELYN MAGYAR
Evelyn Magyar, a Legal Secretary 1 with the Department of Law and Public Safety, appeals the determination of the Attorney General, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-15 JANELLE SPEARMAN
Janelle Spearman, a Senior Correction Officer at East Jersey State Prison (EJSP), Department of Corrections (DOC), appeals the determination of the Director, Equal Employment Division (EED) with the DOC, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-16 NICHOLAS MELFI
The Department of Corrections petitions the Merit System Board to reconsider its final decision granting the appellant's appeal of his minor discipline charge.

ACTION: The Merit System Board directed that this matter be held over.

B-17 SCOTT SISTA
Scott Sista, represented by Gregory A. Busch, Esq., petitions the Merit System Board for reconsideration of its decision rendered June 12, 2001, upholding the removal of his name from the eligible list for Police Officer (M33382Z), City of Jersey City, due to unsatisfactory driving and employment records.

ACTION: The Merit System Board denied the request for reconsideration.

B-18 WILLIAM C. WHITE, SR.
William C. White, Sr., formerly a Senior Correction Officer with the Garden State Reception and Youth Correctional Facility, Department of Corrections, represented by Michael K. Sharp, Executive Vice President, P.B.A. Local 105, petitions the Merit System Board (Board) for reconsideration of the Board's decision rendered on May 22, 2001, in which the Board upheld his removal.

ACTION: The Merit System Board directed that this request be denied.

B-19 JUAN C. BETANCOURTH
Juan C. Betancourth, represented by Peter J. Cresci, Esq., requests that the Merit System Board review the certification of the list for Police Officer (S9999A), City of Bayonne, based on the fact that he received and passed medical and psychological examinations.

ACTION: The Merit System Board directed that the appellant be given an
appointment from the certification absent disqualification after an updated background check.

B-20 MANAGEMENT INFORMATION SYSTEMS SPECIALIST (C6664A), ESSEX COUNTY
The appointing authority requests permission not to make an appointment from the certification for Management Information Systems Specialist (C6664A), Essex County.

ACTION: The Merit System Board granted request for appointment waiver, but
accessed for the costs of the selection process in the amount of $2,048.

B-21 LARRY AUSTIN, ET AL.
Larry Austin, Karl Scheiner, and Paul Ward appeal the determinations of the Division of Selection Services which found that they did not meet the experience requirements for the open-competitive examination for Veteran's Service Officer (40109C), Passaic County.

ACTION: The Merit System Board directed that these appeals be denied.

B-22 CAROL BARR, ET AL.
Carol Barr, Lynette Benton, Kathleen Brown, William Davis, Asha Desai, Diana Ling, Kantilal Sharma and James Trussell appeal the determinations of the Division of Selection Services which found that they did not meet the experience, or education and experience, requirements for the open-competitive examination for Administrative Analyst 4 (S6376B), Statewide.

ACTION: The Merit System Board directed that these appeals be denied.

B-25 SAMUEL A. DIFALCO, JR.
The Division of Selection Services, on behalf of the Department of Environmental Protection, requests that the minimum eligibility requirements be waived in order to effectuate a lateral title change and satisfy the open competitive requirements for a qualifying examination for Samuel A. DiFalco, Jr. for the title of Affirmative Action Officer 3.

ACTION: The Merit System Board directed that this request be granted.

B-26 ANGELA S. FAGEN AND DARLA A. O'ROURKE
The Essex County appointing authority, on behalf of Angela S. Fagen and Darla A. O'Rourke, appeals the determinations of the Division of Selection Services, which found that they did not meet the experience requirements for the promotional examination for Office Service Manager (PC0761B), Essex County.

ACTION: The Merit System Board directed that these appeals be granted.

Debra Fusco appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, she was below the minimum requirements in experience for the promotional examination for Administrative Analyst 1 (PS9468K), Division of Family Development.

B-42 TONI HILSIN
The appeal of Toni Hilsin, an Environmental Specialist (Waste Management) with the Department of Environmental Protection, concerning her layoff, effective July 8, 1994, for reasons of economy and efficiency, was heard by Administrative Law Judge Joseph F. Martone (ALJ), who rendered his initial decision on July 26, 2001, recommending that the layoff be reversed. At its meeting of December 18, 2001, the Board adopted the ALJ's recommendation. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-44 DEPARTMENT OF CORRECTIONS, OFFICE OF INFORMATION TECHNOLOGY TITLES
The Manager, Division of Human Resource Management, on behalf of the Department of Corrections, requests the acceptance of out-of-title work experience of employees currently classified in the titles of Computer Operator 1, 2, and 3, and in the title of Communications Systems Technician 2, in order to qualify for either a lateral title change or a promotion, pending examination, to the Technical Assistant MIS, Technician MIS, Senior Technician MIS, and Technical Support Specialist 2 titles.

ACTION: The Merit System Board directed that this request be granted.
