    A regular meeting of the Civil Service Commission was held on Wednesday, March 4, 2015, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

 

WITHDRAWAL OF APPEALS

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3      DASHICA L. JORDAN

 

Dashica L. Jordan, Juvenile Detention Officer, Hudson County, Department of Corrections, 45 working day suspension, on charges of neglect of duty, insubordination, conduct unbecoming a public employee, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the 45 working day suspension to a 15 working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4      TYRONE MOORE

 

Tyrone Moore, Police Officer, City of Newark, Police Department, six month suspension, on charges of chronic inefficiency or incompetency and disobedience of orders.

 

Recommendation of the Administrative Law Judge - Uphold the six month suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Maxine Reid, Social Work Specialist, Middlesex County Board of Social Services, 10 working day suspension, on charges of conduct unbecoming a public employee, and other sufficient cause.

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-2      E. T. - CSC DOCKET NO. 2014-1785

 

E. T., represented by Craig S. Gumpel, Esq., appeals his rejection as a Fire Fighter candidate by Linden and its request to remove his name from the eligible list for Fire Fighter (M2546M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-3      I. V. - CSC DOCKET NO. 2014-840

 

I.V., appeals his rejection as a County Correction Officer candidate by Essex County and its request to remove his name from the eligible list for County Correction Officer (C9979M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-4      L. M. W. - CSC DOCKET NO. 2014-2390

 

L. M. W., appeals his rejection as a Fire Fighter candidate by Plainfield and its request to remove his name from the eligible list for Fire Fighter (M2564M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-5      JOHN BUONANNO - CSC DOCKET NO. 2015-407

 

The Superior Court of New Jersey, Appellate Division, has remanded the issue of John Buonanno's status as a Construction Official with the Borough of Elmwood Park to the Civil Service Commission.

 

ACTION:       The Civil Service Commission directed that this matter be held over.

 

B-6      JUSTIN GABRYS - CSC DOCKET NO. 2015-1800

 

The Appellate Division, Superior Court of New Jersey, reversed and remanded the determination of the Civil Service Commission, In the Matter of Justin Gabrys, Town of Dover, (CSC, decided September 19, 2012) which granted Dover's request to change Gabrys' resignation to an unpaid leave of absence and to retain his accrued seniority.

 

ACTION:       The Civil Service Commission directed that Justin Gabrys' personnel record be revised to indicate his resignation in good standing as a Police Officer and his subsequent appointment from the regular reemployment list for Police Officer, and his record for the promotional examination for Police Sergeant (PM5089M) be revised to indicate that he is ineligible because he does not have the required three years of continuous permanent service prior to its closing date.

 

B-7      MHYLENE ALEXANDER - CSC DOCKET NO. 2015-1446

 

Mhylene Alexander, a Cottage Training Technician with the Department of Human Services, Vineland Developmental Center, appeals her lateral displacement in lieu of layoff to the same title at Woodbine Developmental Center.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-8      LOUIS IBEKWE - CSC DOCKET NO. 2015-1698

 

Louis Ibekwe, a Cottage Training Technician with the Department of Human Services, Green Brook Regional Center, appeals his demotion in lieu of layoff to Human Services Assistant, effective June 27, 2014.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Henry Li appeals the calculation of performance assessment review (PAR) points and requests that several PAR ratings be averaged to produce a PAR score for the examination for Environmental Engineer 3 (PS8742G), Department of Environmental Protection.

B-18    KAREN CAINE - CSC DOCKET NO. 2014-2363

 

Karen Caine appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Investigator, Communicable Diseases (C1034P), Ocean County eligible list on the basis of her failure to respond to the notice of certification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-19    DENNIS DIGGINS - CSC DOCKET NO. 2015-1809

 

Dennis Diggins appeals the decision of the former Division of Classification and Personnel Management, which upheld the removal of his name from the County Park Ranger (C2397N), Monmouth County, eligible list, on the basis of his failure to complete pre-employment processing.

