    A regular meeting of the Civil Service Commission was held on Wednesday, February 4, 2015, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

 

WITHDRAWAL OF APPEALS

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3      DEREK JOVANOVIC  

Derek Jovanovic, Correction Officer Recruit, New Jersey State Prison, Department of Corrections, removal effective June 4, 2014, on charges of conduct unbecoming a public employee, other sufficient cause, falsification, divulging confidential information without proper authority, violation of administrative procedures and/or regulations involving safety and security, violation of a rule, regulation, policy, procedure, order or administrative decision. 

 

Recommendation of the Administrative Law Judge - Modify the removal to a ninety working day suspension.

 

            ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a 120 working day suspension.

Charles Lindsey, Correction Officer Recruit, Northern State Prison, Department of Corrections, removal effective April 17, 2014, on charges of conduct unbecoming a public employee, other sufficient cause and violation of a rule, regulation, policy, procedure or an administrative order.

 

Recommendation of the Administrative Law Judge - Grant summary decision and uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Armond Lucas, Laborer 1, Township of Union, Department of Public Works, 15 working day suspension on charges of insubordination, chronic or excessive absenteeism or lateness, conduct unbecoming a public employee, neglect of duty and other sufficient cause. 

 

Recommendation of the Administrative Law Judge - Dismiss the appeal for lack of prosecution.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6      TIFFANY MAYES  

Tiffany Mayes, Communications Operator, Secured Facilities, Garden State Youth Correctional Facility, Department of Corrections, 15 working day suspension on charges of insubordination and conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Modify the 15 working day suspension to a 7 working day suspension.

      

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the 15 working day suspension.

 

A-7      CARLOS NIEVES

 

Carlos Nieves, Senior Correction Officer, Central Office, Department of Corrections, 60 working day suspension on charges of conduct unbecoming a public employee, other sufficient cause, falsification and violation of a rule, regulation, policy, procedure, order, or administrative decision. 

 

Recommendation of the Administrative Law Judge - Modify the 60 working day suspension to a 22 working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8      KEITH O'BRIEN

 

Keith O'Brien, Police Officer, Jersey City, Police Department, removal effective December 5, 2013, on charges of violation of the rule regarding narcotic use and conduct unbecoming a public employee, neglect of duty and other sufficient cause. 

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-9      KAREEM TURBEVILLE 

Kareem Turbeville, Human Services Assistant, Ancora Psychiatric Hospital, removal effective May 8, 2013, on charges of conduct unbecoming a public employee, other sufficient cause, physical or mental abuse of a patient, client, resident or employee, and violation of a rule, regulation, policy, procedure, order or an administrative decision.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:     The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a six month suspension.

 

A-10    MATTHEW VILARDO

 

Matthew Vilardo, Laborer 1, Jersey City Public School District, removal effective April 25, 2014, on the charge of conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

           

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Paul Williams, Truck Driver, Heavy, Township of Lakewood, Department of Public Works, removal effective January 7, 2014, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a six month suspension and directed that the appellant undergo a psychological examination.

 

A-12    ROBERT P. WILLIAMS

 

Robert P. Williams, Plumber, Newark School District, removal effective March 18, 2014, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Valerie Bradbury, Police Officer, City of Newark, 45-day suspension on charges of violation of rules and regulations regarding demonstration of respect, responsibility for own actions, compliance with lawful orders, failure to report for duty promptly, disobedience of orders, and failure to report off duty.

 

Recommendation of the Administrative Law Judge - Uphold the 45-day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-17    VENUS YOUNG

 

Venus Young, Senior Correction Officer, East Jersey State Prison, 20 working day suspension on charges of neglect of duty, other sufficient cause, and conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Uphold the 20 working day suspension.  

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Aaron Dartee, Human Services Assistant, New Lisbon Developmental Center, removal effective May 15, 2013, on charges of physical abuse of a client, inappropriate physical contact or mistreatment of a client, falsification, violation of a rule, regulation, policy, procedure, or administrative decision, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

           

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-2      S. F. - CSC DOCKET NO. 2014-2324

 

S. F. appeals his rejection as a Fire Fighter candidate by Plainfield and its request to remove his name from the eligible list for Fire Fighter (M2564M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-3      A. M. - CSC DOCKET NO. 2014-2139

 

A.M. appeals his rejection as a Fire Fighter candidate by Hoboken and its request to remove his name from the eligible list for Fire Fighter (M2537M) on the basis of psychological unfitness to perform effectively the duties of the position.

T.W.O., represented by Darryl M. Saunders, Esq., appeals his rejection as a Police Officer candidate by the Dover Police Department and its request to remove his name from the eligible list for Police Officer (S9999M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-6      JOSEPH SALANITRO - CSC DOCKET NO. 2015-297

 

Joseph Salanitro, a Correction Sergeant with the Adult Diagnostic and Treatment Center, Department of Corrections, requests enforcement of the May 7, 2014 Civil Service Commission's decision, which granted him a retroactive date of appointment to the title of Correction Sergeant, effective January 7, 2006, and entitlement to all seniority based benefits.

 

ACTION:       The Civil Service Commission directed that this request be granted in part.

 

B-7      KENNETH POOLE - CSC DOCKET NO. 2015-1570

 

Kenneth Poole, a former Recreation Program Specialist with Passaic County, requests that his withdrawn good faith layoff appeal be reinstated and transmitted to the Office of Administrative Law for a hearing.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-8      TOMORY BOYER - CSC DOCKET NO. 2014-3104

 

Tomory Boyer, a Parole Officer Recruit with the State Parole Board, appeals the determination of the State Parole Board that his grievance was not timely filed.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-9      ELIZABETH BOWMAN - CSC DOCKET NO. 2015-1910

 

The Department of Children and Families, on behalf of Elizabeth Bowman, requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit Ms. Bowman to retroactively donate 19 sick days to Keith Dienes.

