NOTICE: Please be advised that at this time, due to the circumstances surrounding the ongoing COVID-19 pandemic and the Governor’s direction to strictly observe the practice of social distancing, including avoiding all non-essential travel and directing State employees to work remotely, the New Jersey Department of Environmental Protection (NJDEP) may not be able to fully respond to record requests within the prescribed timeframe under the Open Public Records Act, N.J.S.A. 47:1A-1 et seq (OPRA) while maintaining consistency with the Governor’s social distancing directives. The NJDEP work force has transitioned to work remotely from home, impacting the NJDEP’s ability to access onsite and archived government records, conduct onsite inspections, and copy responsive records.
In accordance with N.J.S.A. 47:1A-5(i)(2), the NJDEP will make every reasonable effort to provide complete responses to record requests within the timeframes required under OPRA. If the NJDEP is unable to respond to a request due to the inability to access onsite and archived government records, provide access thereto or otherwise, the NJDEP will promptly notify the requesting party of any limitations on the response and supplement the response when resources allow.