Afia Shelly, represented by Nancy A. O'Donnell, Esq., appeals the decision of the former Division of Classification and Personnel Management, which upheld the removal of her name from the Correction Officer Recruit (S9988R), Department of Corrections, eligible list on the basis of falsification of her employment application.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-23    LAURENCE SIMON - CSC DOCKET NO. 2015-139

 

Laurence Simon appeals the decision of the Division of Classification and Personnel Management which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Human Services Specialist 1 (C0073P), Ocean County Board of Social Services eligible list on the basis of his unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-24    ANTHONY WALKER - CSC DOCKET NO. 2015-1091

 

Anthony Walker appeals the determination of the Division of Classification and Personnel Management upholding the removal of his name from the eligible list for Correction Officer Recruit (S9988R), Department of Corrections, on the basis of falsification of application and an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-25    DAISY BEAUCHAMPS, ET AL. - CSC DOCKET NO. 2015-1178, ET AL

 

Daisy Beauchamps, Andrea DeJesus, Shelisa Odom and Virginia Scarborough, represented by Brett Richter, Executive Vice President, CWA Local 1039, appeal the decision of the former Division of Classification and Personnel Management that determined the proper classifications of their positions with the Department of Community Affairs are Principal Clerk.  The appellants all seek a Technical Assistant 3, Community Affairs job classifications.

 

ACTION:       The Civil Service Commission directed that this matter be held over.

 

B-26    DIANA BOESCH - CSC DOCKET NO. 2014-1869

 

Diana Boesch, represented by Brad Myhre, Staff Representative, Communications Workers of America, Local 1036, appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with Hunterdon County is Secretarial Assistant, effective June 29, 2013.  The appellant seeks an Administrative Secretary job classification and an earlier effective date.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part.

 

B-27    JOYCE HURLEY - CSC DOCKET NO. 2015-618

 

Joyce Hurley appeals the decision of the Division of Classification and Personnel Management that determined the proper classification of her position with New Jersey City University is Senior Clerk Typist.  The appellant seeks a Secretarial Assistant 3, Non-Stenographic job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Sheree Johnson appeals the decision of the Division of Classification and Personnel Management, which found that her position with the Department of the Treasury is properly classified as Supervisor of Operations.  The appellant seeks a Chief of Operations, Treasury job classification.

B-34    INDERA RESAL-PERSAUD - CSC DOCKET NO. 2015-1051

 

Indera Resal-Persaud appeals the decision of the former Division of Classification and Personnel Management that the proper classification of her position with the Jersey City School District is Principal Account Clerk.  The appellant seeks a Transportation Analyst job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-35    LAUREN WEIGOLD - CSC DOCKET NO. 2015-619

 

Lauren Weigold appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Department of the Treasury is Administrative Analyst 3, Data Processing.  The appellant seeks an Administrative Analyst 2, Data Processing job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-36    D. N. - CSC DOCKET NO. 2014-2627

 

D. N., an Auditor 2, Taxation, with the Department of the Treasury, appeals the determination of the Affirmative Action Officer, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-37    S. L.-W. - CSC DOCKET NO. 2013-1902

 

S. L.-W., a former Principal Occupational Therapist with New Lisbon Developmental Center, Department of Human Services, represented by Joshua Boyette, Esq., appeals the determination of the Assistant Commissioner of DHS stating that there was probable cause to substantiate a finding that she violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied but the appointing authority be fined $1,000 for its untimely investigation.

 

B-38    DEREK JOVANOVIC - CSC DOCKET NO. 2014-2156

 

Derek Jovanovic, a Correction Officer Recruit with the New Jersey State Prison, Department of Corrections, of his removal, effective June 4, 2014, on charges, was heard by Administrative Law Judge Sarah G. Crowley (ALJ), who rendered her initial decision on December 1, 2014.  At its meeting on February 4, 2015, the Civil Service Commission did not adopt the ALJ's recommendation to modify the removal to a 90 working day suspension.  Rather, the Commission imposed a 120 working day suspension.  The proposed decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the decision.