 

ACTION:       The Civil Service Commission directed that this request be granted.

Admira Marah, an Assistant Director of Nursing Services 1, Developmental Disabilities with the Department of Human Services, North Jersey Developmental Center, represented by Robert Yaeger, CWA Local 1040, appeals her demotion in lieu of layoff to Supervisor of Nursing Services at Greystone Park Psychiatric Hospital.

Carol Hardy appeals the determination that she was not permanent with the Newark School District upon the termination of her employment as a Confidential Assistant effective August 1, 2014.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-18    DENISE ILLES - CSC DOCKET NO. 2015-1864

 

The Division of Agency Services, on behalf of the Department of Banking and Insurance, requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Denise Illes to be provisionally appointed, pending promotional examination procedures, to the competitive title of Regulatory Officer 1.

 

ACTION:       The Civil Service Commission directed that this request be granted.

Toni Francis appeals the decision of the Division of Selection Services denying her request for a make-up for the open-competitive examination for Recreation Assistant (S0158S).

CSC DOCKET NO. 2015-1925

 

The Superior Court of New Jersey, Appellate Division, has remanded In the Matter of Police Captain (PM7521P), Jackson (CSC, decided June 5, 2013) to the Civil Service Commission for further review regarding the issue of scope of eligibility.

 

ACTION:       The Civil Service Commission directed that the Police Captain (PM7521P), Jackson examination was properly opened to the next two in-series titles of Police Sergeant and Police Lieutenant.

 

B-143  K. B. - CSC DOCKET NO. 2014-885

 

K. B. appeals the request by the County of Essex to remove his name from the County Correction Officer (C9979M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-144  L. E. - CSC DOCKET NO. 2015-6

 

L. E. appeals the request by the County of Essex to remove her name from the County Correction Officer (C9979M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

R. R. appeals the request by the County of Essex to remove her name from the County Correction Officer (C9979M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-146  P. Z. - CSC DOCKET NO. 2014-417

 

P. Z. appeals the request by the County of Middlesex to remove his name from the Juvenile Detention Officer (C0790P) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-147  RICHARD DIZENZO - CSC DOCKET NO. 2015-2209

 

The Borough of Woodland Park, on behalf of Richard DiZenzo, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remainder of his working test period as a Police Officer, Borough of Woodland Park.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-148  KENNETH BREITEN - CSC DOCKET NO. 2014-2430

 

Kenneth Breiten, a Trooper 1 with the Division of State Police, Department of Law and Public Safety, requests restoration of prior State service in order for his personnel record to reflect continuous service.

 

ACTION:       The Civil Service Commission directed that this petition be granted in part.

 

B-149  LAMAR MACKSON - CSC DOCKET NO. 2015-1130

 

Lamar Mackson, represented by Dayna R. Katz, Esq., appeals the City of Plainfield's decision to discontinue his provisional appointment as a Media Technician, effective June 18, 2014.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-150  CATHYJO ROGOSICH - CSC DOCKET NO. 2014-2333

 

Cathyjo Rogosich, a Keyboarding Clerk 1 with the West Milford Municipal Utilities Authority, represented by John M. Barbarula, Jr., Esq., petitions the Civil Service Commission for relief pursuant to the order of the Superior Court of New Jersey.

 

ACTION:       The Civil Service Commission directed that this petition be denied.

 

B-151  ROBERT GILLEN - CSC DOCKET NOS. 2015-1823 AND 2015-1833

 

Robert Gillen petitions the Civil Service Commission for a reconsideration and stay, of In the Matter of Joseph Lang, et al., Harrison (CSC, decided December 3, 2014).

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-152  JOSEPH SALANITRO - CSC DOCKET NO. 2015-1746

 

Joseph Salanitro requests reconsideration of the final administrative determination in In the Matter of Joseph Salanitro, Correction Sergeant (PS5613I and PS1818I), Department of Corrections (CSC, decided May 7, 2014).

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-153  K. S. - CSC DOCKET NO. 2015-705

 

K. S., a Correction Major with the Department of Corrections appeals the decision of the Assistant Director of the Equal Employment Division of the DOC which determined that it did not have jurisdiction to investigate K.S.'s allegation that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this matter be remanded to the Department of Corrections' Equal Employment Division to conduct an investigation.

 

B-154  M. W. - CSC DOCKET NO. 2015-1737

 

M. W., a Communications Operator, Secured Facilities with the Department of Corrections, appeals the decision of the Assistant Director of the Equal Employment Division of the DOC which determined that it did not substantiate M.W.'s allegation that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part with respect to the packages sent to E.N. and K.S. and this matter be remanded to the Department of Corrections' Equal Employment Division to conduct an investigation.

 

B-155  MICHELE TAYLOR - CSC DOCKET NO. 2015-2127

 

Michele Taylor appeals the determination of the former Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Technical Assistant, Personnel (PS9201T), Department of Transportation.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-156  MARK HRUSKA - CSC DOCKET NO. 2015-2202

 

Mark Hruska, represented by Craig Gumpel, Esq., requests reconsideration of that part of the decision of the Civil Service Commission, rendered on December 17, 2014, which denied him a waiver of the promotional examination for Fire Captain and a retroactive date of appointment.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-157  WILLIAM HAWKINS - CSC DOCKET NO. 2015-1227

 

William Hawkins requests that his title seniority as a Police Officer with the Borough of Somerdale be applied to his current title of Senior Police Officer, Human Services.

 

ACTION:       The Civil Service Commission directed that this request be granted in part.