 

B-39    TIFFANY MAYES - CSC DOCKET NO. 2014-1147

 

The appeal of Tiffany Mayes, a Communications Operator with the Garden State Youth Correctional Facility, Department of Corrections, of her 15 working day suspension, on charges, was heard by Administrative Law Judge Beatrice L. Tylutki (ALJ), who rendered her initial decision on December 15, 2014, modifying the 15 working day suspension to a seven working day suspension.  At its meeting on February 4, 2015, the Civil Service Commission did not adopt the ALJ's recommendation.  Rather, the Commission upheld the 15 working day suspension.  The proposed final decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the final decision.

 

B-40    KAREEM TURBEVILLE - CSC DOCKET NO. 2014-1269

 

Kareem Turbeville, a Human Services Assistant with Ancora Psychiatric Hospital, Department of Human Services, of his removal, effective May 8, 2013, on charges was heard by Administrative Law Judge Joseph A. Ascione (ALJ), who rendered his initial decision on December 3, 2014.  At its meeting on February 4, 2015, the Civil Service Commission did not adopt the ALJ's recommendation to reverse the removal.  Rather, the Commission modified the penalty to a six-month suspension.  The proposed decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the decision.

 

B-41    PAUL WILLIAMS - CSC DOCKET NO. 2014-1750

 

The appeal of Paul Williams, Truck Driver, Heavy, Township of Lakewood, Department of Public Works, of his removal effective January 7, 2014, on charges, was heard by Administrative Law Judge Joseph A. Ascione (ALJ), who rendered his initial decision on December 10, 2014.  At its meeting on February 4, 2015, the Civil Service Commission did not adopt the ALJ's recommendation to reverse the removal.  Rather, the Commission imposed a six-month suspension and ordered that the appellant undergo a fitness-for-duty examination.  The proposed decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the decision.

 

B-42    ACCOUNTING ASSISTANT - CSC DOCKET NO. 2015-1361

 

Middlesex County requests permission not to make an appointment from the April 14, 2014 certification for Accounting Assistant (C0961R).

 

ACTION:       The Civil Service Commission directed that this request be granted and assessed selection costs in the amount of $2,048.

 

B-43    MANAGEMENT SPECIALIST - CSC DOCKET NO. 2015-1933

 

The City of Ocean City requests permission not to make an appointment from the August 11, 2014 certification for Management Specialist (M0973R).

 

ACTION:       The Civil Service Commission directed that this request be granted and assessed selection costs in the amount of $2,048.

 

B-44    SENIOR ACCOUNTANT - CSC DOCKET NO. 2015-1364

 

Burlington County requests permission not to make an appointment from the June 13, 2014 certification for Senior Accountant (C0961R).

 

ACTION:       The Civil Service Commission directed that this request be granted and assessed selection costs in the amount of $2,048.

 

B-45    MICHAEL CIERI - CSC DOCKET NO. 2015-140

 

Michael Cieri, represented by Nancy A. Valentino, Esq., requests reconsideration of the final administrative decision, In the Matter of Michael Cieri, Correction Officer Recruit (S9987M), Department of Corrections, (CSC, decided May 21, 2014) which found that there was a sufficient basis to remove his name from the eligible list on the basis of falsification of the employment application.

 

ACTION:       The Civil Service Commission directed that this request be denied.

David Vibbert, a Park Maintenance Specialist 2 with the Department of Environmental Protection, represented by Francine W. Kaplan, Esq., requests reconsideration of the decision rendered on July 16, 2014 with respect to counsel fees regarding the modification of his ten working day suspension to a five working day suspension.

ACTION:       The Civil Service Commission directed that these appeals be denied.

Robert Christopher and George Kelly appeal their scores on the promotional examination for Equipment Operator (PC0677R), Middlesex County.

S. F., a former Deputy Attorney General with the Office of the Attorney General, Department of Law and Public Safety, petitions the Civil Service Commission for enforcement of the decision rendered on February 12, 2014 ordering her approval for her retroactive participation in the Donated Leave Program.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-61    DANA PALUMBO - CSC DOCKET NO. 2015-371

 

Dana Palumbo appeals the decision of the former Division of Classification and Personnel Management, which upheld the removal of her name from the Correction Officer Recruit (S9988R), Department of Corrections, eligible list on the basis of an unsatisfactory criminal history.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-62    S. J. - CSC DOCKET NO. 2013-990

 

S. J., a Staff Clinical Psychologist 3 with the Woodbine Developmental Center, Department of Human Services, appeals the determination of the Assistant Commissioner, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-63    PLANNING AIDE (C0094M), PASSAIC COUNTY - CSC DOCKET NO. 2014-3107

 

In In the Matter of Planning Aide (C0094M), Passaic County (CSC, decided August 1, 2012), the Civil Service Commission granted the request of Passaic County for an appointment waiver for the May 9, 2011 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration.  However, Passaic did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

 

ACTION:       The Civil Service Commission assessed selection costs in the amount of $2,048.

 

B-64    ROBERT BRENNAN - CSC DOCKET NO. 2014-2632

 

Robert Brennan appeals his score that was below the minimum rating in Written Part 1 for the open competitive examination for Law Enforcement Series (S9999R), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Jasmine Osol appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the open competitive examination for Public Health Consultant 1, Nursing (S0288S), Statewide.

B-67    SCOTT SELIGA - CSC DOCKET NO. 2014-2464

 

Scott Seliga, a Police Captain with Pleasantville, represented by Steven R. Cohen, Esq., requests counsel fees in accordance with the Civil Service Commission decision rendered on February 12, 2014.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part and the petitioner be awarded $38,412.50 in counsel fees and $545.44 in costs.

 

B-68    FRANCIS MCHALE - CSC DOCKET NO. 2014-529

 

Francis McHale, a Correction Sergeant with New Jersey State Prison, Department of Corrections, represented by William G. Blaney, Esq., petitions the Civil Service Commission for a determination with regard to the back pay and benefits awarded in In the Matter of Francis McHale (CSC, decided June 26, 2013).

 

ACTION:       The Civil Service Commission directed that this petition be granted in part.

Andrew Dillman requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit him to donate 30 sick days to S.B.

The Division of Classification and Personnel Management, on behalf of the Department of the Treasury, requests that David Stout be promoted from his current non-competitive title, Senior Garage Attendant, at the Department of the Treasury, to Storekeeper 2, an un-related, competitive title at the Department of the Treasury.

Tracy Robidoux appeals the decision of the former Division of Classification and Personnel Management that her position with the Department of Corrections is properly classified as a Technical Assistant, Contract Administration.  The appellant seeks an Administrative Analyst 3, Fiscal Management job classification.

S.             William Wagner, a former Crew Supervisor, Mechanics, with the Department of Transportation, requests compensation for 64 hours of unused vacation days upon his June 16, 2014 resignation in good standing.

CSC DOCKET NO. 2015-2341

 

Richard T. Burke, Warren County Prosecutor, requests that the Warren County Prosecutor's Office be permitted to increase the number of employees in the unclassified Prosecutor's Agent title beyond the limit set in In the Matter of Prosecutor's Agents (MSB, decided May 23, 1989).

B-82    CRAIG WILLIAMS - CSC DOCKET NO. 2014-1048

 

Craig Williams, represented by Kathleen Fantacone Mazzouccolo, Staff Attorney, AFSCME, New Jersey Council 52, petitions the Civil Service Commission for reconsideration of its final administrative decision, rendered on September 4, 2013, in which the Commission upheld the petitioner's removal.
